40 - Transitional Applications

17.40.010 - Transitional applications.

Prior to the adoption of Ordinance No. 2012-18 which enacted this Title effective December 1, 2012, the prior version of Title (Prior Code) authorized zoning entitlements for properties in the PD Zoning District consisting of a Preliminary PD Site Plan (PPD), followed by a Final PD Site Plan (FPD). Under this Title the equivalent entitlements are denominated as a PD Plan (see Chapter 17.34) and Site Development Plan (see Chapter 17.38), respectively. A Site Development Plan also provides the equivalent entitlements as a General Site Plan (GSP) or Preliminary Plat (PP). As of December 1, 2012, certain applications for approval of a PPD or FPD were active. Each applicant for a PPD, FPD, PP/FPD, GSP, or Preliminary Plat shall have 90 days from December 1, 2012 to elect to proceed under either the Prior Code or this Title. If no election is made within such ninety-day period the application shall be converted to an application for entitlements under this Title. Except where timely election is made to proceed under the Prior Code, an application for a PPD shall be further processed as an application for a PD Plan and an application for an FPD, PP/FPD, GSP or Preliminary Plat shall be processed as an application for a SDP. Applicants shall conform pending submittals to the requirements under this Title and other applicable Town Regulations. No additional processing or review fees shall be imposed on applications that are converted from the Prior Code to this Title within the ninety-day period.
