Ballston Lake Residential District

§ 138-46 Uses permitted.

All uses permitted and all uses requiring site plan approval or a special use permit are listed on the Table of Uses, Area, Frontage and Setback Requirements for Ballston Lake Residential District (Attachment 11) located at the end of this chapter.[1]

§ 138-47 Area requirements.

All area requirements for each use are so indicated on the Table of Uses, Area, Frontage and Setback Requirements for Ballston Lake Residential District located at the end of this chapter (Attachment 11).[1]

§ 138-48 Purpose and intent.

The Ballston Lake Residential District is an area that is conducive to greater density for residential dwelling purposes due to its location and proximity to infrastructure, particularly water and sewer connections via extensions from existing systems. It also serves as a transition zone between the nearby or adjacent areas of higher density in the neighboring Town of Malta and the Ballston Lake Waterfront area. As such, this district is appropriate for a higher level of future residential development that also promotes open space, environmental protection, and maintenance of community character of the Round Lake, Sweet, Valentine and Lake Roads, provision of water and sewer infrastructure. It is also an area that is conducive, if conditions are appropriate, for traditional neighborhood design. Because this is an area suitable for higher residential density, this district is also established to promote provision of neighborhood amenities such as small parks and playgrounds, trails, and walkways in order to enhance pedestrian friendliness and the traditional neighborhood feel. Higher density is allowed with the expectation that more amenities will be required in order to enhance or create traditional-type neighborhoods.

§ 138-49 Design standards.

A. 
Conservation subdivision and traditional neighborhood design.
(1) 
Conservation subdivision required. All major subdivisions proposed in the Ballston Lake Residential District shall be designed as a conservation subdivision as per Article X, Conservation Subdivision Development, of Chapter 104 of the Ballston Town Code with a minimum of 50% of the parcel permanently preserved. There shall be a one-acre minimum lot size within a conservation subdivision when public water and sewer infrastructure is not provided for.
(2) 
Traditional neighborhood design option. For all major subdivisions proposed in the Ballston Lake Residential District, the conservation subdivision design may also establish new dwellings clustered as a Traditional Neighborhood Design using development standards set forth in § 104-15 of Chapter 104, Subdivision of Land, of the Town Code.
B. 
Density calculation shall be as per the Table of Uses, Area, Frontage and Setback Requirements (Attachment 11) for the Ballston Lake Residential District.
(1) 
The allowable density shall be calculated using a net acreage calculation as per § 138-157. Note that subdivision design using conservation subdivision methodology shall not affect calculation of allowable density.
(2) 
Average lot sizes as per § 138-157 may also be used for subdivisions to optimize preservation of open space in this district.
C. 
Purchase of development rights (PDR) and density bonuses. Density bonuses may be applied as set forth in Article XXVIV, only when the proposed development participates in the Town of Ballston Purchase of Development Rights (PDR). A proposed development may also participate in the Green Energy Incentive Program of Article XXVIV.
