5. - BUSINESS ZONES

Sec. 9-5-1. - Core commercial zone.

This section establishes the core commercial (CC) zoning district, the purpose of which is to provide a place at the center of the city for major public institutions and for retail stores and service uses that are compatible with a "Main Street" development pattern of reliance on on-street parking or public or shared parking lots, commercial buildings fronting directly on the sidewalk and street, one hundred (100) percent lot coverage, service access via alleys, and signs on the buildings rather than freestanding.

Sec. 9-5-1-1. - Permitted uses.

Any use permitted shall be consistent with the purpose of this zoning district. Examples of the uses that may be appropriate, if consistent with the "Main Street" development pattern, include:

Accessory uses and structures customarily associated with the uses permitted in the CC zoning district.

Administrative offices of transportation, communications, and utilities services, and travel agencies.

Business services, excluding warehousing and storage services, equipment, automobile, and truck rental services, and other business services that require the outdoor storage of materials or products or outdoor parking of equipment or vehicles.

Cultural entertainment, and recreational facilities that are consistent with the intent of this zoning district.

Financial, insurance, real estate services, and personal services.

Minor utility installations.

Professional services, including healthcare and hospital services, and the administrative functions of government agencies.

Repair of consumer electronic equipment and appliances, watches, and other repair services that do not involve automobiles, other vehicles, or heavy equipment.

Retail stores, excluding retail sales of building materials, hardware, and farm equipment, retail sales of automobiles and other vehicles, marine craft, aircraft, and their accessories, and gasoline service stations, retail sales of farm and garden supplies, retail sales of fuel, and other retail sales that require extensive on site parking or outdoor sales or storage space.

The administrator may refer any application for a development permit in the CC zoning district to the commission for a determination of the proposed use or building's compliance (or failure to comply) with the purpose of this zoning district. Such referrals shall be placed on the agenda of the next regular commission meeting.

Sec. 9-5-1-2. - Special permit uses.

The uses permitted in the CC zoning district after public review for compliance with the applicable performance standards and approval of a special use permit shall be:

Major utility installations and public facilities, including water storage tanks, fire stations, recreation centers, and similar public facilities.

Radio or television antennas that are over fifteen (15) feet in height above the structure to which they are accessory (shorter antennas are customary accessory uses).

Any commercial use excluded by permitted uses, but which the developer clearly demonstrates will comply with the intent and purposes of the CC zoning district.

Sec. 9-5-1-3. - Prohibited uses.

All uses not explicitly permitted by prior sections of this chapter shall be prohibited.

Sec. 9-5-1-4. - Specification standards.

One hundred (100) percent lot coverage shall be permitted in this zoning district, except where it borders an RA or RB zoning district. Landscape buffers are required between new developments in the CC zoning district and residential uses. The maximum building height shall be thirty-five (35) feet.

Sec. 9-5-1-5. - Performance standards specific to the CC zoning district.

A.

Service access. All service access to uses and buildings shall be via an alley, and all uses and buildings shall have service doors, ramps, etc., commensurate with their needs on the alley.

B.

Alleys. Alleys shall be required, and must be twenty (20) or more feet wide, with a compacted base and minimum three-inch gravel surface. Utilities shall be placed in a manner that does not interfere with freight delivery vehicles.

C.

Roof drainage. Roofs shall be designed so that drainage is not directed onto sidewalks.

D.

Curbing, gutters and sidewalks. All uses and buildings shall provide curbing, gutters, and sidewalks on all street frontages. Sidewalks shall be a minimum of seven (7) feet wide.

Sec. 9-5-2. - Highway commercial zone.

This section establishes the highway commercial (HC) zoning district, the purpose of which is to provide a place for diverse retail and service uses, particularly parking and loading areas. The uses permitted in this zoning district are expected to generate traffic, including truck traffic, but generally do not have the nuisance potential of an industrial use.

Sec. 9-5-2-1. - Permitted uses.

Any use permitted shall be consistent with the purpose of this zoning district.

Accessory uses and structures customarily associated with the uses permitted in the HC zoning district.

Bus passenger terminals, broadcast studios, and the administrative offices of transportation, communications, and utility services.

Business services, excluding rental or lease of heavy equipment and warehousing and storage services where the materials or products stored are not fully enclosed within a building, or other miscellaneous business services involving outdoor storage.

Contract construction services, excluding those with outdoor storage of heavy equipment or construction materials.

Educational and miscellaneous services, and cultural, entertainment, and recreational facilities.

Financial, insurance, real estate and personal services.

Government services, excluding those with outdoor storage of heavy equipment or construction materials.

Greenhouses.

Hotels and motels, campgrounds and recreational vehicle parks.

Minor utility installations.

Newspaper and commercial printers.

Professional services.

Repair services, excluding the repair of heavy equipment.

Retail uses.

Veterinary hospitals for small animals, and kennels.

Wholesale uses, but excluding the wholesale of farm products, heavy equipment, metals, minerals, and fuels or other petroleum or chemical products, and scrap and waste products, including recyclable, or other wholesale uses requiring extensive outdoor work or storage areas.

Sec. 9-5-2-2. - Special permit uses.

The uses permitted in the HC zoning district after public review for compliance with the applicable performance standards and approval of a special use permit shall be:

Major utility installations.

Any manufacturing use that is similar to the permitted uses in scale, intensity and impact on neighboring uses.

Any use specifically excluded in permitted uses because it requires outdoor work or storage areas, but which effectively screens all outdoor storage areas from public view by a combination of site design (i.e., shielding storage with buildings); fences or walls, and landscaped buffers.

Sec. 9-5-2-5. - Performance standards specific to the HC zoning district.

A.

Curbing, gutters and sidewalks. All uses and buildings shall provide curbing, gutters, and sidewalks on all street frontages. Sidewalks shall be a minimum of five (5) feet wide.

B.

Parking. Off street parking and loading areas are required.

C.

Landscaped buffering for adjoining uses required. Landscaped buffers subject to review.

D.

Signs. See subsections 8-2-1(E) and (F) of this Code.
