ARTICLE VI
MU General Mixed-Use District
§ 140-28 Purpose.
The intent of the MU General Mixed-Use District is to provide locations to accommodate general retail, service, finance, insurance and real estate and related structures and uses. General Mixed-Use Districts are often adjacent to residential districts to ensure that the population of the Town is adequately serviced. The impacts of these districts on surrounding residential areas are reduced by permitting residential occupancy and allowing the conversion or partial use of residential structures to business and professional uses.
§ 140-29 Permitted uses.
The following uses are permitted in the MU District:
A.
Single-family attached dwellings.
B.
Single-family detached dwellings.
C.
Two-family dwellings.
D.
Accessory apartments on the second floor of existing commercial structures.
§ 140-30 Accessory uses and structures.
The following are the accessory uses, buildings and structures permitted in the MU District, provided that such accessory uses and buildings shall not be constructed until the permitted use has been established:
A.
Commercial vehicle, but not more than one.
B.
Decks, terraces and patios located in the side or rear yard.
C.
Dish antennas three feet or less in diameter.
D.
Fences, walls and hedges subject to the provisions of § 140-119, Fences and walls.
E.
Home occupations, low-intensity.
F.
Horses or livestock, for personal use, provided there is compliance with the standards and conditions outlined in § 140-86, Horses and livestock.
G.
Off-street parking for residents and guests of the principal use.
H.
Private athletic facility, including but not limited to swimming pools or tennis courts, not operated for gain and not operated by a not-for-profit organization.
I.
Private detached garages, carports, pool houses, gazebos, patio covers.
J.
Signs subject to the provisions of § 140-129, Signs.
K.
Storage of no more than two recreation vehicles/utility trailers, except for items stored indoors, provided they comply with § 140-128.
L.
Storage sheds, but no more than two.
M.
Swimming pools as regulated in § 140-99, Swimming pools.
N.
Wind energy conversion systems (noncommercial) subject to the provisions of § 140-108.
O.
Other uses and structures that are customarily incidental and clearly subordinate to permitted uses or uses that require site plan review or special permit.
§ 140-31 Permitted uses subject to site plan review.
The following uses are permitted in the MU District subject to site plan review:
A.
Adult family day-care homes.
B.
Art studios.
C.
Bars and taverns.
D.
Bed-and-breakfasts.
E.
Building supply stores under 3,000 square feet.
F.
Day-care centers and nursery schools.
G.
Essential services.
H.
Family and group family day-care homes.
I.
Health clubs/fitness centers under 3,000 square feet.
J.
Multiple-family dwellings.
K.
Nursing or convalescent homes.
L.
Restaurants and bakeries, excluding drive-through restaurants.
M.
Retail sales and services in existing buildings of under 3,000 square feet or in new buildings.
N.
Places of worship.
O.
Professional offices.
P.
Public and semipublic facilities.
§ 140-32 Special permit uses.
The following uses are allowed as special permit uses in the MU District:
A.
Amusement enterprises not conducted within a completely enclosed building, including a carnival or circus.
B.
Automatic and manual car washes.
C.
Boardinghouses and rooming houses.
D.
Building supply store over 3,000 square feet.
E.
Business centers.
F.
Drive-through restaurants, bakeries and banks.
G.
Garden supply stores and nurseries.
H.
Health clubs/fitness centers over 3,000 square feet.
I.
Hotels or motels.
J.
Retail sales and services over 3,000 square feet.
K.
Self-storage warehouses.
L.
Vehicle rental services, subject to the additional requirements for specified uses in § 140-102.
M.
Vehicle repair stations with accessory automobile sales, subject to the additional requirements for specified uses in § 140-103.
N.
Vehicle sales, subject to the additional requirements for specified uses in § 140-104.
O.
Vehicle service stations, subject to the additional requirements for specified uses in § 140-105.
P.
Wireless communications facilities/towers in accordance with § 140-109.
Q.
Any use or business not specifically mentioned in this chapter which, in the opinion of the Planning Board, is similar in nature and scale to a use or business permitted within the MU District listed above.
§ 140-33 Lot, area and yard requirements.
The following lot, area and yard requirements apply to the MU District:
A.
Minimum lot width.
(1)
Residential uses:
(a)
Single-family: 80 feet.
(b)
Two-family: 80 feet.
(c)
Multifamily: 150 feet.
(2)
Nonresidential uses: 80 feet.
B.
Lot area requirements.
(1)
Residential uses:
(a)
Single-family detached and attached:

Minimum lot area: detached and attached: 20,000 square feet.

Maximum building coverage: 35%.
[3]
Maximum lot coverage: 50%.
(b)
Two-family:

Minimum lot area: 30,000 square feet.

Maximum lot coverage: 50%.
(c)
Multifamily:

Minimum lot area: one acre.

Maximum building coverage: 35%.

(2)
Nonresidential uses:
(a)
Minimum lot area: 10,000 square feet.
(b)
Maximum building coverage: 50%.
(c)
Maximum lot coverage: 60%.
C.
Yard requirements.
(1)
Residential uses and accessory uses:
(a)
Front yards: minimum front yard setback:

Side/rear yards; minimum side/rear yard setback:

Minimum front yard setback: 20 feet, except when adjacent to a residential use, when the front yard setback must comply with that of the residential use to which it is adjacent.

Minimum side/rear yard setback: 10 feet, except when adjacent to a residential use, when the side/rear yard setback must comply with that of the residential use to which it is adjacent.
D.
Corner lots. Corner lot front setbacks shall reflect the front setbacks of the other corner buildings at that intersection but in no case shall be less than the average front yard depth of building(s) in the Mixed-Use District where the property is located.
§ 140-34 Bulk requirements.
The following requirements apply to buildings constructed in the MU District:
A.
Maximum building heights:
(1)
Single-family: 35 feet or 2 1/2 stories.
(2)
Two-family: 35 feet or 2 1/2 stories.
(3)
Multiple-family: 35 feet or 2 1/2 stories.
(4)
Accessory uses: 25 feet.
(5)
Nonresidential: 30 feet.
B.
Floor area.
(1)
Residential uses:
(a)
Minimum floor area:

One-story dwellings: 1,200 square feet.

Two-story dwellings: 1,400 square feet.
[3]
Two-family dwellings and multiple-family dwellings: 1,800 square feet.

Per dwelling unit: 600 square feet.
