900 NORTH/MAIN

STREET PLANNED DISTRICT

§ 156.320 PURPOSE AND INTENT.

   The purpose and intent of establishing the 900 North/Main Street Planned District is to address a very specific area of the city which is located at the crossroads of North Main Street and 900 North Street, State Route 13 and State Route 38. The Planned District is intended to create a zoning district that can be a productive and vibrant location for promoting businesses and jobs. The Planned District site is bound by Main Street on the west, 900 North Street on the north and 100 East on the east. (See Exhibit "A", legal description and site map, attached to the ordinance codified herein, as illustrated in § 156.324.)

§ 156.321 PLANNED DISTRICT.

   The 900 North/Main Street Planned District shall apply to all properties located within the corporate limits of Brigham City at the southeast corner of the 900 North Street and Main Street intersection as shown in Exhibit "A", attached to the ordinance codified herein as illustrated in § 156.324.
   (A)   Zoning district established. P-GC (Planned - General Commercial).
   (B)   Uses. The following uses are allowed within the P-GC District, which otherwise may not be listed in the underlying General Commercial Zoning District:
      (1)   The underlying zone is General Commercial; all uses allowed under the same permitted or conditional use designation as in other General Commercial Districts are hereby allowed in this Planned District.
      (2)   Additional permitted uses allowed and incorporated in the P-GC District:
         (a)   Landscape service business. A business that designs, installs and maintains landscape. Business includes the parking of trucks and equipment trailers on-site. No on-site repair and maintenance of landscape related machinery, including its trucks, equipment, and trailers and storage of landscape materials or fertilizers.
   (C)   General Development Plan. The approved civil site and landscape plans and new building elevations continue to serve as the General Development Plan for this 900 North/Main Street Planned District, except that the proposed site plan shall serve as the modified parking and secured area plan. Any significant revision to the General Development Plan requires an amendment to this subchapter.

§ 156.322 STANDARDS AND REGULATIONS.

   The following provisions shall apply in this P-GC District, which district shall also be subject to other provisions of the city code, except where conflict in regulations occur, the regulations specified in this subchapter, or on the development plan approved pursuant to this subchapter shall apply.
   (A)   Standards for area, coverage, density, yard requirements (setbacks), height regulations, parking, lighting and signage shall be governed by the standards of the GC (General Commercial) District, city code chapters on sign regulations and off-street parking requirements.
   (B)   Standards for public improvements shall be governed by applicable adopted city ordinances and laws, including adopted Public Work Standards.
   (C)   (1)   Landscaping shall be governed by the standards of the GC District and accepted General Development Plan.
      (2)   A minimum of 50% of the area of the required landscaping shall consist of live plant materials.
      (3)   Park strip areas (area between curb and sidewalk) in the public right-of-way is to be landscaped with grass and street trees.
      (4)   Screening of any secured area shall be achieved through chain link fencing with slats or other appropriate methodology approved by the Planning Commission. The installed two-rail steel fencing along a portion of 100 East Street and a portion of 900 North Street in lieu of the security fence where the area is improved and used for parking is allowed through a hold harmless agreement with Brigham City and recorded with the property due to the fencing location within the public right-of-way and located adjacent to the public sidewalk. Said fencing serves as a barrier between the parking and the public sidewalk in lieu of the required landscape and is to be maintained for such purposes.
   (D)   New building construction is intentionally allowed to be flexible and creative. The exterior texture, siding, color, type and the like is to be advanced by owner/applicant and as approved by the Planning Commission.

§ 156.323 CONFLICTS AND SEVERABILITY.

   (A)   Conflict. Whenever regulations in this subchapter conflict with other provisions of the city code, the provisions of this subchapter shall govern. Whenever regulations of other provisions of the city code address matters that are not addressed by this subchapter, then said other provisions shall govern.
   (B)   Severability. This subchapter and the various parts, sections and clauses are hereby declared to be severable. If any part, section, paragraph, sentence, clause or phrase is adjudged to be unconstitutional or invalid, it is hereby declared that the remainder of the subchapter shall not be affected thereby. The City Council hereby declares that it would have passed this subchapter on each part, section, paragraphs, sentence, clause or phrase hereof, irrespective of the fact that any one or more portions thereof be declared invalid.
