ARTICLE VII

C-2, CENTRAL BUSINESS DISTRICT

216.700 - Intent.

Sec. 7.00. This district is intended to encompass the retail, service, and administrative establishments which form the central business district and which provide retail convenience and comparison goods and personal and professional services for the trade area. Heavy volumes of traffic in this district necessitate an efficient system of arterial streets and highways and adequate parking facilities. The nature and high density and intensity of commercial and related uses in this district eliminate the necessity for lot and yard requirements.

216.701 - Permitted uses.

Sec. 7.01. The following provisions apply in all C-2, Central Business Districts. Any use not expressly permitted is prohibited.

1.

Any generally recognized retail business that supplies commodities on the premises, such as but not limited to: foods, liquor, furniture, clothing, dry goods, notions, drugs, or hardware. No warehousing/storage of materials/items or goods for sale outside the C-2 District shall be allowed.

2.

Any personal service establishment which performs services on the premises within a completely enclosed building, such as, but not limited to: repair shops (watches, radio, television, shoe, etc.), tailor shops, beauty parlors, barber shops, interior decorators, photographers and dry cleaners.

3.

Restaurants and taverns where the patrons are served while seated within a building occupied by such establishment, and wherein said establishment extends as part of, or accessory thereto, onto/into the traveled portion of any sidewalk. Provided however that tables and chairs and service stands must not extend into the public right-of-way any more than 30 inches nor shall any table and/or chair and/or service stand create a space of less than 48 inches between the chair and/or table and/or service stand and any other item (i.e., light pole, curb, trash container, flower box). Provided further that all tables, chairs, serving stands, and rubbish containers shall be removed and stored within the building at the end of the business day. Provided also that all food, debris and utensils and associated items shall be removed immediately after use. Any such service plan must also obtain all necessary Lenawee County Health Department Licenses and follow all Lenawee County Health Department Regulations. No more than two two-person tables and chairs may be placed in either the front or the rear, but not both, of an establishment.

4.

Offices and office buildings of an executive, administrative or professional nature.

5.

Public and quasi-public buildings such as, but not restricted to:

(a)

Churches.

(b)

Municipal offices.

(c)

Municipal off-street parking lots.

(d)

Libraries and museums.

(e)

Fraternal organizations, clubs, and lodge halls.

6.

Banks, with drive-in facilities permitted when said drive-in facilities are incidental to the principal function.

7.

Theaters or similar uses.

8.

Offices and showrooms of plumbers, electricians, decorator, or similar trades, in connection with which not more than 25 percent of the floor area of the building or part of the building occupied by said establishment is used for making, assembling, remodeling, repairing, altering, finishing, or refinishing its products or merchandise, and provided that: the ground floor premises facing upon and visible from any abutting street shall be used only for entrances, offices or display. All storage of materials on any land shall be within the confines of the building or part thereof occupied by said establishment.

9.

Business schools, or private schools, operated for profit. Examples of private schools permitted herein include, but are not limited to the following: dance schools, music and voice schools, and art studios.

10.

Newspaper offices and printing plants.

11.

Hotels and motels.

12.

Bus passenger stations.

13.

Other uses similar to the above uses.

14.

Computer sales and service.

15.

Accessory structures and uses customarily incidental to the above permitted uses.

16.

Items may be placed in front and/or behind business under the following conditions:

16.1.

Items must represent the nature of the business.

16.2.

Items must not impede access to or from the establishment by extending into a space less than the width of the present entrance.

16.3.

Items must not extend into the public right-of-way more than 30 inches nor shall these items create a space less than 48 inches between the curb and/or any existing feature/structure (i.e., light pole).

16.4.

Items on public property shall be removed at the end of the establishment's business day.

16.5.

Items placed on private property need not be removed at the end of the business day.

16.6.

No item may extend/be placed so it extends into any alley, street, lane or boulevard whether platted or unplatted.

16.7.

Vehicles and/or implements waiting for repair/improvement must be removed for work within 30 days.

16.8.

This section shall not apply to wood which is stored prior to use for the purposes of heating any building.

17.

Decorative enhancement/additions to an establishment's front or rear facade may be made under the following conditions:

17.1.

Items must be firmly attached to the building and pose no safety hazard.

17.2.

Items must not extend more than 24 inches into the public right-of-way, nor create a passageway less than 48 inches between the attachment and any curb or existing feature/structure.

17.3.

Items showing obvious deterioration must be removed.

18.

Outside vending machines may be placed under the following conditions:

18.1.

If on private property, only with the approval of the Village and the approval of the property owner where the vending machine stands. Further provided that said vending machine(s) shall be in good working order and may only sell bottled or canned non-alcoholic beverages. There shall be no more than five machines in the C-2 District. No beverage vending machines shall be allowed on public property.

19.

Building materials used for the renovation of an establishment may be placed on private property under the following conditions:

19.1.

Placement of these materials shall not create a public health or safety hazard.

19.2.

Materials must be used/removed within 30 days or an application for a time extension must be made to the Village Council.

19.3.

The placement of any material must be such that it does not extend into any alley, street, lane, or boulevard whether platted or unplatted and does not extend into the public walkway more than 30 inches nor shall these items create a space less than 48 inches between the curb and any existing feature/structure (i.e., light pole, refuse, container, bench).

20.

One, two and multiple-family dwelling units within an existing commercial building subject to the following conditions:

(a)

It is the intent herein to provide for the conversion of the upper floors of existing commercial buildings and to extend their economic life by permitting the construction of one, two, and multiple-family residential dwelling units.

(b)

Dwelling units or sleeping rooms shall not be located below the second floor.

(c)

A minimum floor area of 400 square feet for efficiency apartments;

(d)

A minimum floor area of 600 square feet for a one (1) bedroom apartment;

(e)

A minimum floor area of 750 square feet for a two (2) bedroom apartment;

(f)

A minimum floor area of 950 square feet for a three (3) bedroom apartment;

(g)

All apartments' entrances shall be by way of an entrance separate from and apart from the commercial use occurring on the lower floor(s).

216.702 - Special land uses.

Sec. 7.02. The following special land uses shall be permitted, subject to the conditions hereinafter imposed and subject to the review and approval by the Village of Blissfield Planning Commission:

1.

Reserved.

2.

Bed and breakfast (subject to regulations in Section 13.17 [216.1317]).

3.

Solar panels (subject to Section 216.1325).

216.703 - Area, height, bulk and placement regulations.

Sec. 7.03. Area, height, bulk, and placement requirements unless otherwise specified are as provided in Article XII, Schedule of Regulations.

216.704 - Site plan review.

For all uses permitted in the C-2 Central Business District, a site plan shall be submitted to the Planning Commission for review and approval in accordance with Section 13.07 (216.1307) only if a variance or rezoning is necessary, as determined by the Zoning Administrator.
