ARTICLE VI
Zoning Board of Adjustment
§ 147-29 Zoning Board dissolved.

A.
The Zoning Board of Adjustment is hereby dissolved in accordance with P.L. 1985, c. 516, and the Planning Board shall exercise to the same extent and subject to the same restrictions all of the powers formerly exercised by the Zoning Board of Adjustment. All provisions in Article VI of the Code of the Borough of Bay Head inconsistent herewith, are hereby repealed and of no effect.
B.
All references to the "Zoning Board" or "Zoning Board of Adjustment" in this Code are hereby amended to refer to the "Planning Board," except where such reference is clearly inapplicable.[1]

§ 147-30 Expiration of variance.

Any variance from the terms of this chapter granted by the Planning Board permitting the erection or alteration of any structure or structures or permitting a specific use of any premises shall expire by limitation, unless such construction or alteration shall have been actually commenced within one year from the date of the adoption of a written resolution by the Planning Board; except, however, that the running of the period of limitation herein provided shall be tolled from the date of the filing of an appeal from the decision of the Planning Board to a court of competent jurisdiction until the termination in any manner of such appeal or proceeding.[1]
