DEVELOPMENT STANDARDS

§ 152.040 MINIMUM LANDSCAPE REQUIREMENTS.

   (A)   Residential landscape requirements. Residential lots 4,000 square feet or larger shall contain a minimum of 10% gross landscape area.
   (B)   Screening abutting residential. For non-residential uses abutting a residential use screening, shall be provided, and maintained in good condition as a precondition to any and every non- residential use of such abutting property.
      (1)   Landscape material used for screening shall be installed so that within three years it shall mature to a minimum of five feet.
      (2)   Opaque fencing or walls may be used in lieu of landscape screening at a minimum height of five feet using decorative or compatible materials.
   (C)   Non-residential landscape requirements.
      (1)   Ten-foot minimum landscape strip shall be provided adjacent to all rights-of-way.
         (a)   Shade trees shall be planted within the landscape strip along major streets and highways and shall be spaced no less than 40 feet apart.
         (b)   Tree species and planting specifications shall be in accordance with § 151.205 of the Subdivision Regulations, Street Trees.
         (c)   In lieu of the ten-foot landscape strip other landscape and hardscape requirements may be substituted in the CBD as part of an approved site plan.
      (2)   There shall be a minimum five- foot side and rear landscape area from the property line, which shall be curbed if adjacent to paved areas or used as stormwater retention or detention with approval of the Engineer.
      (3)   A minimum five-foot landscape area, planted with decorative trees, shrubs, flowers, or other plant materials shall be planted adjacent to all buildings.
   (D)   Landscaping shall be installed along the perimeter of stormwater retention and detention areas and shall use native plants that perform well in moist environments to create natural a littoral edge.
      (1)   Parking lots. A minimum of 6% of all parking lots shall be landscaped.
      (2)   Trees.
         (a)   For parking lots containing 18 or more parking spaces a tree island, the length of adjacent parking spaces, shall be provided at no less than ten parking stall intervals.
         (b)   Parking lot trees shall be shade tree species to diminish heat island effects.
      (3)   Screening and landscaping. Off-street parking areas for more than five vehicles shall be effectively screened on each side which adjoins premises situated in any "R" District, or institutional premises, by a fence or hedge as determined by the Zoning Inspector (due consideration shall be given to adjacent property owners).
   (E)   All trees shall be a minimum of eight feet tall and two and a half inch caliper at time of planting.
   (F)   A zoning permit shall not be issued without an approved landscape plan, where required.

§ 152.041 ARCHITECTURAL DESIGN STANDARDS.

   (A)   Buildings with blank wall surfaces abutting rights-of-way shall incorporate architectural elements, changes in wall texture or windows to break up the mass and create visual interest.
      (1)   The use of landscaping or other techniques may be approved by the Planning Commission.
   (B)   All mechanical equipment (including rooftop) must be screened from view.
   (C)   All entrances must be clearly defined and shall include one of the following:
      (1)   A minimum one-foot canopy, portico, or roof overhang.
      (2)   Architectural details such as moldings, tile work, display windows or other features.
      (3)   A combination of site amenities such as planters, benches, or trash cans; or
      (4)   Any equivalent technique to define entryways as approved by the Planning Commission.
   (D)   Permitted building materials shall be compatible with adjacent properties and a minimum of 33% of the building shall include one or more of these materials:
      (1)   Brick or stone.
      (2)   Wood (excluding wood sheeting).
      (3)   Split faced or textured masonry.
      (4)   Exterior insulation and finish systems (EIFS) or equivalent product.
      (5)   Other building finishes and materials may be approved by the Planning Commission if they are compatible with adjacent properties.

§ 152.042 FENCES AND PLANTING SCREENS.

   (A)   Fences, plant material and similar screening devices up to three feet in height are permitted in yards fronting on the public street. No planting shall be permitted in the public right-of-way without prior approval of the Street Superintendent and the Administrator.
   (B)   Fences up to six feet in height are permitted in rear and side setbacks and may be placed along the side property line to the front of the house, unless it is on a corner lot or dual frontage lot in which case § 152.045 shall control.
      (1)   The Zoning Inspector may allow a height increase within the rear and side yard of up to 18 inches in cases of unique topography or adjacent uses.
   (C)   Planted screens of any height are permitted in rear and side setbacks and may be placed along the side property line to the front of the building, unless the building is on a corner lot, in which case § 152.045 shall control.

