- ESTABLISHMENT OF DISTRICTS
This article is established to provide districts for the various uses of land within the City and to provide for the interpretation of district boundaries on the zoning map.
For the purposes of this ordinance, the City of Buena Vista, Georgia, is divided into ten districts designated as follows:
The boundaries of these districts are hereby established as shown on the map entitled "Zoning Districts Map - Buena Vista, Georgia," dated ________ and certified by the City Clerk. Said map is hereby made part of this ordinance; it shall be on file in the office of the City Clerk and available for public inspection.
If, in accordance with the provisions of this ordinance, changes are made in district boundaries portrayed on the zoning map, such changes shall be made on the official zoning map promptly after the amendment has been approved by the City Council.
Where uncertainty exists with respect to the boundaries of any of the aforesaid districts shown on the zoning map, the following rules apply:
54.1.
Where district boundaries are depicted as approximately following the centerline of streets or highways, centerlines of streams or drainageways, street lines, or highway right-of-way lines, such centerlines, street lines, or highway right-of-way lines shall be construed to be such boundaries.
54.2.
Where district boundaries are so depicted that they approximately follow the lot lines, such lot lines shall be construed to be said boundaries.
54.3.
Where district boundaries are so depicted that they are approximately parallel to the centerlines of streets, highways, or railroads, or rights-of-way of same, such district boundaries shall be construed as being parallel thereto and at such distance there from as indicated on the zoning map. If no distance is given, such dimension shall be determined by the use of the scale shown on said zoning map.
54.4.
Where a district boundary line as appearing on the zoning map divided a lot in single ownership at the time of enactment of this ordinance, the district requirements for the least restricted portion of such lot shall be deemed to apply to the whole therefore provided that such extension shall not include any part of such a lot more than 35 feet beyond the district boundary line.
54.5.
In case the exact location of a boundary cannot be determined by the foregoing methods, the City Council shall, upon application, determine the location of the boundary.
