088.290 - TRUCK TRACTORS AND TRAILERS
A.
Notwithstanding any other provision within this Title and with the exception of areas zoned B-5 Warehouse Commercial District and M-1 Industrial District and for properties that special use permits have been issued, no real estate in any zoning district shall be used for the parking or storage of truck tractors, trailers, or semi-trailers.
B.
The parking and storage of truck tractors, trailers, or semi-trailers shall be permitted in areas zoned HP-1 Hospitality Park District so long as the operator and/or owner of the truck tractor, trailer, or semi-trailer is registered as a hotel or motel guest of such an accommodation located within the HP-1 Hospitality Park District.
C.
For the purposes of this section, the following definitions shall apply:
Parking means the standing of a vehicle, whether occupied or not, otherwise than when actually engaged in loading or unloading merchandise or passengers.
Semi-trailer means every vehicle without motor power designed for carrying persons or property and for being drawn by a motor vehicle and so constructed that some part of its weight and that of its load rests upon or is carried by another vehicle.
Storage means the standing of an unoccupied vehicle, otherwise than when temporarily and actually engaged in loading or unloading merchandise or passengers.
Tow truck means every truck designed or altered and equipped for and used to push, tow or draw vehicles by means of a crane, hoist, towbar, towline or auxiliary axle, or intended to render assistance to disabled vehicles.
Trailer means every vehicle without motor power designed for carrying persons or property and for being drawn by a motor vehicle and so constructed that no part of its weight rests upon the towing vehicle.
Truck tractor means every motor vehicle designed and used primarily for drawing other vehicles and not so constructed as to carry a load other than a part of the weight of the vehicle and loads so drawn, with the exception of a tow truck.
D.
Any nonconforming use resulting from the adoption of this section shall be subject to a ninety (90) day amortization period from the date of this section's effective date (9/28/98) and they shall either be removed or brought into compliance with this section within the amortization period.
E.
The enforcement of the provisions of this section may be exercised by either the Zoning Administrator or Code Compliance Officer in the manner provided for in Section 17.104.110. Notwithstanding the foregoing, nothing herein shall be construed as to prevent or preempt enforcement of this section in any other manner provided for in this Title.
F.
Any person who is convicted of a violation of this section shall be fined not more than seven hundred fifty dollars ($750.00) plus costs. Each day that a violation continues shall be considered a separate offense.
