ARTICLE IV

INTERPRETATION, PURPOSE AND CONFLICT

Sec. 26-165.- Clarification of ambiguity or omission.

If an ambiguity exists concerning the appropriate classification of a particular use within the meaning and intent of this chapter, or if ambiguity exists with respect to matters of height, yard requirements, area requirements or zone boundaries, as set forth herein, it shall be the duty of the commission to ascertain all pertinent facts and by resolution of record set forth its findings and its interpretation, and such resolution shall be forwarded to the city council and, if approved by the city council, thereafter such interpretation shall govern.

Sec. 26-166. - Interpretation.

In interpreting and applying the provisions of this chapter they shall be held to be the minimum requirement for the promotion of the public health, safety, comfort, convenience and general welfare it is not intended by this chapter to interfere with or abrogate or annul any easement, covenant or other agreement between parties. Should a conflict occur between this and other chapters of this Code, the most restrictive provision shall apply.

Sec. 26-167. - Certificate of occupancy.

To assure compliance with the parking provisions and other provisions of this chapter, a certificate of occupancy shall be obtained from the building division before any premises shall be occupied or used, or before any building thereon is occupied or used in the following instances:

(a)

Before any new building or addition to any building be initially occupied or used.

(b)

Before any existing building which is altered or a change of type or class of use is made.

(c)

Before a change of use of any unimproved premises be made.

Sec. 26-168. - Permits; licenses.

All permits and licenses issued by departments, officials or public employees vested with the authority to issue permits or licenses shall conform to the provisions of this chapter. No such license or permit for uses, buildings or purposes which would be in conflict with the provisions of this chapter shall be issued. Any such license or permit, if issued in conflict with the provisions hereof, shall be null and void.
