The intent of this chapter is to adopt by reference and with modifications the International Fire Code, 2021 Edition. Hereinafter, this Code may be referred to as the "Fire Code." The City Council of the City of Westminster finds that the adoption of the Fire Code is essential for fire prevention and the preservation of the health, safety, and welfare of the citizens of Westminster.

That certain document, one copy of which is on file in the Office of the City Clerk, being marked and designated as the International Fire Code, 2021 Edition, published by the International Code Council, 4051 W. Flossmoor Rd., Country Club Hills, IL 60478 and, in particular Chapters 1 through 80, inclusive and Appendix B - Fire Flow Requirements For Buildings, Appendix C - Fire Hydrant Locations and Distribution, Appendix D - Fire Apparatus Access Roads, Appendix E - Hazard Categories, Appendix F - Hazard Ranking, Appendix G - Cryogenic Fluids - Weight and Volume Equivalents, Appendix H - Hazardous Materials Management Plan (HMMP) and Hazardous Materials Inventory Statement (HMIS) Instructions, and Appendix I - Fire Protection Systems—Noncompliant Conditions is hereby adopted as the Fire Code of and for the City. These sections of the Fire Code, as modified in this chapter, are hereby referred to, adopted, and made a part of the Code, as if fully set forth.

Section 102.13 of the International Fire Code is added as follows:

102.13 Conflicts with other adopted codes. Where a conflict arises between this Code and the International Building Code and/or the International Residential Code, the more stringent application of the respective codes shall apply.

Exception: When any provision from the respective codes is agreed upon by the chief building official and the fire code official as being applicable and acceptable.

Section 103.1 of the International Fire Code is replaced as follows:

103.1 Creation of agency. The Westminster Fire Department is hereby created and the official in charge thereof shall be the fire code official. The function of the agency shall be the implementation, administration, and enforcement of the provisions of this code.

Section 104.7 of the International Fire Code is deleted in its entirety.

(D)

Section 104.7.1 of the International Fire Code is deleted as follows:

Section 105.5 and all subsections of the International Fire Code are replaced as follows:

105.5 Required operational permits. An operational permit shall be obtained from the Fire Prevention Bureau prior to engaging in the following activities, functions, operations, or practices, as defined in accordance with the Fire Code, unless otherwise specified in this Code:

105.6 Required Construction Permits. Upon approval of required construction documents, as required by Section 105.4, a fire protection permit shall be obtained from the Fire Prevention Bureau prior to initiating any alterations, construction, installation, modification, or remodel of any fire protection system or other fire- or life-safety system, as defined by the Fire Code. The following fire protection systems shall require submittal of plans, specifications, design and installation criteria, as required by the fire code official, prior to issuance of a fire protection permit, those not listed are excluded from the requirements of this Section:

Section 105.7 of the International Fire Code is added as follows:

105.7 Operational Permit Fees. The fee for operational permits required by Subsection 105.5 of this Code shall be as set forth in the Fee Schedule adopted by Resolution by the City Council. Fees shall be collected by the Fire Prevention Bureau. The fire code official is authorized to waive the fee in accordance with approved standard operating guidelines for administering permits for activities described in Section 105.8.

Section 105.8 of the International Fire Code is added as follows:

105.8 Construction Permit Fees. Permit fees and taxes are required for fire protection and life safety systems required by Section 105.6 of this Code for initiating any alterations, construction, installation, modification, or remodel of any fire protection system or other fire- or life-safety system, as defined by the Fire Code. These fees shall be assessed by and paid to the City of Westminster in accordance with the provisions of the Fee Schedule adopted by Resolution by the City Council.

Section 111 of the International Fire Code is replaced as follows:

111.1 Board of appeals. Appeals of orders, decisions, or determinations made by the building official or fire code official relative to the application and interpretation of the Building and Fire Codes, and amendments thereto, shall be made to the Building and Fire Code Appeals Committee pursuant to Title II, Chapter 10, of this Code. No such appeal shall be heard by the Building and Fire Code Appeals Committee, unless the appeal is filed within thirty (30) calendar days after the date of the action of the building official or the fire code official.

