CHAPTER 17

14 EXISTING ORDINANCES REPEALED - SEVERABILITY - CONFLICTING PROVISIONS REPEALED - EFFECTIVE DATE

17.14.100 EXISTING ORDINANCES REPEALED

All of Chapter 13 entitled Mobile Home Parks and Other Public Lodging Places; all of Chapter 15 entitled Municipal Planning; all of Chapter 22 entitled Subdivisions; and all of Chapter 25 entitled zoning, of the Code of the City of American Fork, Utah, 1969, together with all subsequent amendments to said chapters be, and the same are hereby repealed to become effective concurrent with the effective date of this code.

17.14.200 CONFLICTING PROVISIONS REPEALED

All ordinances, resolutions, or parts thereof in conflict with the provisions of this code are hereby repealed insofar as they conflict with the provisions set forth in this code.

17.14.300 PRIOR ILLEGAL USES NOT AFFECTED

Any building or use of land or any construction thereon which was not authorized by or under the mobile home, subdivision, and zoning regulations of American Fork, Utah, 1969, including all subsequent amendments thereto, as passed by the city council of said municipal corporation, or which is illegal under such ordinance, shall remain unauthorized and illegal unless expressly authorized or permitted in the provisions of this code.

17.14.400 SEVERABILITY

This code and the various parts, sections, and clauses except for provisions relating to large scale developments, are hereby declared to be severable. If any part, section, paragraph, sentence, clause, or phrase if adjudged unconstitutional or invalid, it is hereby declared that the remainder of this code shall not be affected thereby. The city council hereby declares that it would have passed this code and each part, section, paragraph, sentence, clause, and phrase thereof, irrespective of the fact that any one or more portions thereof be declared invalid. Provided, however, if any part, section, paragraph, clause or phrase relating to large scale developments is adjudged unconstitutional or invalid, it is hereby declared that all parts, sections, paragraphs, clauses and phrases relating to large scale developments shall be declared invalid.
