CHAPTER 9

OFF-STREET PARKING AND LOADING

5-9-1: SCOPE OF REGULATIONS:

The off-street parking and off-street loading provisions of this title shall apply as follows:
   A.   Accessory off-street parking and off-street loading facilities shall be provided as required by the regulations of this chapter for all buildings and structures erected and all uses of land established in each district after the effective date of this title. However, where a building permit has been issued prior to the effective date of this title, as amended, and provided that construction is begun within six (6) months of such effective date and diligently prosecuted to completion, parking and loading facilities in the amounts required for the issuance of said building permit may be provided in lieu of any different amounts required by this title.
   B.   When the intensity of use of any building, structure, or premises shall be increased through the addition of dwelling units, gross floor area, sales, patron service, or customer service floor area, seating capacity, or other units of measurement in the amount specified herein requiring parking or loading facilities, such additional parking and loading facilities as required herein shall be provided.
   C.   Whenever the existing use of a building or structure shall hereafter be changed to a new use, parking or loading facilities shall be provided as required for such new use. However, if the building or structure was erected prior to the effective date of this title, additional parking or loading facilities are mandatory only in the amount by which the requirements for the new use would exceed those for the existing use. 5-9-2: EXISTING PARKING FACILITIES:

Accessory off-street parking facilities in existence on the effective date of this title and located on the same lot as the building or use served shall not hereafter be reduced below, or if already less than shall not be further reduced below the requirements for a similar new building or use under the provisions of this title. 5-9-3: PERMISSIVE PARKING AND LOADING FACILITIES:

Nothing in this title shall be deemed to prevent the voluntary establishment of off-street parking or loading facilities to serve any existing use of land or buildings, provided that all regulations herein governing the location, design, and operation of such facilities are adhered to, provided said parking spaces are in the same zoning district as said use or a less restricted zoning district. 5-9-5: CONTROL OF OFF-SITE PARKING FACILITIES:

In cases where parking facilities are permitted on land other than the lot on which the building or use served is located, such facilities shall be in the same possession as the lot occupied by the building or use to which the parking facilities are accessory. Such possession may be either by deed or long-term lease, the term of such lease to be determined by the Village Board. The owner of the land on which the parking facilities are to be located shall be bound by covenants, filed on record in the Office of the Recorder of Deeds of Cook County, requiring such owner, his or her heirs and assigns, to maintain the required number of parking facilities for the duration of the use served or of the said lease, whichever shall terminate sooner. 5-9-6: OFF-STREET PARKING:

