CHAPTER 17

13 ORDINANCE ADMINISTRATORS

17.13.010 City Council.

The City Council has the following specific powers pursuant to this ordinance:
A. 
To make final decisions on zoning text and map amendment applications.
B. 
To make final decisions on planned unit development applications.
C. 
To make final decisions on appeals of design proposal and building demolition decisions.
D. 
To make final decisions on the adoption of or amendment to the Comprehensive Plan.

17.13.020 Plan and Zoning Commission.

The Plan and Zoning Commission has the following powers pursuant to this ordinance:
A. 
To make recommendations to the City Council on zoning text and map amendment applications.
B. 
To make recommendations to the City Council on preliminary plans for planned unit development applications and final decisions on final plans for planned unit development.
C. 
To hear and report on such matters as may be referred to it by the City Council.
D. 
To make recommendations to the City Council on the adoption of or amendment to the Comprehensive Plan.

17.13.030 Zoning Board of Adjustment.

The Zoning Board of Adjustment has the following powers pursuant to this ordinance:
A. 
To make final decisions on special use applications.
B. 
To make final decisions on hardship variance applications.
C. 
To make final decisions on zoning appeals.
D. 
To hear and report on such matters as may be referred to it by the City Council.

17.13.040 Zoning Administrator.

The Director of Community Planning and Economic Development, or his/her designee, is considered the Zoning Administrator. The Zoning Administrator may designate one or more City staff persons to act as the Zoning Administrator; however, a zoning decision may only be rendered once. The Zoning Administrator has the following powers pursuant to this ordinance:
A. 
To make final decisions on administrative exception applications.
B. 
To make final decisions on zoning interpretation applications.
C. 
To receive and forward zoning applications as required by this ordinance to the Design Review Board, Plan and Zoning Commission, Zoning Board of Adjustment, City Council, or City official, as appropriate.
D. 
To make final decisions on design proposal decisions where the Design Review Board has granted authority to the City staff.

17.13.050 Design Review Board.

The Design Review Board also has the following powers pursuant to this ordinance:
A. 
To make final decisions on design proposal decisions.
B. 
To make final decisions on building demolition decisions.
C. 
To make recommendations on applications for encroachments into and over the public right-of-way.