§ 152.043 DUMPSTER ENCLOSURE.

   Solid fencing or a wall shall be installed around any trash dumpsters or receptacles to provide year-round visual screening for the purpose of effectively shielding those units, and shall meet the following minimum standards:
   (A)   Screening shall be a minimum height of six feet.
   (B)   All four sides of the dumpster must be screened.
   (C)   The screen should incorporate access to the dumpster by using a wooden fence or another opaque device to serve as a gate.
   (D)   Fencing and/or screening around dumpsters shall be maintained in good condition and free of any advertisement.

§ 152.044 ARCHITECTURAL PROJECTIONS.

   (A)   Open structures such as porches, canopies, balconies, platforms, decks, carports, covered patios, and similar architectural projections shall be considered a part of the building to which attached and shall not project into the required minimum front, side, or rear setback.
   (B)   Roof overhangs, inclusive of eave spouts and gutters, shall not project more than two feet beyond the structure and may project into the front, side, or rear setback.

§ 152.045 SPECIAL SETBACK REQUIREMENTS.

   (A)   Corner lots. In all "R" Districts, lots having frontage on more than one street shall provide the required setback along the major traveled street and meet two-thirds of the front yard setback requirements on the other street.
   (B)   Dual frontage lots.
      (1)   Lots that have frontage on a street both in the rear and the front, inclusive of parcels under single ownership used for a single primary use, shall provide the required rear setback along the designated rear frontage.
      (2)   Fences within the rear setback shall not exceed three feet.

§ 152.046 TRAFFIC VISIBILITY ACROSS CORNER LOTS.

   In any district on any corner lot, no fence, structure, or planting shall be erected or maintained within 30 feet of the "corner" at a height between two and one-half feet or more, and ten feet above curb or street grade so as not to interfere with traffic visibility across the corner. Where an alley intersects a street, the above ruling shall apply. Corner, for the purpose of the preceding sentence, shall mean the point of intersection of the edge of pavement of the adjacent streets or alleys extended to meet each other at right angles.

§ 152.047 OFF-STREET PARKING REQUIREMENTS.

   (A)   General requirements. In all districts in connection with every industrial, business, institutional, residential, or other use, there shall be provided, at any time any building or structure is erected or is enlarged or altered in any way which would provide for habitation by an increased number of people, the number of off-street parking spaces for automobiles set forth in § 152.048 in accordance with the following requirements:

   (B)   Interpretation. The following rules shall govern the determination of spaces required:
      (1)   Floor area. The gross floor area of the specified use.
      (2)   Fractional numbers shall be increased to the next whole number.
      (3)   The parking space requirement for a use not specifically mentioned herein shall be the same as required for a use of similar nature.
   (C)   The Engineer shall have the discretion to reduce or increase the minimum number of parking spaces by 15%. Requests beyond this threshold require site plan approval by the Planning Commission.
   (D)   Accessible parking shall be required in compliance with the 2010 ADA Standards and any updates thereto.
   (E)   Change of use. Except when located within the CBD District, any change of use that increases the minimum number of required vehicle parking spaces as noted below, shall be required to comply with the requirements of the zoning code:
      (1)   More than ten parking spaces; or
      (2)   More than 25% of the parking spaces that currently exist on-site or on permitted off-site locations.

§ 152.049 SPECIAL PARKING PROVISIONS.

