ARTICLE XXXVIII

Administration and General Provisions

§ 245-326 Administrative officer.

The provisions of Part 2 of this chapter shall be administered and enforced by the administrative officer as defined in § 245-3 or his designee. In no case shall a permit be granted for the construction, alteration or use of any building where the proposed construction, alteration or use thereof would be in violation of any provisions in Part 2 of this chapter. It shall be the duty of the administrative officer or his designee to cause any building, plans or premises to be inspected or examined and to order, in writing, the remedying of any conditions found to exist in violation of any provisions of Part 2 of this chapter, and he or his designee shall have the right to enter any building or premises in the course of these duties. Any actions of a duly authorized designee shall be subject to the review and approval or disapproval of the administrative officer.

§ 245-327 Permits, certificates and records.

A. 
Conditional use permits. Applications for any conditional use permit as permitted by Part 2 of this chapter shall be made to the Planning Board as per Article XXXII, § 245-279 et seq. In approving any such application, the Planning Board may impose any conditions that it deems necessary to accomplish the reasonable application of the standards as provided in Article XXXII, and may deny any such application not in accordance with said standards.
B. 
Certificate of occupancy. Certificates of occupancy shall be issued by the Construction Official in the manner prescribed in the Township Building Code[1] and shall be signed by the Construction Official. Such signature shall certify that all provisions of Part 2 of this chapter have been complied with in respect to the property or structure in question. Such signature shall be granted or denied within 10 days of the submission of the certificate to the Construction Official.

C. 
Records. It shall be the duty of the head of the Division of Inspection to keep a record of all applications for zoning permits issued and a record of all certificates of occupancy which he signs, together with a notation of all special conditions involved. He shall file and safely keep copies of all plans submitted, and the same shall form a part of the records of his office and shall be available for the use of the Township Council and other officials of the Township of Brick. The Zoning Officer shall prepare a monthly report for the Township Council summarizing, for the period since his last previous report, all zoning permits issued and certificates signed by him and all complaints of violations and the action taken by him consequent thereon. A copy of each such report shall be filed with the Township Tax Assessor at the same time it is filed with the Township Council.

§ 245-328 Applications for zone changes.

Any application for a zone change under this chapter shall be accompanied by a certification executed by the Tax Collector indicating that the real property taxes on those premises which are the subject of such application have been paid and are current to the date of the application.

§ 245-329 Violations and penalties.

Failure to comply with any provision of Part 2 of this chapter shall be considered a violation of Part 2 of this chapter and shall be punishable as provided in Chapter 1, § 1-15, General penalty. Each date of such violation's continuance shall be considered as a separate offense and shall be separately punishable. These penalties shall not be the exclusive remedy available, and nothing in Part 2 of this chapter shall prevent the application for and the obtaining of injunctive relief.

§ 245-330 Amendments.

The Township Council of the Township of Brick may, at any time, after a public hearing, add to or amend any portion of Part 2 of this chapter in accordance with N.J.S.A. 40:55D-1 et seq., as amended.
