TRAFFIC, PARKING AND ACCESS

17.601 - VISIBILITY AND CLEARANCE.

There shall be an unoccupied triangular vision clearance space at the street corner of a corner lot which is bounded by the street lines and a setback line connecting points 10 feet from the corner on each street line. In the case of arterial streets intersecting with other arterial streets or railways, the corner cut-off distances establishing the triangular vision clearance space shall be increased to 50 feet. No obstructions such as structures, parking or vegetation, except for necessary highway and traffic signs or public utility lines, shall be permitted in any district between the heights of 2.5 feet and 10 feet above the curb level.

17.602 - LOADING REQUIREMENTS. (Am. Ord. #20-21(2021))

(1)

Loading Space Required. At any time any use is changed or building is erected, enlarged, extended, or increased, adequate loading space shall be provided. Adequate loading space shall be determined by the builder, developer, consultant, or property owner. Justification of why the provided loading space is considered adequate for the development shall be provided to the City during the site plan review process.

(a)

Each loading space shall be located to facilitate unobstructed access to all public streets and alleys, shall not interfere with other vehicular or pedestrian traffic, and shall not interfere with the function of parking areas. In no instance shall loading areas rely on backing movements into public rights-of-way while in use.

(b)

All loading space(s) shall be completely contained on the lot it is intended to serve unless determined unfeasible by the Zoning Administrator.

(c)

No loading space shall extend over any pedestrian sidewalk or bicycle path.

(d)

No loading space shall negatively affect the safety or flow of traffic.

(e)

At no time should the loading or unloading process for a development negatively affect public or vehicular safety. If such does occur, the development may be required to construct proper loading areas or change their loading process to mitigate safety concerns.

(2)

Exception. Any development located with the B2 Central Business District or B7 Riverfront District shall be exempt from providing loading spaces as required by this section.

(a)

At no time should the loading or unloading process for a development obstruct the passage of traffic in an alleyway or any other public right-of-way due to lack of or insufficient loading space.

17.603 - PARKING REQUIREMENTS. (Am. Ords. #04-21; #20-21(2021); Am. Ord. #13-2023)

In all districts and in connection with every use, there shall be provided at the time any use or building is erected, enlarged, extended or increased, off-street parking stalls for all vehicles in accordance with the following:

(1)

Adequate Access. See Chapter 8.11 Public Works, Municipal Code Waupaca Wisconsin for driveway width requirements.

(2)

Size. The size of each parking space shall be not less than nine feet by 18 feet, exclusive of the space required for ingress and egress.

(3)

Location. The location shall be on the same lot as the principal use or not over 400 feet from the principal use. No parking stall or driveway, except in residential districts, shall be closer than 15 feet to a residential district lot line or a street line opposite a residential district lot line or a street line opposite a residential district with an appropriate landscape buffer as outlined in Subsection (6) below and approved by the Plan Commission.

(4)

Surfacing. All off-street parking areas shall be graded and surfaced so as to be dust-free and properly drained. Any parking area for more than five vehicles shall have the aisles and spaces clearly marked.

(5)

Curbs or Barriers. Curbs or barriers shall be installed so as to prevent the parked vehicles from extending over any lot lines.

(6)

Landscape Buffers. Buffers shall incorporate some combination of shrubs, berming, and deciduous and coniferous trees to provide an all-season screen, with an opacity of at least 60 percent at maturity (80 percent for outdoor storage facilities). Buffer yard landscaping shall have a minimum height of three feet at the time of planting. The use of berming or an opaque fence constructed of materials compatible with the building on the site may be approved by the Plan Commission in addition to landscaping. The location of buffer yard plantings shall be within 25 feet of the property line, except where necessary to avoid utility easements.

(7)

Exemption. Any development located with the B2 Central Business District or B7 Riverfront District shall be exempt from providing parking stalls as required by this section.

17.604 - BARRIER-FREE PARKING STALLS. (Am. Ord. #20-21(2021))

Barrier-Free Parking stalls. Where parking spaces are provided, barrier-free parking spaces shall be provided in accordance with all applicable federal and state requirements including the Americans with Disabilities Act and Chapter Comm 69 of the Wisconsin Administrative Code. The parking spaces provided under this paragraph shall be in addition to, and not in lieu of, any parking spaces required under other provisions of this section.

