- ENACTMENT AND INTENT
There is hereby established a zoning plan for the City of Dover, which plan is set forth in the text and map that constitute this ordinance.
It is the legislative intent of this zoning ordinance to provide for the orderly and desirable development and use of land. This ordinance provides specifications, procedures, and a precise plan designed to guide new development while improving, conserving, or facilitating desirable change in existing portions of the city. As provided in the Delaware Code Municipalities Law (title 22, section 303, 22 Del. C. § 303), this ordinance is to serve the purpose of protecting and promoting the general welfare, which is intended to include the following:
1.
To encourage the most appropriate use of land throughout the city.
2.
To assure [ensure] adequate sites for present and future local and regional needs for residence, industry and commerce.
3.
To allow the greatest freedom in development and design consistent with other purposes expressed herein.
4.
To enhance the general appearance of the city.
5.
To provide for the privacy of family residences.
6.
To facilitate the adequate and efficient provision of community facilities, services, and utilities.
7.
To promote the safe and efficient circulation of vehicles and pedestrians.
8.
To require the adequate provision for off-street parking and loading.
9.
To retain the overcrowding of land with persons or structures in relation to open space, circulation, and neighboring land uses.
10.
To prevent and eliminate other hazards and nuisances.
11.
To attain the objectives set forth in the comprehensive development plan.
