ARTICLE X

- LEGAL STATUS PROVISIONS

Section 10.1. - Conflict with other laws.

Whenever the regulations of this ordinance require a greater width or size of yards, or impose other more restrictive standards than are required in or under any other statute, the requirement of this ordinance shall govern. Whenever the provisions of any other statute require more restrictive standards than are required by this ordinance, the provisions of such statute shall govern.

Section 10.2. - Separability.

Should any section, provision, paragraph, sentence, phrase or clause of this ordinance be declared invalid or unconstitutional by any court of competent jurisdiction, such declaration shall not affect the validity of this ordinance as a whole, or any part thereof, which is not specifically declared to be invalid or unconstitutional.

Section 10.3. - Repeals of conflicting ordinances.

All ordinances and parts of ordinances in conflict with this ordinance are herewith repealed. All violations of prior ordinances shall be enforceable and such fines or punishment authorized under a prior ordinance under which a violation occurred shall be imposed as provided under the prior ordinance.

Section 10.4. - Reversionary clause.

This ordinance replaces the city's prior zoning ordinance existing and in effect immediately prior to the adoption of this ordinance. In the event all of this ordinance is struck down as void, unconstitutional or invalid, that prior ordinance shall be considered to not have been repealed, and shall therefore still be in effect.

Section 10.5. - Effective date.

The public welfare demanding, this ordinance shall take effect and shall be in force immediately upon adoption.