(J)

Sections 111.2, 113, and 111.4 of the International Fire Code are deleted as follows:

111.2 Limitations on authority is deleted in its entirety.

111.3 Qualifications is deleted in its entirety.

111.4 Administration is deleted in its entirety.

Section 112.1 of the International Fire Code is replaced as follows:

112.1 Unlawful Acts. It shall be unlawful for a person, firm or corporation to erect, construct, alter, repair, remove, demolish, or utilize a building, occupancy, premises or system regulated by this Code, or cause same to be done, in conflict with or in violation of any of the provisions of this Code.

Sections 112.3 and 112.4, and all subsections, of the International Fire Code are replaced as follows:

112.3 Notice of Violation. When the fire code official finds a building, premises, vehicle, storage facility or outdoor area that is in violation of this Code, the fire code official is authorized to prepare a written notice of violation describing the conditions deemed unsafe and, when compliance is not immediate, specifying a time for re-inspection.

112.3.1 Service. A notice of violation issued pursuant to this Code shall be served upon the owner, operator, occupant, or other person responsible for the condition or violation, either by personal service, mail, e-mail, or by delivering the same to, and leaving it with, some person of responsibility upon the premises. For unattended or abandoned locations, a copy of such notice of violation shall be posted on the premises in a conspicuous place at or near the entrance to such premises and the notice of violation shall be mailed by first-class mail to the owner of the subject property at the address shown in the county assessor records for the county in which the property is located. Notice shall be deemed served on the date of receipt by the owner, if personally served, or upon the fifth (5th) day after mailing of the notice.

112.3.2 Compliance with Orders and Notices. A notice of violation issued or served as provided by this Code shall be complied with by the owner, operator, occupant, or other person responsible for the condition or violation to which the notice of violation pertains.

112.3.3 Prosecution of Violations. If the notice of violation is not complied with promptly, the Fire Code Official is authorized to request the legal counsel of the jurisdiction to institute the appropriate legal proceedings at law or in equity to restrain, correct or abate such violation or to require removal or termination of the unlawful occupancy of the structure in violation of the provisions of this Code or of the order or direction made pursuant hereto.

112.3.4 Unauthorized tampering. Signs, tags, or seals posted or affixed by the fire code official shall not be mutilated, destroyed, tampered with, or removed without authorization from the fire code official.

Section 112.4 and all subsections of the International Fire Code are replaced as follows:

112.4 Violation penalties. Any person who violates any of the provisions of this Code, or who fails to comply therewith, or who builds any structure in violation of a detailed statement of specifications or plans submitted and approved pursuant to this Code and from which no appeal has been taken, or who fails to comply with a final order issued pursuant to this Code within the time fixed therein shall be guilty of a misdemeanor punishable by a fine or imprisonment pursuant to the limits set forth in Section 1-8-1, W.M.C., or by both such fine and imprisonment. The imposition of one (1) penalty for any violation shall not excuse the violation or permit it to continue, and all such persons shall be required to correct or remedy such violations or defects within a reasonable time and, when not otherwise specified, each day that a prohibited condition is maintained shall constitute a separate offense. The imposition of a criminal penalty shall not prevent the abatement of prohibited conditions.

112.4.1 Abatement of violation. In addition to the imposition of the penalties herein described, The fire code official is authorized to institute appropriate action to prevent unlawful construction or to restrain, correct or abate a violation; or to prevent illegal occupancy of a structure or premises; or to stop an illegal act, conduct of business or occupancy of a structure on or about any premises.

Section 503.1.4 of the International Fire Code is added as follows:

503.1.4 Block Parties and street obstructions. The Fire Department is authorized to issue operational permits for street closures intended for block parties, City of Westminster sponsored events, neighborhood events, or for similar purposes, where such events will not impede delivery of emergency services and does not create an additional risk to public safety. Applicable fees may be waived for City of Westminster events and events sponsored by non-profit entities and organizations.