Off-street parking facilities for motor vehicles shall be provided in accordance with additional regulations set forth hereinafter:
   A.   Use: Accessory off-street parking facilities required as accessory to uses listed herein, shall be solely for the parking of passenger automobiles of patrons, occupants, or employees. (When bus transportation is provided, for patrons, occupants or employees of a specific establishment, additional open or enclosed off-street parking spaces for each bus to be parked on the premises shall be provided in accordance with regulations herein for access, in yards, design and maintenance and area applicable to accommodating such buses.)
   B.   Exemption: When the application of the off-street parking regulations specified hereinafter results in a requirement of not more than three (3) spaces on a single lot in any Business District, such parking spaces need not be provided. However, where two (2) or more uses are located on a single lot, only one of these uses shall be eligible for the above exemption. This exemption shall not apply to dwelling units.
   C.   Computation: When determination of the number of off-street parking spaces required by this title results in a requirement of a fractional space, any fraction of one-half (1/2) or less may be disregarded while a fraction in excess of one-half (1/2) shall be counted as one parking space.    D.   Collective Provisions: Off street parking facilities for individual uses may be provided collectively if: 1) the total number of parking spaces provided in the off street parking facility is at least equal to the number of parking spaces required for each individual use; and 2) all regulations governing location of accessory parking spaces, in relation to the use served, are adhered to. Further, no parking spaces or portion thereof shall serve as a required space for more than one use unless otherwise authorized by the Village in accordance with procedures set forth in chapter 2 of this title.    E.   Area: A required off street parking space shall be at least nine feet (9') in width and at least twenty feet (20') in length, exclusive of access drives or aisles, ramps, columns, or office work areas. Enclosed parking spaces shall have a vertical clearance of at least seven feet (7'). (Ord., 12-15-1964 as amended)
   F.   Access: Each required off street parking space shall open directly upon an aisle or driveway of such width and design as to provide safe and efficient means of vehicular access to such parking space, as approved by the Building Commissioner. All off street parking facilities shall be designed with appropriate means of vehicular access to a street or alley in a manner which will least interfere with traffic movement. No driveway across public property at the right-of-way line shall exceed a width of twenty five feet (25').
   G.   In Yards: Off street parking spaces, open to the sky, may be located in any yard in any zoning district, except front yards and side yards adjoining a street in the R1, R2, R3, T1, M1, and M2 Zoning Districts. Enclosed buildings and carports containing off street parking spaces shall be subject to applicable yard requirements. (Ord. 2019-21, 4-16-2019)
   H.   Design And Maintenance:
      1.   Open Or Enclosed: Accessory parking spaces may be open to the sky or enclosed in a building. (Ord., 12-15-1964 as amended)
      2.   Surfacing: All open off street parking spaces and access drives shall be surfaced with smooth and durable surface material approved by the Building Commissioner so that they will remain free from dust or litter particles, and be adequately drained so that they will not retain water, except all open off street parking areas containing more than four (4) parking spaces and access drives shall be improved with seven inches (7") of water bound macadam base, plus one inch (1") of bituminous concrete binder, plus two inches (2") of bituminous concrete surface. All materials and method of installation of any surfacing shall be in accordance with Village specifications. (Ord. 2019-21, 4-16-2019)
      3.   Screening, Landscaping, And Barriers: All open off street parking areas, containing more than four (4) parking spaces, located less than forty feet (40') from the nearest property line of a lot in a Residence District, shall be effectively screened on each side adjoining or fronting on such property line by a wall, fence, or densely planted compact hedge, not less than five feet (5') nor more than eight feet (8') in height. There shall be installed a substantial barrier on or adjacent to the lot line along all open off street parking spaces and such barrier shall be so located that no portion of any vehicle parked on the lot shall extend over the lot line.
      4.   Lighting: Any lighting used to illuminate off street parking areas shall be directed away from residential properties in such a way as not to create a nuisance and in a parking area containing four (4) or more parking spaces such lighting shall be extinguished one-half (1/2) hour after the close of business, except as may otherwise be permitted or required by the Real Estate Development Board for maintaining illumination after the time specified above.
      5.   Repair And Service: No motor vehicle repair work or service of any kind shall be permitted in conjunction with any parking facilities. No gasoline or motor oil shall be sold in conjunction with any accessory parking facilities.
      6.   Sidewalk Maintenance: All sidewalks surrounding off street parking spaces shall be kept free from dirt, ice, sleet and snow and maintained in a safe condition for pedestrian travel.
   I.   Location: All parking spaces required to serve buildings or uses erected or established after the effective date of this title shall be located on the same lot as the building or use served. Buildings or uses in any district except single-family and two-family dwellings existing on the effective date of this title which are subsequently altered or enlarged so as to require the provision of parking spaces under this title and new uses established in any Business District may be served by parking facilities located on land other than the lot on which the building or use served is located, provided such facilities in the B1 District are within five hundred feet (500') walking distance of a main entrance to the use served, and in any case are located in districts where parking lots or storage garages are listed as permitted uses or special uses.    K.   Required Spaces: The minimum number of off street parking spaces accessory to designated uses shall be provided as follows:
1. Dwelling and lodging uses:
Boarding or rooming houses, hotels and apartment hotels, motels or tourist homes
 
1 parking space for each dwelling unit, and 1 parking space for each lodging room, plus 3 additional spaces
Single-family dwellings, two-family dwellings, and multiple-family dwellings
 
2 parking spaces for each dwelling unit
2. School, institution, auditorium or other places of assembly uses:
Churches
 
1 parking space for each 4 seats or for each 80 inches of seating space used for the principal church service
Colleges, junior colleges, and universities
 
1 parking space for each 2 students, based upon the maximum number of students that can be accommodated according to design capacity, plus 1 parking space for each classroom
Community centers
 
10 parking spaces for each 1,000 square feet of gross floor area
Convalescent homes, nursing homes, rest homes, institutions for the care of the aged, and for children
 
2 parking spaces for each 4 beds
Gymnasiums, stadiums, and grandstands
 
1 parking space for each 3 seats or for each 60 inches of seating space
Libraries and museums
 
1 parking space for each 400 square feet of patron service floor area. Libraries with meeting halls must conform to the requirements of "meeting halls", under this subsection K2
Meeting halls, convention halls, exhibition halls and auditoriums other than schools
 
The number of parking spaces equal to 40 percent of the maximum number of people that can be accommodated in accordance with design capacity, or 2 parking spaces for each 5 seats
Parks
 
5 parking spaces per acre
Private clubs and lodges
 
1 parking space for each lodging room and 2 parking spaces for each 3 seats in accordance with design seating capacity of the main meeting room
School auditoriums
 
1 parking space for each 4 seats or for each 80 inches of seating space in the main auditorium, or assembly hall
Schools, commercial or trade, and music and dance businesses
 
1 parking space for each classroom, plus 1 space for each 2 students, based on the maximum number of students that can be accommodated in accordance with design capacity
Schools, high, public or private
 
