06 HEIGHT AND AREA REGULATIONS

§ 10.06.001 Height.

(a) 
The height regulations prescribed herein shall not apply to television and radio towers, church spires, monuments, tanks, water and fire towers, stage towers or scenery lofts, cooling towers, ornamental towers and spires, chimneys, elevator bulkheads, smokestacks, conveyors, and flagpoles.
(b) 
Public, semipublic or public service buildings, hospitals, institutions or schools, in zoning districts where they are permitted as of right, may be erected to a height not exceeding 60 feet and churches and temples may be erected to a height not exceeding 75 feet when the required side and rear yards are each increased by one foot for each foot of additional building height above the height regulations for the district in which the building is located.
(c) 
Sports lighting facilities owned by or under the control of a governmental entity and utility poles and towers owned by a public utility and used for the transmission and distribution of electricity may be erected to any height in any zoning district.

§ 10.06.002 Front yards.

Front yard regulations are as follows:
(1) 
When 40 percent or greater of the frontage on one side of the street on a block (between two intersecting streets) is improved with buildings that have a front yard that is greater or less than the required front yard in the zoning district, no building shall project beyond the average front yard as established; provided, however, that a front yard setback shall not be required to exceed 50 percent of the front yard otherwise required in the zoning district in which the lot is located.
(2) 
On lots having double frontage, the required front yard shall be provided on both streets.
(3) 
Off-street parking facilities may be located within the required front yard of any commercial or industrial district, but shall not be nearer than 50 feet to any residential district, and no off-street parking shall be permitted in the required front yard of any residential district.
(4) 
Every part of a required front yard must be open and unobstructed of structures from ground level of the graded lot to the sky, except as follows:
(A) 
Bay windows projecting not more than three feet.
(B) 
Steps, four feet or less above grade, which are necessary for access to a permitted building or for access to a lot from a street or public way.
(C) 
Access ramps for the disabled.
(5) 
Landscaping, fountains, sculptures, lighting fixtures, flagpoles and mailboxes, which are situated and constructed in compliance with all other ordinances, may be located in any required front yard setback, provided they do not obstruct the view of traffic.

§ 10.06.003 Side yards, corner and interior.

Regulations for side yards, corner and interior, are as follows:
(1) 
On lots that are 50 feet or less in width, which are platted and filed at the time of the adoption of the ordinance from which this chapter is derived, the minimum corner side yard setback shall be ten feet. All future platted lots shall conform to the setback requirements of the zoning district in which they are located.
(2) 
No accessory building shall project beyond a required yard setback along any street.
(3) 
Where dwelling units are erected above commercial establishments, no side yard is required except when required for the commercial building on the side of a lot adjoining a residential district.
(4) 
For the purpose of side yard regulations, a two-family dwelling or multiple dwelling shall be considered as one building occupying one lot.
(5) 
Every part of a required side yard must be open and unobstructed of structures from ground level of the graded lot to the sky, except as follows:
(A) 
Central air conditioning units, heat pumps and solar collecting equipment, extending not more than ten feet from the principal structure.
(B) 
Balconies not projecting more than three feet.
(C) 
Off-street parking spaces and loading areas.
(6) 
Landscaping, fountains, sculptures, lighting fixtures, flagpoles and mailboxes, which are situated and constructed in compliance with all other ordinances, may be located in any required side yard setback, provided they do not obstruct the view of traffic.

§ 10.06.004 Rear yards.

Where a lot abuts upon an alley, one-half of the alley width may be considered as part of the required rear yard.
