ARTICLE IX

Conservation Zone

§ 340-49 Permitted uses.

The following principal uses shall be permitted in this district:
Open space, beach and water recreation.
Protective vegetation as approved by the NJ Department of Environmental Protection (DEP) to protect and stabilize these environmentally sensitive areas.
Sand and snow fences.
Shore protection projects.
All other uses are prohibited.

§ 340-50 Bulkheads.

All waterfront development must comply with CAFRA[1] rules and regulations.
Must obtain a permit from the Borough of West Wildwood for replacement and newly constructed bulkheads.
The Department of Public Works is to be provided with a timeline for bulkhead replacement and repairs in writing. Time is of the essence due to potential flooding issues while construction is occurring.
The contractor shall make every effort to replace each section as removed so as not to endanger life and property.
Materials for sheathing may be wood, vinyl, fiberglass, galvanized steel or composite. Other materials are to be approved by the Borough Engineer prior to construction.
Sheathing shall be driven equally below the mud line (example, eight feet above mud line/eight feet below mud line). Any alterations are to receive prior approval by the Borough Engineer.
All pilings must comply with CAFRA standards due to environmental impact.
All whalers must be a minimum of six inches by six inches and shall be marine grade lumber as per CAFRA.
All hardware utilized must be hot dipped galvanized or stainless steel.
Tie rods and deadman tie rods must be 3/4 inch diameter or greater and attached to a deadman which is to be 10 feet back on the landward side. Tie rods are to be a minimum of five feet on center. The deadman can be concrete or piling.
Height of top of bulkhead must be at elevation 8.5 feet.
Backfill must be of sandy fill material with a minimum finish grade to be at elevation 6.5 feet which must run at this height a for a distance of 6 feet landward of the bulkhead.
When a bulkhead is found to be in a state of disrepair allowing for the intrusion of water to the landward of the bulkhead during a normal high tide the property owner must make the appropriate repairs or replacement. This determination will be made by the Borough Engineer.
Drains in the bulkhead used for equalization of pressure are prohibited.
