CHAPTER 4

RESIDENCE DISTRICTS

10-4A-1: PERMITTED USES:

Permitted uses in the residence A zone are:
Accessory buildings, provided they shall be located as required in section 10-2-5 of this title and subsection 10-4A-2E of this article.
Home occupations as herein provided.
One-family dwellings.
Signs; one on each lot not exceeding twelve (12) square feet in area, pertaining to the lease or sale of the building or premises on which the sign is located placed flush on a building on the premises, and not self-illuminated.
Special uses, subject to the provisions of section 10-10-3 of this title.
Temporary buildings used for construction purposes for a period not to exceed one year.
Truck gardening and other horticultural uses.
Uses customarily incident to any of the above uses, including permitted home occupations, as provided herein. (Ord. 499, 4-16-2009)

10-4A-2: LOT AREA AND YARDS:

No building or structure, nor the enlargement of any building or structure, shall be hereafter erected or maintained unless the following described yards and lot areas are provided and maintained in connection with such building, structure or enlargement:
   A.   Front Yard: Each lot upon which a dwelling is constructed shall have a front yard of not less than thirty feet (30'). Where lots comprising forty percent (40%) or more of the frontage between two (2) intersecting streets are developed with a variation of not more than twenty feet (20') in depth, the average of such front yards shall establish the minimum front yard depth for the entire frontage. In no case shall a front yard of more than fifty feet (50') be required.
   B.   Side Yards: The minimum distance of any building, including accessory buildings, from the side lot line of an adjoining interior lot shall be fifteen feet (15') for any building fifteen feet (15') in height or less, and for buildings greater than fifteen feet (15') in height, such minimum distance shall be fifteen feet (15') plus four inches (4") for each foot or fraction thereof in excess of fifteen feet (15') in building height, measured from average ground level adjacent to lot line to the peak of the roof. The minimum distance of any building, including accessory buildings, from the street adjacent to a side lot line shall be five feet (5').
   C.   Rear Yard: There shall be a rear yard having an average depth of not less than ten feet (10'); provided, that accessory buildings may be placed up to the real lot line.
   D.   Lot Area: Every dwelling erected or structurally altered shall be on a lot having an area of not less than ten thousand (10,000) square feet and a width at the established building line of not less than one hundred feet (100'), and there shall be no more than one dwelling for each lot; provided, however, that a single lot having less area and width, the title to which has been recorded before the enactment of this title, may be improved with a single-family dwelling, provided all yards and open spaces are within seventy five percent (75%) of those required herein, and provided further, the total lot area is not less than seven thousand five hundred (7,500) square feet.
   E.   Accessory Buildings; Yard Obstructions: Accessory buildings shall not encroach upon the front yard, but they may encroach upon the rear yard as hereinabove provided; provided, that on a corner lot, accessory buildings shall not encroach upon the front or side yards adjacent to the abutting streets. 10-4A-3: BUILDING HEIGHT:

No building or structure, nor the enlargement of any building or structure, shall be hereafter erected or maintained to exceed two and one-half (21/2) stories, nor shall it exceed thirty five feet (35') in height. Accessory buildings shall not exceed fifteen feet (15') in height. (Ord. 499, 4-16-2009)

10-4A-4: DWELLING WIDTH:

Minimum width of any dwelling, including manufactured/mobile homes, in residence A zone, shall be twenty feet (20'), exclusive of porches, patios, carports and garages. (Ord. 499, 4-16-2009)

10-4B-1: PERMITTED USES:

Permitted uses in the residence B zone are any uses permitted in the residence A zone. (Ord. 499, 4-16-2009)

10-4B-2: ACCESSORY BUILDINGS AND USES:

Accessory buildings and uses customarily incident to any of the above uses, including permitted home occupations, as provided herein, are permitted. (Ord. 499, 4-16-2009)

10-4B-3: LOT AREA AND YARDS:

No building shall be erected nor shall any existing structure be enlarged or altered unless the following yards and lot areas are provided and maintained in connection with such building, structure or enlargement:
   A.   Front Yard: Front yards in the residence B zone shall be fifteen feet (15').
   B.   Side Yards: The minimum distance of any building, including accessory buildings, from a side lot line shall be one foot (1') for each one foot (1') or fraction thereof in building height, or ten feet (10'), whichever is greater. The minimum distance of any building, including accessory buildings, from a street adjacent to a side lot line, shall be five feet (5').
   C.   Rear Yard: Rear yards in the residence B zone shall be not less than ten feet (10'); provided, that accessory buildings may be placed up to the rear lot line.
   D.   Lot Area: Every dwelling erected or structurally altered shall be on a lot having a width at the established building line of not less than forty five feet (45') and an area of not less than four thousand five hundred (4,500) square feet, and there shall be no more than one dwelling for each such lot. 10-4B-4: BUILDING HEIGHT:

No building shall be erected or enlarged to exceed a height of two and one-half (21/2) stories, nor shall it exceed thirty five feet (35') in height. (Ord. 499, 4-16-2009)
