ARTICLE III

ZONING DISTRICTS AND MAP

216.300 - Districts established.

Sec. 3.00. The Village of Blissfield is hereby divided into the following districts:

R-1 One Family Residential District
R-2 One Family Residential District
RM-1 Multiple Family Residential District
C-1 Local Commercial District
C-2 Central Business Commercial District
C-3 General Commercial District
I-1 Industrial District
I-2 Heavy Industrial District
O/R, I Office, Research and Industrial District
PL Public Land District

216.301 - Map.

Sec. 3.01. The boundaries of these districts are shown upon the Official Zoning Map of the Village of Blissfield and made a part of this Ordinance. All notations, references, and other information shown thereon are a part of this Ordinance and have the same force and effect as fully described herein.

216.302 - Authority.

Sec. 3.02. This Ordinance is adopted pursuant to Public Act 110 of 2006, as amended, of the State of Michigan. Said enabling act covering City and Village zoning is herein made a part of this Ordinance by reference.

216.303 - Interpretation of district boundaries.

Sec. 3.03. Where uncertainty exists with respect to the boundaries of the various districts as shown on the Zoning Map the following rules shall apply:

1.

Boundaries indicated as approximately following the center lines of streets, highways, or alleys shall be construed to follow such center lines.

2.

Boundaries indicated as approximately following platted lot lines shall be construed as following such lot lines.

3.

Boundaries indicated as approximately following Village limits shall be construed as following Village limits.

4.

Boundaries indicated as following railroad lines shall be construed to be the midway between the main tracks.

5.

Boundaries indicated as following shore lines shall be construed to follow shore lines, and in the event of change in the shore line, shall be construed as moving with the actual shore line: boundaries indicated as approximately following the center line of streams, rivers, canals, lakes, or other bodies of water shall be construed to follow such center lines.

Boundaries indicated as parallel to or extensions of features indicated in subsections 1. through 5. above, shall be so construed. Distances not specifically indicated on the Official Zoning Map shall be determined by the scale of the map.

Where physical or cultural features existing on the ground are at variance with those shown on the official Zoning Plan or in other circumstances not covered by subsections 1. through 6. above, the Zoning Board of Appeals shall interpret the district boundaries.

Insofar as some or all of the various districts may be indicated on the Zoning Map by patterns which, for the sake of map clarity, do not cover public rights-of way, it is intended that such district boundaries do extend to the center of any public right-of-way.

216.304 - Interpretation.

Sec. 3.04. In the interpretation and application, the provisions of this Ordinance shall be held to be minimum requirements adopted for the promotion of the public health, morals, safety, comfort, convenience, or general welfare. It is not intended by this Ordinance to repeal, abrogate, annul, or in any way to impair or interfere with any existing provision of law or ordinance other than the above described Zoning Ordinance, or with any rules, regulations, or permits previously adopted or issued or which shall be adopted or issued pursuant to the law relating to the use of buildings or premises; provided, however, that where this Ordinance imposes a greater restriction than is required by existing ordinances or by rules, regulations, or permits, the provisions of this Ordinance shall control. Nothing in this Ordinance should be interpreted or construed to give rise to any permanent vested rights in the continuation of any particular use, district, zoning classification, or any permissible activities therein; and, they are hereby declared to be subject to subsequent amendment, change, or modification as may be necessary to the preservation or protection of public health, safety, and welfare.