(B)

Section 503.2.3 of the International Fire Code is replaced as follows:

503.2.3 Surface. Fire apparatus access roads shall be designed and maintained to support the imposed loads of fire apparatus and shall be surfaced with asphalt or concrete to provide all-weather driving capabilities.

(C)

Section 503.3.1 of the International Fire Code is added as follows:

503.3.1 Fire lanes on private property. The marking of fire lanes on private property devoted to public use shall be approved by the fire code official, in accordance with the Fire Code and the Uniform Traffic Control Manual.

(D)

Section 503.4.2 of the International Fire Code added as follows:

503.4.2 Obstruction by vehicle. The fire code official or any of his subordinates, or the Police Department, with knowledge of the existence of any vehicle parked in the fire lane, or in such manner as to interfere with the use of any fire hydrant, or in any manner in violation of this Section, may have such vehicle towed away and the charges of such towing shall be assessed to the owner of such vehicle. The aforesaid violation shall be sufficient grounds to cause a citation to be issued. In the event of a fire, the Fire Department shall have the authority to cause the vehicle blocking a fire hydrant or fire lane to be removed, with any subsequent damage to the vehicle being paid by the owner of said vehicle. The towing of any vehicle pursuant to this Section shall comply with the provisions of Title X, Chapter 1 of the Westminster Municipal Code.

(E)

Section 505.1 of the International Fire Code is replaced as follows:

New and existing buildings shall be provided with approved address identification. The address identification shall be legible and placed in a position that is visible from the street or road fronting the property. Address identification characters shall contrast with their background. Address numbers shall be Arabic numbers or alphabetical letters. Numbers shall not be spelled out. Each character shall be a minimum of 6 inches (102 mm) high with a minimum stroke width of 3/4 inch (12.7 mm). Where required by the fire code official, address identification shall be provided in additional approved locations to facilitate emergency response. Where access is by means of a private road and the building address cannot be viewed from the public way, a monument, pole or other approved sign or means shall be used to identify the structure. Address identification shall be maintained.

(F)

Section 505.1.1 of the International Fire Code is added as follows:

505.1.1 Rear or side doors. Buildings having exterior rear or side access doors shall have approved address numbers, building numbers or approved building identification placed in a position approved by the fire code official. Address identification characters shall contrast with their background. Address numbers shall be Arabic numbers or alphabetical letters. Numbers shall not be spelled out. Each character shall be a minimum of 4 inches (102 mm) high with a minimum stroke width of 1/2 inch (12.7mm).

(G)

Section 505.1.2 of the International Fire Code is added as follows:

505.1.2 Interior doors. Buildings with multiple tenants with interior access doors shall have approved unit or space identification numbers, address numbers or other approved means of identifying individual tenant spaces or units. Address identification characters shall contract with their background. Address numbers shall be Arabic numbers or alphabetical letters. Numbers shall not be spelled out. Each character shall be a minimum of 4 inches (102 mm) high with a minimum stroke of 1/2 inch (12.7 mm) or as approved.

(H)

Section 507.5.3.1 of the International Fire Code is added as follows:

507.5.3.1 Private hydrants. Privately owned hydrants shall be maintained at the expense of the private property owner, subject to the direction and requirements of the fire code official. Such private hydrants shall be flushed and tested periodically according to the Fire Code. In the event such testing reveals that the flow from private hydrants is inadequate according to applicable standards, modifications necessary to meet these standards shall be ordered by the fire code official. and made at the expense of the property owner. All private hydrants shall be painted the same color as hydrants on public rights-of- way or elsewhere throughout the City with a different color cap, that being white, to designate a private fire hydrant.

Appropriate markings or signs restricting parking in front of or adjacent to fire hydrants shall be designated by the fire code official and implemented at the expense of the owner of the property. No point of connection to any private fire hydrant shall be left uncapped without permission of the fire code official.

