Chapter 1101 - PLANNING COMMISSION

Editor's note— Provisions concerning the Planning Commission of Bay Village are set forth in Article VII of the City Charter. Chapter 115 of the Administrative Code prescribes the procedure for applications to the Planning Commission for zoning, rezoning, land use and land development. There are no sections in this Chapter 1101. It has been established to provide a place for cross references and any future legislation.

Editor's note— Although the Thoroughfare Plan for the City of Bay Village was originally adopted by ordinance and has been amended subsequently, such ordinances are not included in the Codified Ordinances due to the fact that it is felt that the Thoroughfare Plan is an instrument of the Planning Commission rather than the City Council and, therefore, is not subject to repeated amendment by Council whenever the Plan is modified.

Chapter 1104 - RESERVED

Editor's note— Chapter 1104, which pertained to rezoning petitions, was repealed by Ord. No. 75-24, passed 5-5-75. See Administrative Code 115.02.

1103.01 - Planning commission to designate areas for city acquisition.

The Planning Commission is authorized, upon the preparation of a plan and map of the whole or any portion of the City which shall show the Commission's recommendations for the general location, character and extent of streets, alleys, ways, bridges, boulevard, parkways, parks, playgrounds and other public grounds, ways and open spaces, the general location of public buildings and other public property, to designate by a good and sufficient legal description within the area so planned and mapped, the areas deemed by it necessary for the City to acquire in order to effectuate the purposes of the plan and map. Such designation, however, need not be of the whole of the area generally proposed for public use, but may be done by a series of resolutions passed from time to time, each describing part only of the whole area determined necessary for the City to acquire.

1103.02 - Building commissioner, council to receive resolution.

Upon the passage of a resolution designating a certain area as necessary for the City to acquire in order to effectuate the plan and map, the Planning Commission shall cause a copy of said resolution, duly certified, to be delivered to the Building Commissioner and the Council.

1103.03 - Applications for improvements inconsistent with resolution; permit after 90 days.

From and after the date of the receipt of such certified resolution, the Building Commissioner shall not issue a permit for the improvement of the land so described, or adjacent thereto, inconsistent with the terms and provisions of said resolution for a period of 90 days from and after the date that an application for the improvement is filed with the Building Commissioner.

1103.04 - Council and planning commission to be notified of inconsistent applications.

Upon the filing of an application for the improvement of the land so described, or adjacent thereto, inconsistent with the terms and provisions of said resolution, the Building Commissioner shall forthwith notify the Council and the Planning Commission in writing of the filing of such application.

1103.05 - Application for improvement issued.

Unless the land so described is acquired by the City, or an action for the appropriation thereof instituted in accordance with law, within said 90-day period, the application for the improvement as filed with the Building Commissioner, providing the same is in all other respects in accordance with law, shall be issued.
