1001.41 TEMPORARY

STRUCTURES.

Subd. 1 Purpose.

   The purpose of this section is to provide for the erection of temporary structures (not including model homes/temporary real estate offices or temporary classroom structures for use by a public or private institution) needed for emergency purposes or for temporary use during the construction of a permanent structure.

Subd. 2 Procedure.

   The erection of a temporary structure shall require an administrative permit, as may be issued by the Zoning Administrator, except as otherwise provided by City Code. Failure to meet the requirements of this section shall be grounds for revocation of any issued permit.

Subd. 3 Special Requirements

   (1)   Temporary structures governed by this section shall be allowed in all zoning districts.
   (2)   No administrative permit shall be issued for a temporary structure unless: a site plan meeting or exceeding the requirements of City Code has been submitted for the review and approval of the Zoning Administrator, if required by the Zoning Administrator, or unless a building permit has been issued for a new structure, addition or remodeling of an existing structure on the property.
   (3)   The administrative permit shall terminate 9 months from its date of issuance, or within 30 days after a certificate of occupancy has been issued by the Building Official for the permanent structure, whichever occurs first, unless a different time schedule is approved as part of the permit. The permit may be extended for an additional 90 days by and at the discretion of the Zoning Administrator.
   (4)   Temporary structures may be placed in a required building setback area, provided that no such structure may be placed within 30 feet of a public right-of-way or obstruct visibility, as determined by the City, at any public right-of-way intersection or driveway access.
   (5)   All applicable requirements of the State Building Code shall be met to the satisfaction of the City.
   (6)   Provisions for water and sewer servicing the temporary structures shall be subject to the review and approval of the Building Official. Any such requirements shall be met to the satisfaction of the Building Official.
   (7)   A plan for security measures of the temporary structure, including but not limited to lighting, shall be submitted subject to the review and approval of the Zoning Administrator and shall be implemented as required by the Zoning Administrator.
   (8)   Parking shall be in compliance with the requirements of City Code.
   (9)   Signage shall be in compliance with the requirements of City Code Subsection 1001.20, and its amendments.
