CHAPTER 6

- ACCESSORY BUILDINGS

Sec. 5-6-1. - Location.

(a)

Unless otherwise authorized by this Code, no accessory building or structure may be located within the minimum side yard required for the main building. However, when an accessory building or structure is located in the rear yard, it may then be located within five feet of the interior lot line, but not nearer than five feet to the rear lot line in any residential district, nor nearer than ten feet to the rear lot line in any B-1, B-2 or B-3 district.

(b)

Unless otherwise authorized by this Code, no accessory building or structure shall be located on a reversed corner lot beyond the front yard required on the adjacent lot to the rear, nor be located nearer than five feet to the side lot line of the adjacent building.

(c)

Unless otherwise authorized by this Code, no portion of any accessory building shall be located closer to any adjacent street than that portion of the principal building (excluding porches, stoops, overhangs and other similar appurtenances) which is closest to the adjacent street.

Sec. 5-6-2. - When erected.

An accessory building shall not be erected prior to the establishment or construction of the main building to which it is accessory, with the exception that a private detached garage may be erected prior to the establishment or construction of the principal dwelling building to which it is accessory, provided that the following requirements are met:

(1)

That prior to the issuance of the building permit for the private detached garage, a site plan for both the principal dwelling building and the private detached garage is approved.

(2)

That within one year after the building permit has been issued for the detached private garage, work is begun on the principal dwelling building.

(3)

That the use of the private detached building, prior to the construction of the principal dwelling building, be limited to the storage of materials and equipment used in the construction of the principal dwelling building.

(4)

That the contractor or owner requesting the building permit for the detached private garage posts a $1,000.00 corporate surety bond to cover the cost of removing the detached private garage and the footings of the principal dwelling building if the requirements of the ordinance from which this chapter derives and all other city ordinances are not complied with.

Under no circumstances shall the private detached garage be used as a dwelling structure.

Sec. 5-6-3. - Limitation on area and height.

(a)

The total area of all accessory buildings located on a lot in a conservation and residential estate district, or in an R-1 One-Family Dwelling District, an R-2 One-Family Dwelling District or an R-3 Two-Family Dwelling District, or on any other lot not located within one of the districts, which lot is used as the location for a one-family dwelling or a two-family dwelling, shall not exceed the lesser of:

(1)

One thousand two hundred fifty square feet; or

(2)

The amount by which the maximum lot coverage permitted in the district where the lot is located exceeds the total area of all buildings already located or under construction on the lot in question.

(b)

On any lot in a C Conservation and Residential Estate District, or in an R-1 One-Family Dwelling District, an R-2 One-Family Dwelling District, or an R-3 Two-Family Dwelling District, or on any other lot not located within one of the districts, which lot is used as the location for a one-family dwelling or a two-family dwelling, the building height of an accessory building shall not exceed the lesser of:

(1)

Twenty-one feet; or

(2)

The building height of the principal building located on the lot in question;

provided, however, that in the event that the principal building has not yet been constructed, no accessory building shall exceed 14 feet in building height.

Sec. 5-6-4. - Limitation on number.

No more than two accessory buildings may be located on any lot in a C Conservation and Residential Estate District, or in an R-1 One-Family Dwelling District, an R-2 One-Family Dwelling District, or an R-3 Two-Family Dwelling District, or on any other lot not located within one of the districts, which lot is used as the location for a one-family dwelling or a two-family dwelling.

Sec. 5-6-5. - Other restrictions on use and location of accessory buildings.

(a)

In addition to all other regulations governing the size of accessory buildings, no accessory building or buildings which are totally or partially located within a minimum required rear yard in a residential zoning district may occupy more than 40 percent of said minimum required rear yard.

(b)

Freestanding carports are not permitted in any residential district. However, carports that are attached to the primary structure and are consistent with the building materials and architecture of that structure are allowed.

(c)

No use may be made of any accessory building other than a use which is accessory to the primary use which is lawfully conducted on the lot where the accessory building is located.

(d)

No quonset hut-style accessory buildings or temporary sheds (non-rigid panel made of vinyl, canvas, or other similar material) may be constructed or located in any zoning district identified in chapter 8 of the East Peoria Zoning Code.

(e)

Accessory buildings with a metal exterior, where permitted by this title, must have factory applied paint.

(f)

All accessory buildings having an area in excess of 150 square feet shall: 1) be constructed of substantially the same materials as the principal structure located on the same zoning lot as the accessory structure; 2) shall be architecturally consistent with the principal structure; and 3) comply with the minimum construction standards established by the East Peoria Building Code.
