ARTICLE VII

CONSERVATION AND RESIDENCE DISTRICTS

22.81 - General requirements.

(a)

Permitted Uses. Permitted uses of land or buildings, as hereinafter listed, shall be permitted in the zoning districts indicated under the conditions specified. Unless otherwise specifically set forth, wherever a permitted use is named as a major category in this chapter, it shall be deemed to include all and only those itemized uses under the said permitted use category listed in the district. No building or tract of land shall be devoted to any use other than a use permitted hereinafter in the zoning district in which such building or tract of land shall be located, with the exception of the following:

(1)

Uses lawfully established on the effective date of the ordinance from which this Chapter is derived.

(2)

Conditional uses, allowed in accordance with the provisions of subsection (b).

Uses already established on the effective date of the ordinance from which this Chapter is derived and rendered nonconforming by the provisions thereof shall be subject to the regulations of Article V.

(b)

Conditional Uses. Conditional uses, as hereinafter listed, may be allowed in the zoning districts indicated, subject to the issuance of conditional use permits in accordance with the provisions of Section 22.26. Unless otherwise specifically set forth, wherever a conditional use is named as a major category in this chapter, it shall be deemed to include all and only those itemized uses listed under the said category in the district.

(c)

Lot Size Requirements. Lot size requirements shall be as specified under each zoning district in Division 2 of this Article. In addition, the following regulations shall be complied with:

(1)

No building shall be converted so as to conflict with, or further conflict with, the lot size requirements of the zoning district in which such building is located.

(2)

No use shall be established or hereafter maintained on a lot recorded after the effective date of the ordinance from which this Chapter is derived which is of less area or less frontage than prescribed hereinafter for such use in the zoning district in which it is to be located.

(d)

Yard Requirements and Open Space.

(1)

Yard requirements shall be as set forth under each zoning district. Front, side, and rear yards shall be provided in accordance with the regulations hereinafter indicated and shall be unobstructed from the ground level to the sky.

(2)

All accessory buildings which are attached to principal buildings (e.g., attached garages) shall comply with the yard requirements of the principal building.

(3)

With the exception of the Neighborhood Transition District, front yards shall be as specified in each zoning district, except as may be established by City Council and reflected on the zoning district map, provided where forty (40) percent or more of the frontage of the block is improved with structures that are set back more than the district requirements, no main or accessory building or other structure shall project beyond the average set back so established by such buildings; provided further that such set back so established need not be greater than thirty (30) percent of the depth of the lot. Open, unenclosed one-story front porches that do not exceed an encroachment into the established average front yard setback of more than six feet of that average setback shall be permitted provided, however, that the encroachment cannot exceed the required setback of the district in which it is located.

(4)

In single-family residential developments containing eight or more units, the yard requirements may be waived in order to encourage innovative design and to provide for such housing types as the atrium or patio house. Such waiver may be obtained only by conditional use permit, as provided within each residential district.

(5)

For each structure designed, used or occupied, containing at least twenty (20) residential dwelling units or eighteen thousand (18,000) square feet of gross floor area, whichever is less; there shall be provided a minimum of twenty (20) percent of the area of the zoning lot for unobstructed open space which may be located on the ground or on safe usable roofs, but shall not include required yard spaces, or space provided for off-street parking.

(e)

Building Bulk (Volume) Limitations.

(1)

Building bulk limitations shall be expressed in terms of minimum yard requirements and maximum building height, or in terms of floor area ratio.

(2)

Where prescribed, the floor area ratio requirements shall determine the maximum floor area allowable for the building or buildings (total floor area of both principal and accessory buildings) in direct ratio to the gross area of the zoning lot.

(f)

Signs. Signs shall be allowed in residence districts in accordance with the regulations contained in Article XI.

(g)

Fences. Fences shall be allowed in residence districts in accordance with the regulations contained in Article XII.

(h)

Off-Street Parking and Loading. Off-street parking and loading facilities, accessory to uses allowed in residence districts, shall be provided in accordance with the regulations established in Article X.

22.86 - CR—Conservation/recreation district.

The CR district is designed to preserve and protect large, open space uses and to encourage the development of land for "open space" recreational activities or conserve natural resources.

(a)

Permitted Uses. Land located in the CR district shall be used for the following purposes only:

(Numbers within parentheses ( ) indicate parking class of each permitted or conditional use. For specific parking requirements, see subsection 22.242(b).)

(1)

Botanical gardens and arboretums (17).

(2)

Buildings and/or facilities owned, operated or controlled by the City.

(3)

Cemeteries (30).