(I)

Section 507.5.7 of the International Fire Code is added as follows:

507.5.7 Existing private fire hydrants. Existing hydrants that do not conform to City specifications or that do not face in the direction most consistent with emergency use by the Fire Department, as established by the fire code official, shall be changed to meet the City's requirements by the property owner and at the property owner's expense, within fifteen (15) days of service of notice of the required changes upon the property owner or its resident agent.

(J)

Section 509.1 of the International Fire Code is replaced as follows:

509.1 Identification. Fire protection equipment shall be identified in an approved manner. Rooms containing controls for air-conditioning systems, fire protection equipment, utility equipment, or hazardous materials shall be identified for the use of the fire department with permanently installed and readily visible signs constructed of durable materials. Signs required to identify fire protection equipment locations, such as FDC, FACP, FIRE SPRINKLER RISER ROOM, and FIRE COMMAND CENTER shall be constructed with a red background and white letters a minimum of 4 inches tall with a 1/2 inch stroke in block font.

(K)

Section 509.1.2 of the International Fire Code is added as follows:

509.1.2 Roof top unit identification. All roof top units shall be labeled in a numerical sequence. If duct detectors are installed, remote test stations shall be in a readily accessible location and labeled according to the associated roof top unit.

(L)

Section 603.4 of the International Fire Code is amended by adding the following:

The area of the minimum required working space at electrical equipment located inside of buildings shall be permanently marked on the floor, including plainly visible and legible wording stating "NO STORAGE".

Section 901.4.7.5 of the International Fire Code is added as follows:

Section 901.4.7.5 Location. Automatic sprinkler system riser rooms and fire pump rooms shall be located at grade level and accessible directly from the outside, and their location shall be subject to approval by the fire code official.

901.4.7.5.1 In existing buildings where a new fire pump is being added or an existing fire pump is being replaced with a new fire pump of different nominal rating, the location and access shall be preplanned and approved by the fire code official.

(B)

Section 903.1.2 of the International Fire Code is added as follows:

903.1.2 Anti-freeze systems. Anti-freeze solutions shall be listed.

(C)

Section 903.2 of the International Fire Code is amended by adding the following sentence:

Interior and audible and visual occupant notification devices shall be provided throughout building that have installed a NFPA 13 or 13R automatic sprinkler system.

(D)

Section 903.2.8 of the International Fire Code is replaced as follows:

903.2.8 Group R. An automatic sprinkler system installed in accordance with Section 903.3 shall be provided throughout all buildings with a Group R fire area. Group R-2 and Group R-4 occupancies required to be protected with an automatic fire sprinkler system shall provide fire sprinkler coverage for all exterior balconies.

Exception: Existing Group R-2 and Group R-4 buildings and occupancies constructed prior to January 1, 2012, unless the building is undergoing renovation which is of sufficient extent that sprinkler system modifications are being completed that would provide fire sprinkler coverage on exterior balconies.

(E)

Section 903.3.1.1.3 of the International Fire Code is added as follows:

903.3.1.1.3 Safety factor allowance. All automatic sprinkler systems installed in accordance with NFPA 13 shall comply with: Colorado Code of Regulations requires min 10 percent safety margin (max of 10 psi) for sprinkler hydraulic calculations, taken from the static and residual flow tests. Reference: 8 CCR 1507-11, Section 6.2.6 Hydraulic Calculations.

(F)

Section 903.3.1.2.4 of the International Fire Code is added as follows:

903.3.1.2.4 Safety factor allowance. All automatic sprinkler systems installed in accordance with NFPA 13R shall comply with: Colorado Code of Regulations requires min 10 percent safety margin (max of 10 psi) for sprinkler hydraulic calculations, taken from the static and residual flow tests. Reference: 8 CCR 1507-11, Section 6.2.6 Hydraulic Calculations.

(G)

Section 903.3.1.3.1 of the International Fire Code is added as follows:

903.3.1.3.1 Safety factor allowance. All sprinkler systems installed in accordance with NFPA 13D shall have a safety factor for all hydraulic calculations in systems. This shall consist of one of the following:

(1)

A five (5) percent hydraulic safety factor from the static pressure allowance.

