ARTICLE VII

H-C Highway Commercial District

§ 172-51 Purpose.

The H-C Highway Commercial District is created in order to provide for a variety of retail and commercial uses with access to high volume roadways and separated from residential neighborhoods.

§ 172-52 Restrictions.

A building may be used, erected, or altered and a lot or premises may be used for any of the following purposes, subject to off-street parking regulations as set forth in Article XV.

§ 172-53 Permitted uses.

Permitted uses:
A. 
Automotive service stations and auto body shops.
B. 
General retail sales.
C. 
Hotels; motels. See § 172-127.
D. 
Restaurants.
E. 
Drive-in restaurants.
F. 
Golf driving range, miniature golf courses.
G. 
Supermarkets or grocery stores.
H. 
Hardware stores.
I. 
Theaters.
J. 
General or medical offices.
K. 
Laundromats and dry cleaning establishments.
L. 
Drugstores.
M. 
Banks.
N. 
Communications tower. See § 172-124.
O. 
Self-storage facilities.
P. 
Greenhouses, horticulture and landscaping supply yards, for commercial/retail sale, conducted upon a lot or parcel of land not less than five contiguous acres in area.

Commercial kennels.

§ 172-54 Conditional uses.

Public hearing shall be required to be held by the Board of Supervisors. All conditions specified herein shall be met:
A. 
Senior citizen high rise. See § 172-143.
B. 
Public or private high schools. See § 172-139.
C. 
Retail shopping centers over 50,000 square feet, subject to the recommendation of the Planning Commission, and compliance with the provisions of Chapter 147, Subdivision and Land Development, of the Code of the Township of Darlington. See § 172-141.
D. 
Home occupation. See § 172-136.
E. 
Adult businesses. See § 172-131.
F. 
Two principal uses limited to those allowed under the permitted and conditional uses of this zoning district. No property shall have more than two principal uses under this conditional use provision.

§ 172-55 Uses by special exception.

Uses by special exception:
A. 
Nonresidential storage buildings. See § 172-146.

§ 172-56 Lot area.

Each lot shall be at least 43,560 square feet (1 acre) in area with a minimum lot width of 100 feet at the building setback line.

§ 172-57 Required yards.

Each lot shall have front, side, and rear yards of not less than the depth or width below indicated.
A. 
Front yard: minimum of 40 feet from the right-of-way line.
B. 
Side yards: two; width: 10 feet each side of a principal building, provided that when a written agreement is provided by adjoining property owners, no side yard shall be required where two or more commercial uses abut side to side. However, in no case shall party walls be permitted between properties of separate ownership. In the case of a series of abutting structures abutting and paralleling a public right-of-way, an open and unobstructed passage for vehicles and pedestrians, of at least 30 feet in width, shall be provided at grade level at intervals of not more than 1,000 feet.
C. 
Rear yard: minimum of 15 feet.

§ 172-58 Height.

The height of a building shall be no greater than 36 feet, except as otherwise specified. (See Article XII, § 172-118.)

§ 172-59 Lot coverage.

A. 
No structure or combination of structures, including sidewalks, driveways and parking areas, shall be permitted to exceed 75% of the gross lot area.
B. 
At least 10% of the total lot area shall be covered with vegetative material. These planted areas shall be reasonably dispersed throughout the premises.
