CHAPTER 6

ZONING DISTRICTS AND MAP

10-6-1: ESTABLISHMENT OF DISTRICTS:

In order to carry out the purposes and provisions of this title, the village is hereby divided into the following districts:
Residence districts:
W1 Single-family residence
W2 Single-family residence
W3 Single-family residence
W4 Single-family residence
W5 Single-family residence (riverfront)
Business districts:
B Local shopping center
Historic districts:
Historic preservation 1
Commercial equestrian:
E Commercial equestrian

10-6-2: ZONING MAP:

   A.   Map Adopted By Reference: The location and boundaries of the districts established by this title are set forth on the zoning district map which is incorporated herein and hereby made a part of this title. The said map, together with everything shown thereon, and all amendments thereto, shall be as much a part of this title as though fully set forth and described herein. Said map shall be filed with the office of the village clerk, and certified copies thereof in the office of the zoning enforcement officer, and shall be open to public reference at all times during which those offices are open.
   B.   Current Map:
      1.   The current official zoning map of the Village of Wayne shall be incorporated herein by reference and remain on file with the Village Clerk of the Village of Wayne.
      2.   There is hereby established a fee of twenty dollars ($20.00) which shall be charged to any person desiring a copy of such map. Such fee shall be paid to the building and zoning department or to the village clerk and shall be applied to defray the cost of publication of the official map. (Ord. 89-13, 5-16-1989; amd. 10-6-3: BOUNDARIES OF DISTRICTS:

When uncertainty exists with respect to the boundaries of the various districts, as shown on the zoning district map, the following rules shall apply:
   A.   District boundary lines are either the centerlines of railroads, highways, streets, alleys or easements, tract or lot lines or such lines extended, unless otherwise indicated.
   B.   In areas not subdivided into lots and blocks, wherever a district is indicated as a strip adjacent to and paralleling a street, highway or railroad, the depth of such strips shall be in accordance with dimensions shown on maps measured at right angles from the center line of a street, highway or railroad, and the length of frontage shall be in accordance with dimensions shown on the Map from center lines of streets, highways or railroad rights of way unless otherwise indicated.
   C.   Where a district boundary line divides a lot in single ownership, the regulations for either portion of the lot may, in the owner's discretion, extend to the entire lot, but not more than twenty five feet (25') beyond the boundary of the district. (Ord. 89-13, 5-16-1989)
   D.   Any ordinance placing a particular parcel described therein within a specific zoning district shall control irrespective of the provisions contained in subsections A through C above. (1998 Code)

10-6-4: ZONING OF ANNEXED LANDS:

Any lands lying outside the corporate limits of the Village at the time of adoption of this Title and which shall thereafter be annexed to the Village shall thereupon become subject to the terms of this Title and shall be classified into the zoning district or districts as designated on the Comprehensive Plan Map of the Village then in effect, or if no such designation exists, the in the W1 Single-Family Residence District. 10-6-5: EXEMPTIONS:

   A.   Public Utility Uses: The following public utility uses are permitted in any district: conduits, vaults, laterals, pipes, pipelines, mains, valves, or any other similar ground level or below ground level distributing equipment, provided that installation shall conform with rules and regulations of the applicable administrative authorities.
Existing poles, towers, wires and cables installed above ground are also permitted. However, replacement of such facilities or newly constructed facilities shall be installed underground.
   B.   Agriculture Uses: Buildings, structures or land used for "agriculture", as herein defined, except that such use established after the effective date hereof, shall conform with all other regulations of the district in which it is located; and buildings for shelter of livestock or poultry shall be not less than two hundred feet (200') from a property line adjoining a street and fifty feet (50') from all other property lines. Furthermore, if such buildings or structures exist on a lot or parcel upon which a principal residence exists, such buildings and structures shall be in the rear yard. (Ord. 89-13, 5-16-1989)
