CHAPTER 1267

Economic Development Overlay District

1267.01 PURPOSE.

   The purposes of the Economic Development Overlay are to:
   (a)   Provide the Village with the opportunity to make enhanced economic development use of certain parcels of land without modifying the underlying residential zoning or adversely impacting adjacent residential properties.
   (b)   Insure that the appropriate use and value of property adjacent to such developments will not suffer a significant negative impact.
   (c)   Recognize the unique nature of specific parcels as identified by the Planning Commission and Village Council and to provide for the orderly development of those properties in a manner compatible with surrounding residential properties.

1267.02 ESTABLISHMENT OF ECONOMIC DEVELOPMENT OVERLAY DISTRICT.

   Land within an R-1 Country Home District may be developed in accordance with the terms and provisions of this chapter for Economic Development Overlay Districts in lieu of compliance with the standard provisions of Sections 1266.03 through 1266.10, when such an Overlay District is approved as a conditional use by the Planning Commission pursuant to the procedures set forth in Section 1258.07. In such instances, the provisions of Chapter 1267 shall apply and take precedence over the provisions of Sections 1266.03 through 1266.10.

1267.03 CRITERIA FOR ESTABLISHMENT.

   The Planning Commission may approve property to be developed as an Economic Development Overlay provided that:
   (a)   The proposed development advances the purposes set forth in Section 1267.01.
   (b)   The proposed development complies with all of the provisions of Sections 1294.02 and 1294.03.
   (c)   The proposed development contains a minimum of 15 acres of land, provided however, that after an Economic Development Overlay District is established, additional contiguous areas of any size my be added as extensions of the original Overlay District.
   (d)   Each Economic Development Overlay District shall be developed and maintained in accordance with a development plan that conforms to Section 1258.05 and which has been approved pursuant to the provisions of Section 1258.07.
   (e)   Such approval is designated for the specific applicant, uses, and operations and any changes to ownership, use, or operation shall be prohibited unless specifically authorized by the Planning Commission.

1267.04 PERMITTED USES.

   (a)   Conditional Uses. Uses listed in the Schedule of Permitted Uses denoted by the letter "C" may be permitted as a conditional use where determined to be appropriate by the Planning Commission and subject to all conditions and standards attached to such approval by the Planning Commission.
   (b)   Accessory Uses. A use listed in the Schedule of Permitted Uses shall be permitted as an accessory use when denoted by the letter "A". Such use shall be permitted as a subordinate building or use when it is clearly incidental to and located on the same lot as the principal building or use and it complies with all other of this Zoning Code.

1267.05 SETBACK REQUIREMENTS.

   Setbacks and building separations shall be as determined and approved by the Planning Commission as part of the development plan approval for the Economic Development Overlay, provided however, that such setbacks shall not be less than set forth in the following Schedule of Setback Requirements:

1267.06 HEIGHT REGULATIONS.

   Buildings and structures shall comply with the height regulations set forth below:
   (a)   Principal buildings shall not exceed a height of four stories or 56 feet.
   (b)   Accessory buildings shall not exceed 25 feet.
   (c)   Mechanical rooms, mechanical equipment, chimneys, flagpoles, water tanks and other appurtenances may be erected above such maximum height, but are limited to a height not exceeding 65 feet above finished grade.
   (d)   Architectural or decorative features may extend above the maximum building height but shall not exceed a total of 60 feet from grade.

1267.07 ACCESSORY USE REGULATIONS.

   Accessory uses, buildings and structures permitted in the Economic Development Overlay as set forth in Section 1267.02 shall conform to the following requirements:
   (a)   Fences and Walls. Fences and walls shall be permitted accessory uses provided they comply with Chapter 1298 , Landscaping, Screening and Outdoor Lighting Regulations.
   (b)   Signs. Signs shall be permitted accessory uses provided they comply with Section 1267.08 (d), Section 1267.09 (e), and the regulations of Chapter 1296 .

1267.08 DEVELOPMENT STANDARDS.

   (a)   In an Economic Development Overlay, all exterior wall areas of each elevation of any building or other structure erected or the expansion of existing buildings and other structures shall be constructed of brick, split face block or such other materials as may be approved by the Planning Commission.
   (b)   Each proposed development or redevelopment of property within the District shall be subject to development plan review as provided in Section 1258.05.
   (c)   In recognition of the special character of the Economic Development Overlay and its future development with respect to the mixture of permitted uses and the unique development opportunity it represents, the Planning Commission shall have the authority and responsibility to consider, in addition to the other standards set forth in Section 1258.05, the compatibility of any proposed use within the District.

1267.09 SUPPLEMENTAL REGULATIONS.

   (a)   For purposes of this chapter "medical facilities" shall mean those facilities that provide medical care or treatment that is not customarily provided in a medical office. Medical facilities shall include hospitals, surgical center, outpatient clinics, emergency rooms, trauma centers, nursing homes, assisted living facilities, and similar uses.
   (b)   All operations required in the use of the premises shall be enclosed within a building or structure or stored outdoors in such a nature so as to conceal all such items from the view of any person standing at the nearest residential district line and at the street line of the nearest public street.
   (c)   No road or driveway serving an Economic Development Overlay shall have connection with or discharge traffic into a residential district of the Village other than on Alexander Road.
   (d)   Permanent signs attached to buildings.
