Chapter 1191 Off-Street Parking

All off-street parking spaces in existence on April 29, 1954 shall continue to be maintained and shall not be reduced so long as the existing use of the main building or structure remains, unless an equivalent number of such off-street parking spaces is provided in any other permitted location.

At the time of construction of any main building or structure or when the same is enlarged or increased in capacity of adding dwelling units, floor area or seats, or when the use of the same is enlarged or increased in capacity, there shall be provided in accordance with the following schedule, parking spaces located off the streets and in conformity with the requirements of this Zoning Code with adequate driveway provisions for ingress thereto and egress therefrom, and such off-street parking spaces shall thereafter be maintained so long as the use of the main building or structure remains, unless an equivalent number of such off-street parking spaces is provided in another permitted location:
For a building, structure or use not scheduled above, the Building Director shall apply and establish such unit of measurement from the foregoing schedule as applies to the scheduled building, structure or use found by him to be most similar to such unscheduled building, structure or use.

Where any single development consists of two or more buildings, structures or uses having the same hours of operation, off-street parking spaces shall be provided at least equal in number to the sum of the parking spaces required hereunder for such individual buildings, structures and uses.

With respect to institutions, places of amusement or places of worship it may be assumed that not more than 50 percent of the off-street parking spaces hereunder required therefor are provided by off-street parking lots of adjacent business establishments, if any, having different hours of operation, and reduction in the number of off-street parking spaces so required for such institutions, places of amusement and places of worship may be made to such extent.

The portion of the lot occupied by required off-street parking spaces shall not by conveyance or encumbrance be detached from such lot during the continuance of the main building, structure or use thereon.

Notwithstanding the accessory use provisions of this Zoning Code, where sufficient area is not available on a lot for providing required off-street parking spaces therefor, then such off-street parking spaces may be located within 300 feet of the main building, structure or use of such lot on other lots; provided, however, that the portions of such other lots so to be used shall be owned or leased by the applicant and satisfactory assurance of his right to continued use of such premises for such use shall be furnished to support his application for a building permit.

Driveways providing access to off-street parking spaces, other than driveways for residential lots, shall have a width of not less than ten feet and not more than 12 feet if such driveway constitutes a one-way access to the off-street parking spaces; of not less than 18 feet and not more than 20 feet if it is a two-way access driveway. In the event that the Planning Commission determines that the above stated widths are not suitable for the proposed site and use, it shall have the power to vary such widths. The Planning Commission determination to vary such widths shall be based on the number of off-street parking spaces served by the driveways, the number of driveways serving the off-street parking facility, the width of abutting streets, the amount of traffic on abutting streets, the type and location of traffic control devices controlling traffic on abutting streets, pedestrian traffic in the area, the distance of such driveways from street intersections, traffic pattern within the off-street parking facility and the safety of vehicular and pedestrian traffic in the general area of the off-street parking facility.

All off-street parking spaces and driveways, for other than residential lots, shall have smoothly graded, stabilized and dustless surfaces with adequate drainage, with such appropriate guards or curbs as the Building Director shall deem necessary to define parking spaces or limit the parking area, and with proper safeguards necessary to prevent injury to adjacent premises as a result of use of such parking spaces or driveways.

Notwithstanding the accessory use provisions of this Zoning Code, no off-street parking space shall be located within five feet of the side line of any lot.

In Administrative Office and Apartment House Districts and in Business Districts illumination of off-street parking spaces shall be installed, provided, however, that the design and location of such illumination shall be such that Residence Districts and streets shall be shielded from any light source, and provided further, however, that such illumination shall not be of such brightness as to constitute a safety hazard to users or occupants of such parking spaces or adjacent premises.

All buildings and structures hereafter constructed for or converted to use, in whole or in part, for business, commercial or manufacturing purposes shall be provided with adequate off-street loading or unloading platforms or space located not less than 50 feet from the front street line. Any such platforms or space located beside a building, structure or street shall be so located that a motor vehicle while loading or unloading will not interfere with the pedestrian or vehicular traffic upon any street or alley. For manufacturing, storage, wholesale or rental buildings or structures one off-street loading and unloading space shall be provided for each 20,000 square feet of floor area or fraction thereof.

When there are existing structures located on lots in either commercial or retail districts, the uses of which are to be changed or which structures are to be increased in size or capacity, the Planning Commission may decrease the number of required off-street parking spaces and/or decrease driveway width as required in this chapter, upon finding that the decrease in the number of spaces and/or decrease in driveway width will not unreasonably interfere with vehicular and pedestrian traffic in the area, and that the denial of the decrease will result in a manifest injustice to the property owner.
