ARTICLE VI

RESIDENTIAL DISTRICT R-2

Sec. 66-166.- Statement of intent.

The R-2 residential district is composed of certain low and medium to high concentrations of residential uses, ordinarily located between residential and commercial areas, plus certain open areas where similar development appears likely to occur. The regulations for this district are designed to stabilize and project the essential characteristics of the district; to promote and encourage a suitable environment for family life; and to permit certain commercial uses of a character unlikely to develop general concentrations of traffic, crowds of customers and general outdoor advertising. To these ends, retail activity is sharply limited, and this district is protected against encroachment of general commercial or industrial uses. This residential district is not solely residential, as it includes certain public and semipublic, institutional and other related uses; however, since it is primarily residential in character, commercial and industrial uses are intentionally quite limited.

Sec. 66-167. - Acceptable uses.

In residential district R-2, structures to be erected or land to be used shall be for one or more of the following:

(1)

Single-family dwellings, as defined. (Amdmt. No. O-02-8, 10-1-02)

(2)

Two-family dwellings.

(3)

Schools and churches, with a cemetery as an accessory use. (Ord. No. 00-3, 8-1-00; Amdmt. No. O-02-2, 2-19-02)

Libraries.

(6)

Professional offices.

(7)

Accessory uses as defined; however, garages or other accessory structures, such as carports, porches and stoops, attached to the main building shall be considered part of the main building. No accessory building may be closer than five feet to any side or rear property line. No accessory building may be located within the main structure's front setback. (Amdmt. No. 92-5, 7-15-92)

Sec. 66-168. - Uses permitted by special exception.

In the R-2 residential district, uses permitted by special exception shall be as follows:

(1)

Mobile home parks.

(2)

Clubs, lodges, meeting and assembly halls. (Ord. No. 00-3, 8-1-00)

Residential assisted living facility, as defined. (Code of Virginia, § 63.1-172) (Amdmt. No. O-02-8, 10-1-02)

Boardinghouses, and bed and breakfast homestays. (Amdmt. No. 92-5, 7-15-92)

Child care centers. (Amdmt. No. 92-5, 7-15-92)

Sec. 66-169. - Uses permitted by special use permit.

In the R-2 residential district, uses permitted by special use permit shall be as follows:

(1)

Hotels and motels.

(2)

Amusement parks.

(3)

Apartment houses and townhouses.

(4)

Hospitals and nursing homes.

(6)

Garden centers/plant nurseries. (Amdmt. No. 89-7, 10-31-89)

(9)

Sec. 66-170. - Minimum lot area.

(a)

In the R-2 residential district, for lots served by public water and sewage disposal, the minimum lot area shall be 8,000 square feet. The health official and the zoning administrator may require a greater area if considered necessary by soil and site conditions. For lots containing more than one use or structure, excluding accessory structures, the minimum lot area shall be an additional 8,000 square feet per use or structure. (Amdmt. No. O-02-2, 2-19-02)

(b)

For lots served by either a public water system or public sewer system, the minimum lot area shall be 15,000 square feet. The health official and the zoning administrator may require a greater area if considered necessary by soil and site conditions. For lots containing more than one use or structure, excluding accessory structures, the minimum lot area shall be an additional 15,000 square feet per use or structure. (Amdmt. No. O-02-2, 2-19-02)

(c)

For lots served by individual water and sewage treatment systems, the minimum lot area shall be 20,000 square feet. The health official and the zoning administrator may require a greater area if considered necessary by soil and site conditions. For lots containing more than one use or structure, excluding accessory structures, the minimum lot area shall be an additional 20,000 square feet per use or structure. (Amdmt. No. O-02-2, 2-19-02)

Sec. 66-171. - Front yard setbacks.

In the R-2 residential district, structures shall be located 35 feet or more from any street or road right-of-way, which is 50 feet or greater in width, or 65 feet or more from the centerline of any street or road right-of-way less than 50 feet in width, except that signs advertising the sale or rental of property may be erected up to the property line. Sec. 66-172. - Frontage.

In the R-2 residential district, the minimum lot frontage of a lot or parcel at the front yard setback line shall be 80 feet or more. (Amdmt. No. O-02-8, 10-1-02)

Sec. 66-173. - Yard setbacks.

(a)

Side yard. The minimum side yard setback for each main structure or use in the R-2 residential district shall be five feet, and the total width of the two required side yards shall be 25 feet or more. (Amdmt. No. 91-5, 9-17-91; Amdmt. No. O-02-8, 10-1-02)

(b)

Rear yard. Each main building or use shall have a rear yard of 25 feet or more. (Amdmt. No. O-02-8, 10-1-02)

(c)

Distance between structures. Where more than one main structure or use is permitted on the same lot, there shall be a minimum of 25 feet separation between building or use and shall meet the required minimum setbacks for the front, side, and rear yards for a R-2 zone district. Sec. 66-174. - Corner lot setbacks.

(a)

In the R-2 residential district, the side yard setback on the side facing an improved side street shall be equal to the front setback for the district in which the lot is located.

(b)

On corner lots, as defined under article XXI of this chapter in the term "lot, corner," in subdivisions of record prior to May 1965, the setback, as defined in this article, shall be required only from the street line deemed to be the street upon which the lot fronts. The distance by which a structure must be separated from the street line along the longest side of the lot shall be not less than the minimum side yard required by the district regulations. (Amdmt. Sec. 66-175. - Buffering and screening.

In the R-2 residential district, a minimum of ten feet of buffering and screening is required where uses, other than residential, are within 100 feet of an existing residential use or a R-1 zone designation. This may also include the use of "home occupations." The zoning administrator is to determine the plant or design specifications for any buffering or screening. (Amdmt. No. O-02-2, 2-19-02)
