08 ACCESSORY AND TEMPORARY USES

§ 10.08.001 Principal uses to include accessory uses.

(a) 
Principal uses authorized as permitted uses are deemed to include accessory uses. Accessory uses are subject to the same regulations as apply to principal uses in each district, except as otherwise specified in this chapter.
(b) 
An accessory use must not be established prior to the establishment of the principal use.

§ 10.08.002 Garages, carports, and sheds.

A detached garage, carport, or shed may be constructed on any residential lot as an accessory use if it meets the following requirements:
(1) 
It is not located within a required front yard, public right-of-way, or easement.
(2) 
It is not located within five feet of a rear lot line or six feet of a side lot line. If a reverse corner lot condition exists:
(A) 
A 15-foot setback from front lot line to the rear lot line shall be required; and
(B) 
It has a maximum height of 20 feet.
(3) 
It is not closer than ten feet to the main building.
(4) 
Accessory buildings must not occupy more than 30 percent of the required rear yard.

§ 10.08.003 Temporary uses.

Temporary buildings used in conjunction with construction work only may be permitted in any district during the period that the construction work is in progress, but such temporary buildings shall be removed upon completion of the construction work. In residential districts, a temporary construction office must cease upon the issuance of a certificate of occupancy for the last dwelling unit for the subdivision or project.

§ 10.08.004 Fences and walls.

Fences and walls may be constructed to a maximum height of eight feet in all districts as measured above the average grade level on the property line and subject to the following restrictions.
(1) 
Fences and walls in the required front and corner side yards may be constructed on the property line provided the construction shall not exceed four feet in height and shall be at least 50 percent open.
(2) 
Fences and walls in the required corner rear yard of a reverse corner lot may be constructed on the property line provided the construction shall not exceed four feet in height and shall be at least 50 percent open.
(3) 
Fences and walls exceeding four feet in height or less than 50 percent open in the front yard are required to be set back 25 feet from the front lot line.
(4) 
Fences and walls exceeding four feet in height and less than 50 percent open in the corner side yard are required to be set back 15 feet from the side lot line.
(5) 
Fences and walls exceeding four feet in height and less than 50 percent open in the corner rear yard are required to be 15 feet from the side lot line of a reverse corner lot.