1 parking space for each 7 students based on the maximum number of students that can be accommodated according to design capacity
Schools, nursery, elementary or junior high
 
1 parking space for each classroom, plus 1 parking space for each 20 students enrolled
Swimming pools
 
1.5 parking spaces for each 75 square feet of water area
3. Business, commercial and manufacturing uses: All parking spaces in this subsection shall be marked for easy identification; catch basins are required in all parking lots of 50 cars or more, according to the specifications of the Village Engineer.
All business and commercial establishments, except those specified hereafter
 
1 parking space for each 150 gross square feet of sales area up to and including 1,500 gross square feet and then 1 parking space for each 250 gross square feet of sales area
Automobile service stations
 
3 parking spaces for each service bay
Automotive body shops
 
1 parking space for every 300 gross square feet of floor area, plus screened storage area off the right-of-way for all vehicles awaiting servicing
Banks, business, professional and public or service office buildings, excluding dental or medical

Bowling alleys
 
7 parking spaces for each lane, plus additional spaces as may be required for affiliated uses therein, including, without limitation, restaurants
Cannabis Dispensaries
 
5 parking spaces for each 1,000 gross square feet of floor area
Cartage, express, parcel delivery and freight establishments
 
11/2 parking spaces for each vehicle maintained on the premises
Carwashes
 
4 parking spaces for each 1,000 gross square feet of floor area
Dental clinics
 
1.5 parking spaces for each examination room and treatment room
Drive-in, carryout establishments handling the sale of food exclusive of indoor seating for the consumption of food

Drive-in window, business and commercial establishments

Manufacturing establishments and establishments engaged in production, processing, assembly, or disassembly, cleaning, servicing, testing or repair of materials, goods, or products
 
1 parking space for each 800 gross square feet of floor area
Medical clinics
 
1 parking space for each 80 gross square feet of floor area
Retail tobacco stores
 
1 parking space for each 100 gross square feet of floor area
Undertaking establishments and funeral parlors
 
25 parking spaces for each potential chapel or parlor, plus 1 parking space for each funeral vehicle maintained on the premises
Warehouse and storage establishments
 
0.4 parking space for each 1,000 gross square feet of floor area
4. Miscellaneous uses:
Planned unit developments
 
The number of parking spaces required for each separate use
Public utility and public service uses
 
1 parking space for each 750 square feet of gross floor area
5. Other uses:
 
Parking spaces for other permitted or special uses not listed above shall be provided in accordance with requirements designated by the Real Estate Development Board

5-9-7: OFF STREET LOADING:

Off street loading spaces accessory to designated uses shall be provided as follows:
   A.   Location: All required loading spaces shall be located on the same lot as the use served. All motor vehicle loading spaces which abut a Residence District or intervening alley separating a Residence District from a Business or Manufacturing District shall be completely screened therefrom by building walls, or a uniformly painted solid fence, wall, or door, or any combination thereof, not less than eight feet (8') in height. No permitted or required loading space shall be located within forty feet (40') of the nearest point of intersection of any two (2) streets. No loading space shall be located in a required front or side yard, and any loading space located in a required rear yard shall be open to the sky.
   B.   Area: Unless otherwise specified, a required off street loading space shall be at least ten feet (10') in width by at least thirty five feet (35') in length, exclusive of aisle and maneuvering space, and enclosed loading spaces shall have a vertical clearance of at least fourteen feet (14').
   C.   Access: Each required off street loading space shall be designed with appropriate means of vehicular access to a street or alley in a manner which will least interfere with traffic movement.
   D.   Surfacing: All open off street loading spaces shall be improved with stormwater drainage facilities and pavement surfacing in accordance with Village heavy duty street pavement specifications.
   E.   Repair And Service: No motor vehicle repair work or service of any kind shall be permitted in conjunction with loading facilities.
   F.   Utilization: Space allocated to any off street loading space shall not, while so allocated, be used to satisfy the space requirements for any off street parking facilities or portions thereof.
   G.   Minimum Facilities: Uses for which off street loading facilities are required herein but which are located in buildings of less floor area than the minimum prescribed for such required facilities, shall be provided with adequate receiving facilities, accessible by motor vehicle, off any adjacent alley, service drive, or open space on the same lot.
   H.   Off Street Loading Space Requirements:
      1.   The minimum number of off street loading spaces accessory to nonresidential uses in any Residence District and such nonresidential uses in any Business and Manufacturing District that are also permitted or special uses in any Residence District shall be: One loading space for buildings containing ten thousand (10,000) to one hundred thousand (100,000) square feet of gross floor area, plus one additional loading space for each additional one hundred thousand (100,000) square feet of gross floor area or fraction thereof.
      2.   The minimum number of off street loading spaces accessory to uses in any Business and Manufacturing District, except those uses that are also permitted in special uses in any Residence District, shall be in accordance with the following schedule:
