ARTICLE I

Purpose And Authority

§ 172-1 Purpose and authority.

The purpose of this chapter is to promote the public health, safety, morals and general welfare of residents of the Township of Darlington. The following regulations or restrictions shall be in full force and effect upon signature by the Board of Supervisors of Darlington Township.

§ 172-2 Short title.

This chapter shall be known as "The Darlington Township Zoning Ordinance."

§ 172-3 Statement of community development goals and objectives.

This chapter has been prepared in consideration of the character of the Township, with the recognition of the presence of environmental constraints which indicate a growth management approach based on the occurrence within the Township of steep slopes, wetlands, floodplains and land situated within rights-of-way established for the transmission of electricity which creates electromagnetic fields. Elements considered in the preparation of this chapter include existing land use patterns, the character of the remaining undeveloped land and the capacity of the community's basic infrastructure to support additional development. Consideration has also been given to development activities and trends in the areas surrounding the Township. The purpose of this chapter is to guide future growth and development within the Township in accordance with the following general goals:
A. 
General goals:
(1) 
To preserve the quality of life within the Township's residential neighborhoods;
(2) 
Retain the rural character of the Township through the application of growth management techniques;
(3) 
Pursue land use policies which emphasize creative treatment of existing conditions and result in low-impact development;
(4) 
To undertake physical improvements to the man-made landscape that will create a better community and improve the attractiveness of the Township as a place to live and work;
(5) 
To provide for a variety of employment opportunities as well as a range of housing options in appropriate areas;
(6) 
To provide citizens and prospective developers with a clear understanding of the Township's land use decisionmaking process;
(7) 
To encourage citizen participation in the land use decisionmaking process.
B. 
Specific objectives — short range:
(1) 
Land use goal: prepare an inventory of prime development sites in the Township and manage new growth in those areas through appropriate land use regulations.
(2) 
Housing goal: encourage maintenance and repair of existing housing stock while promoting quality in new residential construction.
(3) 
Transportation goal: continue the established trend of commitment of significant portion of tax revenues to roadway maintenance and improvement projects.
(4) 
Public facilities goal: provide centralized municipal services to eliminate duplication.
(5) 
Socioeconomic goal: prepare a new residents and developers packet for distribution to persons interested in relocating to Darlington Township.
C. 
Specific objectives — long range:
(1) 
Land use goal: retain rural character of the community and limit disturbance of significant natural areas.
(2) 
Housing goal: provide for a wide variety of residential development, including starter homes and housing designed for seniors.
(3) 
Transportation goal: prioritize roadway improvements based on projected volumes, current deficiency and best-fit options.
(4) 
Public facilities goal: consider the need for public sanitary sewers and a treatment facility as on-lot system failures prohibit new residential development.
(5) 
Socioeconomic goal: monitor the rate of infill and expansion in Light Industrial Zones and overall permit trends identified in the Township.

§ 172-4 Municipal liability.

The granting of a zoning/building permit for the erection and/or use of a building or lot shall not constitute a representation, guarantee, or warranty of any kind or nature by the municipality, or an official or employee thereof, of the safety of any structure, use or other proposed plan from any cause whatsoever, and shall create no liability upon or a cause of action against such public official or employee for any damage that may result pursuant thereto.

§ 172-5 Interpretation and strict construction.

In applying and interpreting the provisions of this chapter, they shall be held to be the minimum requirements necessary for the promotion of the health, safety and general welfare of the residents of Darlington Township. All ordinances, regulations and rules made pursuant to any act of assembly repealed by Act 170, an amendment to the Pennsylvania Municipalities Planning Code, Act 247, as amended,[1] shall continue except as those provisions are inconsistent herewith. The provisions of this chapter pursuant to authority granted by Act 170 shall be severable, and if any of its provisions shall be held to be unconstitutional, the validity of any of the remaining provisions shall not be affected. It is hereby declared as the legislative intent that this chapter would have been adopted had such unconstitutional provision not been included herein.