(2)

System design of no greater than 80 psi static pressure.

(3)

As otherwise allowed by the fire code official.

(H)

Section 903.3.1.3.2 of the International Fire Code is added as follows:

903.3.1.3.2 Requirement for notification. All sprinkler systems installed in accordance with NFPA 13D shall have a horn/strobe notification device placed on the exterior of the structure in a location visible to passersby.

Exception. Horns and strobes shall not be required for passive purge systems.

(I)

Section 903.3.2.1 of the International Fire code is added as follows:

903.3.2.1 Residential automatic sprinkler heads in light hazard occupancies. Residential automatic sprinkler heads are prohibited in light hazard occupancies.

(J)

Section 903.3.2.2 of the International Fire Code is added as follows:

903.3.2.2 Residential and quick-response automatic sprinkler heads. All installations of residential and quick-response automatic sprinkler heads shall be in strict accordance with their listings. Where listings authorize installation where prohibited in 903.3.2 and 903.3.2.1, the fire code official may waive the requirements mandated by 903.3.2 and 903.3.2.1.

(K)

Section 903.4.2 of the International Fire Code is replaced as follows:

903.4.2 Alarms. Approved audible and visual notification devices shall be connected to each automatic sprinkler system. Such sprinkler waterflow alarm notification appliances shall be activated by water flow equivalent to the flow of a single sprinkler of the smallest orifice size installed in the system. Exterior audible and visual notification appliances shall be provided on the exterior of the building above the wall-mounted Fire Department Connection.

(L)

Section 905.3.1 of the International Fire Code is amended by adding Exceptions 7 and 8 as follows:

905.3.1 Height shall be amended by adding the following exceptions:

Exception 7: Class I standpipes are allowed to be manual systems.

Exception 8: Fire hose is not required for Class III standpipes. Standpipe hose outlets shall be two and one-half -inch (2-1/2") outlets with a two and one-half-inch (2-1/2") cap.

(M)

Section 905.3.9 of the International Fire Code is added as follows:

905.3.9 Bridges and roadway overpasses. Where required to extend water supply to streets, highways, and rail systems, a dry standpipe shall be installed in accordance with Fire Department requirements.

(N)

Section 905.4 of the International Fire Code is amended by deleting the exception to item #2:

Section 905.4 of the International Fire Code is amended by adding the following to item #6:

Where the fire code official has determined that additional hose connections be provided, such locations shall provide protection for responding personnel. Such protection shall be in the form of a smoke or fire door assembly or other approved method.

(P)

Section 907.2 of the International Fire Code is amended by adding the following sentence:

Interior audible and visual occupant notification devices shall be provided throughout buildings that have installed a NFPA 13 or 13R automatic sprinkler system.

(Q)

Section 907.2.11 of the International Building Code is replaced as follows:

907.2.11 Single- and multiple-station smoke alarms. Listed single- and multiple station smoke alarms complying with UL 217 shall be installed in accordance with Sections 907.2.11.1 through 907.2.11.7, NFPA 72 and the manufacturer's published instructions.

Section 907.6.7 of the International Fire Code is added as follows:

907.6.7 Extent of coverage. The fire code official shall approve the extent of zone coverage for fire alarm systems in all buildings and structures.

(S)

Section 912.2.2 of the International Fire Code is replaced as follows:

912.2.2 Existing buildings. On existing buildings, wherever the fire department connection is not visible to approaching fire apparatus, the fire department connection shall be indicated by an approved sign mounted on the street front or on the side of the building. Such sign shall be constructed with a red background and white letters a minimum of 6 inches tall with a ¾ inch stroke in block font stating "FDC" and words in letters not less than 2 inches (51 mm) high or an arrow to indicate the location. Such signs shall be subject to the approval of the fire code official.

(T)

Section 912.2.3 of the International Fire Code is added as follows:

912.2.3 Fire hydrant accessibility. The Fire Department connection (FDC) shall have a fire hydrant within one hundred feet in a location approved by the fire code official.