(4)

Forest preserves, wildlife reservations, and ecological sanctuaries (17).

(5)

Parks and playgrounds (17).

(6)

Public flood control projects (17).

(7)

Zoological gardens (16).

(8)

Accessory uses and buildings, incidental to and on the same zoning lot as a principal use.

(b)

Conditional Uses. Subject to the conditions prescribed in Section 22.26, the following conditional uses may be allowed:

(1)

Cultural facilities, including libraries, museums, and similar cultural facilities (07).

(2)

Elementary schools (13).

(3)

Junior high schools (13).

(4)

Senior high schools (21).

(5)

Colleges or universities (25).

(6)

Golf courses and driving ranges, tennis centers, pitch and putt, and similar (15).

(7)

Government administration buildings and facilities (08).

(8)

Miniature golf courses (28).

(9)

Nurseries, for the growing and sale of trees and shrubbery (14).

(10)

Religious Assembly (22).

(c)

Lot Size Requirements. No permitted or conditional use shall be allowed in this district which is not provided with at least two acres of lot area and two hundred (200) feet of lot frontage; except that there shall be no lot size requirements for publicly-owned property.

(d)

Setback from Property Lines. No building or structure in the CR district shall be located closer than fifty (50) feet from any property lines.

(e)

Height Limitations. No building or structure shall exceed the lesser of two and one-half stories, or thirty-five (35) feet in height.

22.87 - RE—Residential estates district.

The RE residential estates district is intended to preserve and protect those unique areas within the City, which are characterized by large lots with deep setbacks.

(a)

Permitted Uses. The following uses are permitted in the RE district:

(Numbers within parentheses ( ) indicate parking class of each permitted or conditional use. For specific parking requirements, see subsection 22.242(b).)

(1)

Single-family detached dwellings (01).

(2)

Accessory uses and buildings, incidental to and on the same zoning lot as a principal use, as follows:

(A)

Garages and carports.

(B)

Greenhouses and conservatories, private (non-commercial).

(C)

Home occupations.

(D)

Outdoor storage of building materials and equipment for dwelling construction purposes for a period not to exceed the duration of such construction; but, in no event to exceed twelve (12) months, unless such time period is extended by mutual consent of applicant and Zoning Administrator.

(E)

Swimming pools, private.

(F)

Tool houses, sheds, and other similar buildings for the storage of domestic supplies.

(b)

Conditional Uses. The following conditional uses may be allowed in the RE district, subject to the provisions of Section 22.26:

(1)

Assisted living establishments with a maximum of eight occupants per residence (30).

(2)

Congregate housing for the elderly/senior home-sharing facility, with a maximum of eight occupants per facility (05).

(3)

Cultural institutions, including public libraries, museums and art galleries.

(4)

Educational institutions as follows:

(A)

Elementary schools (13).

(B)

Junior high schools (13).

(C)

Senior high schools (21).

(D)

College or university (25).

(5)

Group home/community residence, with a maximum of eight occupants per residence (05).

(6)

Hospitals (09).

(7)

Planned developments, in accordance with subsection 22.26(k) (30).

(8)

Public utility and service uses, and civic buildings, as follows:

(A)

Fire stations (08).

(B)

Police stations (08).

(C)

Telephone exchange, telephone transmission equipment buildings, and microwave relay towers (30).

(D)

Waterworks, reservoir, pumping station, and filtration plant (30).

(E)

Other municipal buildings (30).

(9)

Recreational and social facilities, as follows:

(A)

Grounds of recreational clubs, non-commercial (17).

(B)

Parks and playgrounds (17).

(C)

Recreational buildings and community centers, non-commercial (08).

(D)

Swimming pools, non-commercial (17).

(E)

Tennis clubs and courts, non-commercial (17).

(10)

Religious institutions, as follows:

Waiver of yard requirements, in accordance with subsection 22.81(d).

(13)

Accessory uses and buildings incidental to and on the same zoning lot as a principal use, as follows:

(A)

Adult day center, within a public or institutional building.

(B)

Athletic fields and playgrounds.

(C)

Child day care center, pre-school, within a public or institutional building.

(D)

Seasonal or temporary uses, accessory to a public or institutional facility, and consistent with all pertinent requirements of this Code.

(E)

Secondary religious facilities servicing a principal religious institution.

(F)

Stadiums and grandstands in athletic fields (public).

(G)

Outdoor storage of building materials and equipment, and temporary buildings for construction purposes for a period not to exceed the duration of such construction; but, in no event to exceed twelve (12) months, unless such time period is extended by mutual consent of applicant and Zoning Administrator.

