- CERTIFICATE OF OCCUPANCY AND COMPLIANCE
No vacant land shall be occupied nor used except for agricultural uses and no building hereafter erected or structurally altered shall be occupied or used until a certificate of occupancy shall have been issued stating that the building or proposed use of a building or land complies with all of the building and health rules and ordinances and with the provisions of these regulations.
Certificate of occupancy and compliance shall be applied for coincident with application for a building permit and shall be issued within ten days after the erection or structural alteration in conformity with the provisions of these regulations.
A record of all certificates shall be kept on file in the office of the city engineer, or other properly appointed administrative officer and copies shall be furnished on request to any person having a proprietary or tenancy interest in the building affected.
No permit for excavation for any building shall be issued before application has been made for a certificate of occupancy and compliance.
The use of a building already erected at the passage of this ordinance shall [not] be changed from one class to another unless and until a certificate of occupancy with the provisions of this ordinance shall have been obtained from the city engineer.
Certificate of occupancy for the use of vacant land or the change in the character of the use of land as herein provided shall be applied for before any such land shall be occupied or used, and a certificate of occupancy shall be issued within ten days after the application has been made, provided such use is in conformity with the provisions of these regulations.
Certificate of occupancy for a nonconforming use existing at the time of the adoption of this ordinance shall be issued by the city engineer, or other properly appointed administrative officer, and the certificate shall state that the use is a nonconforming one, and does not conform to the provisions of this ordinance.
The city engineer, or other properly appointed administrative officer, shall notify all occupants of property being used for nonconforming uses and said occupants shall, within 30 days after receipt of said notice, apply to such officer for a certificate of occupancy.
Certificates of occupancy shall be issued only where the property and improvements for which the certificate is requested, conforms to all codes, regulations and ordinances of the City of Alice, in force and effect at that time and applicable thereto and upon the payment of a fee of $30.00.
