Exceptions to Minimum Area and Setback Regulations for Previously Platted Lots in the City of Bonham
The City Manager, or his designee, may approve lesser minimum lot sizes, including widths and depths; and lesser setbacks for improvements if such requests are deemed necessary for the construction or placement of a home in the City and such construction does not contradict with any building restrictions in subdivisions which have deed restrictions approved by the City; and further, that such construction must adhere to the following guidelines:
The minimum size lot area, minimum lot width and minimum lot depth may be adjusted when constructing or placing single-family residential or duplex residential dwellings on any lot platted prior to the effective date of this Ordinance, which lies in the Revitalization Zone of the City (as defined by City Resolution 071403.4), or on any lot outside the Revitalization Zone, if platted prior to 1978, provided that such lot is smaller than the minimum required square footage, or if the existing platted lot has lesser width and depth lengths than the minimum required under the present Zoning Ordinance; and provided that builder can produce house plans for appropriate placement of a home on the property in such a manner as to blend with the neighborhood, and not create a fire, health, or safety hazard as determined by the Fire Marshall.
Also, reduced front, side, and rear yard setbacks may be allowed if consistent with the neighborhood and deemed necessary for appropriate placement of a home; however, the front yard setback shall not be closer than the front of the adjacent home or homes, unless the adjacent home is set back farther than the minimum 25-foot front setback; and side and rear yard setbacks shall not be closer than five feet from the applicable property lines, unless a setback less than five feet is approved by the Fire Marshall as not being a fire, health or safety hazard.
