Section 14.1. - Residential center city overlay district.

The residential center city overlay district is defined as pictured and designated on the map attached to this exhibit.

The overlay district is a specially designated residential area of the city that conforms to not only the basic zoning, building and property maintenance regulations but also to standards of this overlay ordinance protecting the traditional character of established neighborhoods by applying a set of infill housing standards regulated by the building inspector and the ad hoc architectural review committee.

There are a number of properties in this overlay district that fall within a C-1 or C-2 commercial district even though the properties are currently more residential in nature or surrounded by residential uses. Applies only on all newly constructed residential structures in the designated area.

The residential properties included under this ordinance are those residential properties designated on the attached map. Any additions, deletions or changes to the properties included in the residential center city overlay district by street or neighborhood shall be added by request to the P&Z commission. This is considered a zoning change and requires a public hearing with the city council before any changes may be approved.

Section 14.2. - Goal.

To protect the traditional character of a neighborhood in the central city as to style and form by enacting a zoning overlay district applying to all newly constructed residential structures in the designated area.

The established neighborhoods to be included in Boonville's Residential Center City overlay district are defined according to the residential center city overlay district map, herein attached and referenced as Exhibit A to the enabling ordinance.

The following residential infill housing standards are applicable to all lots, not just undersized lots, in the designated area:

(1)

Standard No. 1. Maintain the line of building fronts in a block.

a.

A building should fit within the range of yard dimensions seen in the block.

b.

Maintain the uniform spacing of side yards.

c.

When new sidewalks are to be installed, they should be compatible with the historic character of the streetscape.

d.

Maintain the established progression of public to private spaces.

Standard No. 2. Orient the front of a building to the street.

a.

Orient the front of a house to the street and clearly identify the front door.

b.

The use of a porch is encouraged in any residential development.

c.

Porch supports should be of a substantial enough size that the porch does not appear to float above the entry.

(3)

Standard No. 3. Plant materials should be used to create continuity among buildings.

a.

Use plant materials that are adapted to the Boonville climate.

b.

Maintain mature trees whenever feasible.

c.

Incorporate established plantings in new projects.

d.

When plant materials are used for screening they should be designed to function year-round.

(4)

Standard No. 4. Maintain the traditional character of a front yard.

a.

Use a grass lawn in the front yard.

b.

If a fence or wall is to be used in a front yard, then it should be low to the ground and have a transparent quality, allowing views into the yard.

c.

A fence may be used to define a side or rear yard.

d.

If a retaining wall is considered, use materials similar to those seen traditionally.

Standard No. 5. A new building should appear similar in scale to traditional single family houses.

a.

New construction should appear similar in mass and scale to nearby structures.

b.

On larger structures, subdivide larger masses into smaller modules that are similar in size to single-family residences seen traditionally.

Standard No. 6. The form of a new building should be similar to those seen traditionally.

a.

Use building forms similar to those found traditionally.

b.

Use traditional roof forms.

Standard No. 7. Building materials for new construction should be similar to materials seen traditionally.

a.

Maintain the existing range of exterior wall materials.

b.

Exterior finishes should appear similar to those used traditionally.

c.

Masonry should appear similar to that used traditionally.

d.

Materials should be applied in a manner similar to that used traditionally.

e.

Newer synthetics materials may be considered for a new structure, if they appear similar in character and detailing to traditional building materials.

f.

Roofs should be composite material shingles or metal.

Standard No. 8. A new building should be visually compatible with traditional residential structures in the area.

a.

Use contemporary interpretations of architectural features that are common to traditional buildings in the context.

b.

If they are to be used, design ornamental elements, such as brackets and porches, to be in scale with similar traditional features.

c.

Where a deck is used, it should be unobtrusive, as seen from the street.

d.

Windows and doors should be similar in location, size and type to those seen traditionally.

e.

The ratio of window openings to solid wall should be similar to that of traditional buildings.

Section 14.3. - Statement of purpose.

The ad hoc architectural review committee will serve as a building permit application review body for persons desiring to build a new home in the designated residential center city area by reviewing the submitted house plans and exterior facade features, defining the character of the applicable existing neighborhood and applying the standards as approved by the historic preservation advisory committee, planning and zoning commission and city council.

Section 14.4. - Application of the residential center city overlay district infill housing standards.

The standards identified in Exhibit B of the enabling ordinance shall be applied for the purpose of integrating a new home into the fabric of the existing neighborhood while being sensitive to the owner's desires to build a cost effective, marketable and energy efficient home. Not every standard must be met, however, a preponderance of the standards and intent of the ordinance must be met in order to achieve a reasonable compatibility with the existing neighborhood character.

Section 14.5. - Membership.

The ad hoc architectural review committee will consist of five members. These members will be appointed by the mayor and shall consist of individuals living within the City of Boonville with the following areas of expertise, knowledge and/or interest:

(1)

Representative living in the overlay district.

(2)

Historic preservationist (may be current member of the historic preservation advisory committee).

(3)

Architectural historian (may be current member of the historic preservation advisory committee).

(4)

Land use and zoning advisor (may be current member of the planning and zoning commission).

(5)

Residential building contractor/builder.

(6)

Real estate agent/broker.

City staff from the building inspection department will provide recommendations to the committee and the city administrator will serve as building commissioner for any appeal purposes.

Section 14.6. - Meeting schedule.

The meetings will be called at the request of the building inspector when an application for building in the designated district has been received. An application will be reviewed and a response given by the committee within 14 days of receipt of the building permit application.

Section 14.7. - Required documents to prepare for the committee.

The applicant shall submit a building permit application with an attached picture or sketch of the exterior design of the house and orientation of the house on the lot selected. Any additional features such as landscaping, fencing and/or color schemes that are to be used to fit the house into the existing neighborhood should be demonstrated pictorially or in written description.

Section 14.8. - Appeal process.

If the applicant is not satisfied with the recommendations and findings of the review committee, the applicant shall appeal to the city council.
