A.   For the purposes of this chapter, it shall be generally recognized that the type of use is not so important as the manner in which the use is accomplished. It would be impractical, if not impossible, to accurately enumerate all of the uses which would be beneficial or detrimental to the community at large. It is also intended that the districts listed in this chapter shall not be used indiscriminately to permit any use which could be detrimental to the public health, welfare, and safety of the community or its citizens. While the City desires to encourage the development of the community, it shall be done in a responsible manner consistent with the rules and regulations of the City and in accordance with the goals and policies of the Comprehensive Plan.

B.   The regulations set forth in this chapter specify the uses that are allowed in the various zones under this chapter. (Ord. 1190, 6-17-1996)

A.   Uses shown in the matrix as "permitted" (P), are a permitted use by right in the applicable district; however, new construction or expansion of existing structures, or expansion of the area of use or operation, shall require review and site plan development approval by the city.

B.   Uses shown in the matrix as "permitted conditional use permit" (Pc) may be permitted in the applicable district following review and approval by the Board of Adjustment. This requirement shall apply to new uses, as well as the expansion of any use or change in operation.

C.   Each use is subject to all provisions of this title.

D.   Where a proposed land use is not identified in this chapter, the Director of Development Services or their designee shall review the proposed use, based upon the characteristics of the use and operational intentions, to determine which of the uses listed in this chapter is most closely equivalent to that proposed and thus whether to classify the property land use as permitted (P) or as a permitted conditional use (Pc). The proposed use, if determined to be equivalent to an allowed use, shall be subject to review through the process indicated within the matrix. (Ord. 1190, 6-17-1996; amd. A.   The following regulations shall be applied to the specific uses listed below in any district where that use is allowed:

1.   Day nursery schools and childcare centers shall be allowed, provided that no building, structure or accessory use for property so used, is located no closer than thirty feet (30') from any other principal building on any other lot in a Residential District. In addition there must be an established and well maintained, fenced play lot of no less than one thousand (1,000) square feet in area for the first twenty (20) or less children under care, with twenty five (25) square feet added to such play lot area for each additional designated child capacity of the principal building.

2.   The best practical means known for the disposal of refuse matter or water carried waste, and abatement of obnoxious or offensive odor, dust, smoke, gas, noise or similar nuisance, shall be employed for any use within this chapter. (Ord. 2136, 1-26-2016)

3.   Unless allowed elsewhere in this title or defined within a planned unit development (PUD) or Specific Plan Ordinance (ZCSP), residential uses shall be prohibited within the Commercial, Office and Industrial Districts. Residential uses located above nonresidential uses and single-family detached dwellings in the Valley Junction Historical Business District and Valley Junction Commercial District may be permitted in accordance with Building, Fire and Rental Codes. Residential uses are not allowed on the first floor of a mixed-use building in the Valley Junction Historical Business District and Valley Junction Commercial District. Multi-family residential uses are permitted within the Support Commercial Zoning District when incorporated and approved by the City Council as part of a mixed use building and/or development. Multi-family residential uses shall be permitted within the Professional Commerce Park (PCP) Zoning District when the only use within a standalone building and approved by the City Council. 4.   The maximum number of consecutive nights tents, camp trailers, travel trailers, motor homes, or similar movable or temporary sleeping quarters may occupy a campground is fifteen (15). After fifteen (15) nights, the temporary sleeping quarters must be removed from the campground for a minimum of three (3) consecutive nights. (Ord. 2136, 1-26-2016)

5.   The intent of this subsection is to create benchmarks to clearly distinguish the differences in restaurants, bar/restaurants and bars (aka drinking places (SIC 5813)). In determining the variations in the use, businesses that serve food and beverages are divided into four (4) class categories. The classes are defined by a list of operational characteristics that help to establish the intensity of how the use operates and help anticipate possible impact to the surrounding area. The following chart shall be used to determine the class category for uses under SIC 58.

A.   The City hereby adopts the "Standard Industrial Classification Manual" (1987 edition) as prepared by the U.S. Office of Management and Budget, as a method of classifying and defining permitted uses in the zoning districts. Any subsequent supplements and amendments to the "Standard Industrial Classification Manual" (SIC) will be incorporated into the land use matrix. In all cases, except where noted by the lack of an SIC code number, the SIC Manual will be used to define uses within a category.

A.   Introduction: The following matrix represents those uses in the applicable zoning districts which are permitted (P), allowed with the approval of a permitted conditional use permit (Pc), or not permitted (blank space). The applicable zoning district is identified at the top of the matrix and the uses, and their SIC codes, are identified along the left side of the matrix. For the ease of finding a particular subject in the matrix, a table of contents has been included that identifies the subject areas and the page number of the beginning of that section in the matrix.
