ORDINANCE NO. 904

[An Ordinance Adopting and Enacting a New (Re-Codified) Zoning Ordinance for the City of Zeeland, Michigan; Providing for the Repeal of Certain Ordinances Not Included Therein; Providing a Penalty for the Violation Thereof; Providing for the Manner of Amending Such Code; and Providing When Such Code and This Ordinance Shall Become Effective.]

Portions of minutes of a Regular Meeting of the City Council of the City of Zeeland, County of Ottawa, Michigan, held in the Zeeland City Hall of said City on December 20, 2010, at 7:00 o'clock P.M., Local Time.

PRESENT: Council Members Mayor Hoogland, Gruppen, Klynstra, Broersma,
Dannenberg, Van Dorp and Kass

ABSENT:  Council Members None

The following preamble and ordinance were offered by Council Member Kass and supported by Council Member Van Dorp.

WHEREAS, the Planning Commission has recommended the amendment and re-codification of the Zeeland Zoning Ordinance, Ordinance #572, in its entirety, as it had been amended from time to time;

AND WHEREAS, the re-codification and re-adoption of the Zoning Ordinance are recommended so as to make the Zeeland Zoning Ordinance more readily available on the internet, so as to update and combine ordinances which had been known as the Zeeland City Code with the Zoning Ordinance and to publish both the Zoning Ordinance and the City Code as a single code, but in two separate printed books, and so as to make certain formatting, organizational, and editorial changes so as to provide a greater consistency to the language within the City of Zeeland Zoning Ordinance and the Zeeland City Code;

AND WHEREAS, a public hearing was held regarding such amendments on December 2, 2010, and no objection was made to such new and re-codified Zoning Ordinance, and having received the final report of the Planning Commission recommending such new and re-codified Zoning Ordinance;

AND WHEREAS, such amendments and this re-codification are found to be in the interest of the public and to promote the welfare of the public.

THE CITY OF ZEELAND ORDAINS:

Section 1. Short title. This ordinance shall be known as the "City of Zeeland Zoning Ordinance" and may be so cited.

Section 2. Adoption. The City of Zeeland Zoning Ordinance attached hereto, published by Municipal Code Corporation, consisting of Articles I through IX, each inclusive, is adopted by reference.

Section 3. Repealer. All zoning ordinances of a general and permanent nature enacted on or before the effective date of this ordinance, and not included in the ordinance or recognized and continued in force by reference therein, are repealed.

Section 4. Prior Ordinances Not Revived. The repeal provided for in Section 3 hereof shall not be construed to revive any ordinance or part thereof that has been repealed by a subsequent ordinance that is repealed by this ordinance.

Section 5. Penalty. Whenever in this ordinance an act is prohibited or is made or declared to be a municipal civil infraction, or whenever in this ordinance the doing of any act is required or the failure to do any act is declared to be a municipal civil infraction, the violation of any such provision by any person shall, upon conviction of a municipal civil infraction, a finding of responsibility shall be punished by a civil fine as provided.

Each act of violation and each day upon which any such violation shall occur shall constitute a separate offense. The penalty provided by this section, unless another penalty is expressly provided, shall apply to the amendment of any section, whether or not such penalty is reenacted in the amendatory ordinance. addition to the penalty prescribed above, the City may pursue other remedies such as abatement of nuisances, injunctive relief and revocation of licenses or permits.

Section 6. Code Additions or Amendments. Additions or amendments to the ordinance when passed in such form as to indicate the intention of the City Council to make the same a part of the ordinance shall be deemed to be incorporated in the ordinance, so that reference to the ordinance includes the additions and amendments.

Section 7. Later Ordinances. Ordinances adopted after the effective date of this ordinance that amend or refer to ordinances that have been codified in this ordinance shall be construed as if they amend or refer to like provisions of this ordinance.

Section 8. Availability of Ordinance. A copy of this ordinance and of the City of Zeeland Zoning Ordinance which has been adopted by this ordinance are available for purchase or inspection in the office of the City Clerk at 21 S. Elm Street, Zeeland, Michigan and also in the office of the Building Official at 21 S. Elm Street, Zeeland, Michigan, and will be available during normal business hours for such purposes.

Section 9. Effective Date. In accordance with MCL 125.3401, this Ordinance shall take effect seven (7) days after publication of a notice of the adoption of this ordinance. Such effective date shall be December 30, 2010.

This Ordinance is hereby adopted on the 20th day of December, 2010, at a Regular Meeting of the Zeeland City Council, with the following vote:
