ARTICLE 12

SPECIFIC USE PERMITS

§ 12.01 Purpose.

The purpose of the Special Use Permit is to authorize and regulate uses which may be beneficial in a specific instance to the general welfare of the community, yet ensure that such uses are not detrimental to surrounding property, and are consistent with the stated purpose of the zoning district in which such uses are located regarding conditions of operation, location, arrangement, and construction.

§ 12.02 Authority to Issue Specific Use Permits.

The City Commission of the City of Bonham, Texas, after public hearing and proper notice to all parties affected, and after recommendation by the City Planning and Zoning Commission, may authorize the issuance of specific use permits for the uses indicated by “S” in the Schedule of Uses in Appendix 1 of this ordinance.

§ 12.03 Application Process.

A property owner may petition the City for a specific use of property, as authorized by the zoning district in which the property is located. An application for a Specific Use Permit shall be accompanied by a site plan drawn to scale and showing the general arrangement of the project, together with essential requirements such as off-street parking facilities; size, height,
construction materials, and locations of buildings; the uses to be permitted; location and construction of signs; means of ingress and egress to public streets; visual screening such as walls, landscaping, and fences, and the relationship of the intended use to all existing properties and land uses in all directions to a minimum distance of two hundred (200) feet.

§ 12.04 Review and Recommendation by Planning and Zoning Commission.

The Planning and Zoning Commission shall consider any petition for a Specific Use Permit. The Planning and Zoning Commission in considering and determining its recommendation to the City Commission on any request for a Specific Use Permit may require from the applicant plans, information, operating data, and expert evaluation concerning the location and function and characteristics of any building or use proposed. The Commission shall make recommendations as to requirements for the paving of streets, alleys, and sidewalks, means of access to public streets, provisions for drainage, adequate off-street parking, protective screening and open space, heights of structures, compatibility of buildings, and any other conditions which the Commission regards as important to the welfare of the citizens of the City and protection of adjacent or nearby property from excessive noise, vibration, dust, smoke, fumes, gas, odor, explosion, glare, offensive view, or other undesirable or hazardous conditions.

§ 12.05 Review and Action by City Commission.

After proper notice and a public hearing, the City Commission may grant a permit for a specific use of property as authorized by the zoning district in which the property is situated. The City Commission may require information, operating data, and expert evaluation concerning the location and function and characteristics of any building or use proposed. The City Commission may, in the interest of the public welfare and to assure compliance with this ordinance, establish conditions of operation, location, arrangement, and construction of any use for which a permit is authorized. In authorizing the location of any of the uses listed as Specific Use Permits, the City Commission may impose such development standards and safeguards as the conditions and location(s) warrant relative to the welfare of the citizens of the City and protection of adjacent property from excessive noise, vibration, dust, smoke, fumes, gas, odor, explosion, glare, offensive view, or other undesirable or hazardous conditions.
The City Commission shall authorize issuance of a Specific Use Permit only after determining that adequate provisions have been made for the paving of streets, alleys, and sidewalks, means of access to public streets, provisions for drainage, adequate off-street parking, protective screening and open space, heights of structures, and compatibility of buildings.

§ 12.06 General Provisions.

a. 
Permits To Be Attached to Site Plan and Accepted by Grantee
All Specific Use Permit conditions approved by the City Commission shall be attached to the site plan drawing (or drawings) and shall be accepted through written agreement by the applicant, owner, or recipient of the permit.
b. 
Permits to be Considered Amendments to Ordinances
A Specific Use Permit shall be considered as an amendment to the Zoning Ordinance and shall be processed in accordance with Article 20 of this ordinance. The approved site plan accompanying the request for a Specific Use Permit shall be made part of the amending ordinance.
When the City Commission authorizes granting of a Specific Use Permit, the Zoning Map shall be amended according to its legend to indicate that the affected area has conditional and limited uses.
c. 
More Restrictive Provisions to Govern
Whenever regulations or restrictions imposed by this ordinance are either more or less restrictive than regulations imposed by any governmental authority, the regulations or restrictions which are more restrictive or impose higher standards or requirements shall govern.