   (A)   Every parcel of land hereafter used as a public, commercial, or private parking lot for other than single family dwelling shall be developed and maintained in accordance with the following requirements.
      (1)   Installation of curbs or wheel stops for parking stalls along the perimeter of the property to prevent any part of a parked motor vehicle from extending beyond the property line, overhanging a pedestrian walkway or sidewalk, or damaging any structure.
      (2)   Adjacent parking lots on internal parcels are encouraged to provide cross access connections and shared driveways whenever possible to minimize curb cuts off highways and collectors.
      (3)   Minimum distance and setback requirements. No part of any parking area for more than five vehicles shall be closer than 20 feet to any dwelling, school, hospital, or other institution for human care located on an adjacent lot, unless separated by an acceptably designed screen.
   (B)   Shared parking.
      (1)   Two or more non-residential uses may jointly provide and use parking spaces based upon their hours of operation, overlapping hours and amount of use, provided that the parking spaces that the proposed use(s) are within 300 feet of the principal structure.
      (2)   A shared parking agreement shall be filed with the application for a zoning permit. Shared parking agreements shall be reviewed by Legal Counsel and the Engineer and shall comply with the following criteria:
         (a)   If an office use and retail sales and service or two uses of the same type of use parking, the parking requirement for the retail sales and personal service use may be reduced by 20%, provided that the reduction does not exceed the minimum parking requirement for the office use.
         (b)   If a residential use shares parking with a retail sales or personal service other than lodging, restaurants and bars, or entertainment uses, the parking requirement for the residential use may be reduced by 30%, provided that the reduction does not exceed the minimum parking requirement for the retail sales and personal service use.
         (c)   If an office and a residential use share off-street parking, the parking requirement for the residential use may be reduced by 40%, provided that the reduction shall not exceed the minimum parking requirement for the office use.
         (d)   Shared parking based on hours of operation, daytime uses, or nighttime and Sunday only uses may share up to 80% of parking.
            1.   Daytime uses, operate anytime between the hours 8:00 a.m. and 6:00 p.m., Monday through Friday only, include customer service and administrative offices, retail sales and services, wholesale, storage, and distribution uses, manufacturing uses and other similar primarily daytime uses, as determined by the Zoning Inspector.
            2.   Nighttime uses, operating anytime between the hours of 6:00 p.m. and 8:00 or Sunday uses include auditoriums accessory to public or private schools, houses of worship, entertainment uses, restaurants and bars, or other similar nighttime or Sunday use as determined by the Zoning Inspector.
   (C)   Bicycle parking. Bicycle parking shall be required in accordance with § 152.048. As part of any site plan approval, the Engineer or Planning Commission may require additional bicycle parking if the nature of the business generates higher than required bicycle traffic.
   (D)   Surfacing and drainage. All drainage from a parking lot must be managed on site. No sheet drainage off the paved area will be permitted.
      (1)   Parking areas for more than five spaces shall be paved and curbed as directed by the Engineer. Any deviation from established drainage procedures shall require approval from the Planning Commission.
      (2)   In M-1 and M-2 Zoning Districts, the Engineer shall have the discretion to reduce paving and curbing for developments requiring five or less parking spaces that also utilize large storage and internal drive areas in addition to parking.
      (3)   For developments that exceed five spaces, hard surface and/or curbing requirements may be relaxed during the site plan review with Planning Commission Approval.
   (E)   Lighting.
      (1)   Commercial and industrial parking lots with more than five parking spaces are required to have lighting. Any lighting used to illuminate any off-street parking area shall be so arranged as to reflect the light away from adjoining properties.
      (2)   Horizontal luminance shall have an average maintained one foot-candle with a minimum level of 0.25 foot-candle on the parking lot surface from dusk until termination of normal business hours

§ 152.050 OFF-STREET LOADING REQUIREMENTS.

   (A)   In any district, in connection with every building or part thereof having a gross floor area of 10,000 sq. ft. or more, which is to be occupied by manufacturing, storage, warehouse, retail, wholesale, hotel, hospital, mortuary, or other uses similarly requiring the receipt or distribution by vehicle or materials or merchandise, shall provide and maintain on the same lot at least one off-street loading space, plus one additional such loading space for each additional 20,000 sq. ft.
   (B)   Each loading space shall be no less than 14 feet in width, 45 feet in length.
   (C)   A lot abutting a public or private alley or access easement adjacent to a loading or parking area shall provide a parallel area of not less than 12 feet in width.
   (D)   The CBD "Core" sub-area shall be exempt from this requirement. The municipality may establish on street loading zones and specified hours for deliveries.
