CHAPTER 12

EQUESTRIAN DEVELOPMENT AND USES

10-12-1: COMMERCIAL EQUESTRIAN DEVELOPMENT AND STABLES:

Commercial equestrian development and commercial stables may be a special use in each of the zoning districts in the Village subject to all of the procedures set forth this Title and subject to the following standards:
   A.   The special use shall be available only to contiguous parcels under single ownership of not less than twenty (20) acres in area.
   B.   The special use shall set forth in sufficient detail any new construction on the property subject to the special use, it being the intention of the Village to retain architectural control over any new construction. Any new or additional construction not approved at the time the special use is granted shall be approved by the Village Board prior to the issuance of a building permit.
   C.   The special use shall contain sufficient detail of landscaping designed to create a buffer between the subject property and any adjoining residential property.
   D.   The special use shall contain sufficient restrictions regarding manure disposal and removal, it being the intention to minimize any health hazards and annoyance to adjoining property owners.
   E.   The special use shall contain sufficient restrictions regarding the commercial aspects of the use of the subject property, including but not limited to parking for customers, guests, and trailers. Furthermore, said special use shall contain detailed restrictions relating to the number of horses and horse stalls, as well as, detailed restrictions on horse shows and special events.
   F.   The special use may contain any further or additional terms, conditions or restrictions as may be deemed reasonable and appropriate by the Village. (Ord. 89-13, 5-16-1989)

10-12-2: PRIVATE EQUESTRIAN FACILITIES:

Private equestrian facilities may be a special use in the W1 Single-Family Residence District in the Village, subject to all of the procedures set forth in this Title, and subject to the following standards:
   A.   The special use shall be available only to contiguous parcels under single ownership of not less than ten (10) acres in area.
   B.   The granting of a special use shall be predicated upon a finding by the corporate authorities that the special use will be compatible with the character of adjacent properties and will not adversely affect the health, safety and welfare of the Village or its residents.
   C.   The special use shall set forth in sufficient detail any new construction on the property subject to the special use and shall incorporate or be subject to later approval of a site plan, it being the intent of the Village to retain architectural, landscaping and site planning control over any new construction. Any new or additional construction not approved at the time the special use is granted shall be approved by ordinance prior to the commencement of the work or, if required, the issuance of a building permit.
   D.   The special use shall specify the maximum floor area and ground floor area for all buildings or structures, including stables and enclosed or covered arenas.
   E.   The special use shall provide for minimum setbacks and yard requirements for any buildings or structures which may, if appropriate, exceed setback and yard requirements in any zoning district.
   F.   The special use shall contain plans in sufficient detail for any landscaping buffers between the subject property and any adjoining residential property that may be required by the Village.
   G.   The special use shall contain sufficient provisions regarding manure disposal and removal, it being the intent to minimize any health hazards and annoyance to adjoining property owners.
   H.   The special use shall contain sufficient provisions regarding the location and amount of parking on the subject property to avoid traffic congestion.
   I.   The special use shall contain detailed provisions relating to the number of horses and horse stalls, as well as detailed provisions regarding the type and amount of equestrian or other special events on the subject property, if permitted.
   J.   The special use may contain any further or additional terms, provisions, conditions or restrictions as may be deemed reasonable and appropriate by the village, including, but not limited to, type and amount of fencing.
   K.   The special use shall satisfy all requirements set forth in section 10-4-7 of this title. (Ord. 97-19, 6-3-1997)
