CHAPTER 17

16 R-3 HIGH DENSITY RESIDENTIAL DISTRICT

§ 17.16.010 R-3 Purpose.

A. 
Purpose. The purpose of the R-3 high density residential district is to provide living areas within the city where development provides for high density concentrations of dwelling units together with specific ancillary and complementary uses. It is intended to implement the applicable provisions of the general plan, as amended from time to time.
B. 
Provision. In the R-3 district no building or land shall be used and no building shall be constructed, erected, altered, added to, enlarged or moved for any purpose or in any manner except in compliance with these regulations.

§ 17.16.020 R-3 Principally permitted uses.

The following uses are principally permitted in the R-3 district:
A. 
Dwelling groups consisting of one-family, two-family, or multiple-family dwellings;
B. 
Manufactured housing as defined and mandated by Government Code Section 65852.3, subject to the provisions of Chapter 17.48;
C. 
Accessory buildings;
D. 
Home occupations;
E. 
Accessory Dwelling Unit (ADU) and/or Junior Accessory Dwelling Unit (JADU), subject to the provisions of Chapter 17.35;
F. 
Single room occupancy (SRO) units;
G. 
Rooming houses;
H. 
Residential care facilities for twelve or fewer clients;
I. 
Transitional/Supportive housing as defined and mandated by Government Code Section 65651; and
J. 
Employee housing for six or fewer employees in a single-family dwelling as defined and mandated by the California Health and Safety Code Section 17021.5.

§ 17.16.025 R-3 Uses permitted subject to a use permit.

The following uses may be permitted subject to the granting of a conditional use permit (see Chapter 17.54) in the R-3 district:
A. 
Bed and breakfast establishments subject to the provisions of Chapter 17.59;
B. 
Dormitories owned by public or nonprofit agencies;
C. 
Convalescent hospitals or assisted care homes operated by a person with state, and/or local agency license;
D. 
Mobile home parks;
E. 
Residential hotels;
F. 
Religious institutions;
G. 
Family day care facilities for fifteen or more children;
H. 
Parking lot; and
I. 
Small public facilities such as schools and public utility substations.

§ 17.16.030 R-3 Property development standards.

All development within the R-3 district shall be subject to the following development standards:
A. 
Height.
1. 
Main Building. Maximum thirty-five feet; and
2. 
Accessory Building. Maximum sixteen feet.
B. 
Yard Setbacks from Property Boundary.
1. 
Front Yard Setbacks.
a. 
All buildings. Minimum ten feet.
b. 
Garage doors and carport entrances. Minimum twenty feet.
2. 
Side Yard Setbacks.
a. 
Interior. Minimum five feet.
b. 
Exterior. Minimum ten feet.
3. 
Rear Yard Setbacks.
a. 
Main Buildings. Minimum ten feet.
b. 
Accessory Buildings. Minimum five.
4. 
Mobile home parks.
a. 
Front, side and rear yard setbacks shall apply to the exterior of the park.
b. 
Internal development shall be subject to the adopted city mobile home park standards, subject to the provisions of Chapter 17.48.
C. 
Lot Area.
1. 
Minimum six thousand square feet.
D. 
Density.
1. 
Minimum one dwelling unit per fifteen hundred square feet; and
2. 
Maximum thirty dwelling units per acre.
3. 
Mobile home parks. One dwelling per forty-three hundred square feet.
E. 
Lot Coverage.
1. 
Maximum sixty-five percent for all buildings and structures.

§ 17.16.040 R-3 Building placement.

All building placement within the R-3 district shall be subject to the following:
A. 
Accessory buildings:
1. 
All buildings are subject to fire prevention code requirements.
2. 
A five-foot (5 ft) passage from one side yard to the area to the rear of the main building, to the other side yard shall be maintained. This passage shall provide ready access around the main building.
3. 
Construction on accessory buildings may only be started after the main building on the lot has been roofed and has had the siding constructed.
4. 
Coverage of the rear yard by accessory building, structures or covered patios shall be limited to fifty percent of the required rear yard area.
B. 
All new structures upon the lot shall be arranged to provide for the maximum dwelling unit potential.

§ 17.16.060 R-3 Townhouse (row dwellings) requirements.

Each group of townhouses shall maintain required side yards at its extremities. No group of townhouses shall exceed one hundred fifty feet (150 ft) in length and front and rear yards shall conform to the district requirements.

§ 17.16.070 R-3 General provisions.

All development within the R-3 district shall be subject to the following general provisions:
A. 
Site Plan and Architectural Design Review. Subject to the provisions of Chapter 17.46.
B. 
Landscaping. Subject to the provisions of Chapter 17.41 and 17.43.
C. 
Parking. Subject to the provisions of Chapter 17.42.
D. 
Fencing. Subject to the provisions of Chapter 17.40.
E. 
Signs. Subject to the provisions of Chapter 17.39.
Exterior Lighting. All new exterior lighting shall be shielded and directed downward on the property to prevent upward glare and glare at adjacent properties.