1032.11 Valet trash service in corridors. Valet trash services shall not be permitted in new and existing buildings in the exit access or exit portion of the means of egress.

Section 1205.5 of the International Fire Code is added as follows:

1205.5 Direct current (DC) wiring. Direct current (DC) conduit, wiring, and raceways shall be located below the solar array or a minimum of twenty-four inches below the roof sheathing.

(B)

Section 1205.6 of the International Fire Code is added as follows:

1205.6 Labeling. For residential applications, a label stating, "CAUTION, SOLAR PHOTO VOLTAIC SYSTEM ON PREMISES" shall be placed at or within the main electrical service disconnect.

Section 3314.1 of the International Fire Code is replaced as follows:

3314.1 Where required. In buildings required to have standpipes by Section 905.3.1, not less than one standpipe shall be provided for use during construction. Such standpipes shall be installed prior to construction exceeding 40 feet (12 192 mm) in height above the lowest level of fire department vehicle access. Such standpipes shall be provided with fire department hose connections at locations adjacent to stairways complying with Section 3312.1, with a 150-foot maximum horizontal separation between standpipes. As construction progresses, such standpipes shall be extended to within one floor of the highest point of construction having secured decking or flooring.

(A)

Section 5601.1.3 of the International Fire Code is replaced as follows:

5601.1.3 Fireworks. The possession, manufacture, storage, sale, handling, and use of fireworks are prohibited.

Exceptions:

(1)

State of Colorado defined "permissible fireworks" will be allowed for possession, handling, and use only during the timeframe beginning at 12:00 a.m. on July 3rd and ending at 12:00 p.m. on July 5th of any given calendar year.

(2)

Fireworks shall be prohibited in all City of Westminster parks and open spaces, unless approved by the Director of Parks, Recreation, and Libraries and the Fire Department.

(3)

As provided in Section 6-8-3, W.M.C.

(B)

Section 5604.1.1 of the International Fire Code is added as follows:

5604.1.1 General Storage Limitations. The storage of explosives and blasting agents is prohibited within all zones except PUD (Planned Unit Development) where such storage is specifically listed as an allowed use, except for temporary storage for use in connection with approved blasting operations; provided that this prohibition shall not apply to wholesale and retail stocks of small arms, ammunition, explosive bolts, explosive rivets, or cartridges for explosive-actuated power tools in aggregate quantities involving less than five hundred pounds (500#) of explosive material.

Section 6104.2 of the International Fire Code is amended by adding the following text:

6104.2 Maximum Capacity within Established Limits.

This maximum capacity limitation specifically applies to the following zoning areas: RA, RE, R1, R2, R3, R4, R5, B1, C1, T1, and PUD (Planned Unit Development) zoned districts.

Section B105.1 of the International Fire Code is replaced as follows:

B105.1 One- and two-family dwellings, Group R-3 and R-4 buildings and townhouses. The minimum fire-flow and flow duration requirements for one- and two-family dwellings, Group R-3 and R-4 buildings and townhouses shall be as specified in Tables B105.1(1) and B105.1(2), but not less than 1500 gallons per minute.

Section B105.2 of the International Fire Code is replaced as follows:

B105.1 Buildings other than one- and two-family dwellings, Group R-3 and R-4 buildings and townhouses. The minimum fire-flow and flow duration requirements for buildings other than one- and two-family dwellings, Group R-3 and R-4 buildings and townhouses shall be as specified in Tables B105.1(1) and B105.1(2), but not less than 1500 gallons per minute.

(C)

Section B105.4 of the International Fire Code is added as follows:

B105.4 Fire Flow Reduction Allowance. Buildings which are equipped with an automatic sprinkler system in accordance with section 903.3.1.1 or 903.3.1.2 of the International Fire Code are allowed a minimum fire-flow of 50 percent of the value in Table B105.1(2), provided the fire-flow shall be a minimum of 1,500 gallons per minute.

Table B105.2 Footnote a. The reduced fire flow shall not be less than 1500 gallons per minute.