(1)

All parking spaces provided for the use of physically disabled persons shall be located as close as possible to an entrance that allows such persons to enter and leave the parking area without assistance.

(2)

All parking spaces provided for the use of physically disabled persons shall be marked with a sign which includes the international symbol for barrier-free environments and a statement informing the public that the parking space is reserved for use by physically disabled persons.

17.605 - NUMBER OF PARKING STALL REQUIRED. (Am. Ords. #04-21; #20-21(2021))

At any time any use is changed or building is erected, enlarged, extended or increased, adequate parking space shall be provided for vehicles in accordance with all of the following:

(1)

Single-Family and Two-Family Developments.

(a)

A minimum of 2 spaces per dwelling unit shall be provided for each development.

(2)

All Other Developments shall be required to provide an adequate parking justification report or parking study with their submitted application. A professionally completed traffic study, completed by a professional engineer, may be required to determine adequate off-street parking if the originally provided justification report is inadequate upon submittal.

(a)

Adequate off-street parking shall be based upon a justification report or parking study conducted by the builder, developer, or consultant, meeting all ADA, Building Code, and City requirements. The developer or property owner shall grant final approval of the parking study. If the parking study should prove to be inadequate or inaccurate after its approval, resulting in spillover to public right-of-way parking or causing any negative effects to public or vehicular safety, parking will be required to be modified to accommodate the needs or increased needs of the development.

(b)

The parking spaces, defined by the parking justification report or parking study, shall be shown on the site plan for approval by the Community Development Director, or designee, and final site plan approval granted by the City Plan Commission, as required.

(3)

Subsequent to the time that a use is begun or a building is erected, if such use or building is enlarged, extended, or increased, then a new parking justification report or parking study shall be submitted to the City pursuant to the requirements of this Section to ensure adequate off-street parking.

(4)

Exemption. Any development located with the B2 Central Business District or B7 Riverfront District shall be exempt from providing parking stalls as required by this section unless otherwise required by the Plan Commission.

(a)

At no time should customer or employee vehicle traffic or parking, within these districts, obstruct the passage of traffic in any public right-of-way due to lack of or insufficient parking. If the quantity of parking provided or that is located around the development proves to be inadequate for a development, resulting in any negative effects to public or vehicular safety, parking requirements may be placed on the development by the City.

17.606 - DRIVEWAYS. (Am. Ord. #13-2023)

All driveways installed, altered, changed, replaced or extended after November 3, 1967, shall meet the following requirements:

(1)

See Chapter 8.11 Public Works, Municipal Code Waupaca Wisconsin for driveway width requirements.

(2)

Vehicular Entrances and Exits. Vehicular entrances and exits to drive-in theaters, banks and restaurants; motels; funeral homes; vehicular sales, service washing and repair stations; garages; or public parking lots shall be not less than 200 feet from any pedestrian entrance on exit to a school, college, university, place of worship, hospital, park, playground, library, public emergency shelter or other place of public assembly.

17.607 - HIGHWAY ACCESS.

No direct private access shall be permitted to the existing or proposed rights-of-way nor to any controlled access arterial street without permission of the highway agency that has access control jurisdiction. No direct public or private access shall be permitted to the existing or proposed rights-of-way of the following:

(1)

Arterial streets intersecting another arterial street within 100 feet of the intersection of the right-of-way lines.

(2)

Streets intersecting an arterial street within 50 feet of the intersection of the right-of-way lines.

(3)

Access barriers such as curbing, fencing, ditching, landscaping or other topographic barriers shall be erected to prevent unauthorized vehicular ingress or egress to the above specified streets or highways.

(4)

Temporary access to the above rights-of-way requires a Conditional Use Permit. The Plan Commission shall grant a Conditional Use Permit after review and recommendation by the highway agencies having jurisdiction. Such access shall be temporary, revocable, and subject to any conditions required, and shall be issued for a period not to exceed 12 months.