(c)

Lot Size Requirements.

(3)

Accessory Uses. Each accessory use may be established on the same lot as a principal use, provided that such lot meets the lot size requirements of the RE district as provided in paragraphs a. and b. above.

(d)

Maximum Lot Coverage. No building, together with its accessory structures, shall occupy in excess of twenty-five (25) percent of the area of the lot upon which it is constructed.

(e)

Yard Requirements.

(f)

Building Height Limitations. No buildings or other structure erected within the RE district shall exceed the lesser of two and one-half stories or thirty-five (35) feet in height.

22.88 - R1—Single-family residence district.

The R1 single-family residence district is intended to provide for relatively large-lot single-family areas and protect such areas from the encroachment of incompatible uses.

(a)

Permitted Uses. The following uses are permitted in the R1 district:

(Numbers within parentheses ( ) indicate parking class of each permitted or conditional use. For specific parking requirements, see subsection 22.242(b).)

(1)

Single-family detached dwellings (01).

(2)

Accessory uses and buildings, incidental to and on the same zoning lot as a principal use, as follows:

(A)

Garages and carports.

(B)

Greenhouses and conservatories, private (non-commercial).

(C)

Home occupations.

(D)

Outdoor storage of building materials and equipment for dwelling construction purposes for a period not to exceed the duration of such construction; but, in no event to exceed twelve (12) months, unless such time period is extended by mutual consent of applicant and Zoning Administrator.

(E)

Swimming pools, private.

(F)

Tool houses, sheds, and other similar buildings for the storage of domestic supplies.

(b)

Conditional Uses. The following conditional uses may be allowed in the R1 district, subject to the provisions of Section 22.26:

Assisted living establishments with a maximum of eight occupants per residence (30).

Congregate housing for the elderly/senior home-sharing facility, with a maximum of eight occupants per facility (05).

(3)

Cultural institutions, including public libraries, museums and art galleries (07).

(3)

Accessory Uses. Each accessory use may be established on the same lot as a principal use, provided that such lot meets the lot size requirements of the R1 district as provided in paragraphs a. and b. above.

(d)

Maximum Lot Coverage. No building, together with its accessory structures, shall occupy in excess of thirty (30) percent of the area of the lot upon which it is constructed.

(e)

Yard Requirements.

* However, on any lot which is not served by an alley and on which the main building does not have an attached garage there shall be provided a side yard on one side of the lot of not less than nine feet in width to allow for a driveway or parking space. Platted lots, of record as of the effective date of the ordinance from which this Chapter is derived, which have equal to or less than sixty (60) foot frontages, shall have a minimum five-foot side yard notwithstanding any other provisions of this Chapter to the contrary.

22.89 - R1A—Single-family residence district.

(3)

(e)

* However, on any lot which is not served by an alley and on which the main building does not have an attached garage there shall be provided a side yard on one side of the lot of not less than nine feet in width to allow for a driveway or parking space. Platted lots of record as of the effective date of the ordinance from which this Chapter is derived, which have equal to or less than sixty (60) foot frontages, shall have a minimum five-foot side yard notwithstanding any other provisions of this Chapter to the contrary.

22.90 - R2—Single-family residence district.

The R2 single-family residence district is primarily designed to accommodate existing single-family neighborhoods in the City, which are characterized by smaller recorded lots than required in the RE and R1 district.

(a)

Permitted Uses. The following uses are permitted in the R2 district:

22.93 - R5—Specialty residence district.

The R5 specialty residence district is intended to provide locations for single family and low to medium density multi-family dwellings while allowing limited opportunity for single family structures to have office and bed and breakfast uses, conditionally approved by City Council. The intent of this district is to provide sufficient flexibility to encourage creative solutions in the re-use of the older single family structures while encouraging compatible new construction within this district.

(a)

Permitted Uses. The following uses are permitted in the R5 district:

Lot Size Requirements. No permitted or conditional use shall be located on a lot containing less than nine thousand (9,000) square feet of area, and the minimum lot frontage shall be sixty (60) feet. No building, together with its accessory structure, shall occupy in excess of forty (40) percent of the area of the lot upon which it is constructed.

(e)

Floor Area Ratio/Building Height. In the R5 district, floor area ratio shall not exceed 0.8.

No building or structure hereafter erected or structurally altered shall exceed three stories nor thirty-five (35) feet in height.

(f)

Architectural Review Required. All construction, whether for permitted or conditional uses, including, but not limited to new construction, remodeling, renovation, repair and site improvements, shall be subject to review and approval by the Architectural Review Commission to assure architectural compatibility with existing structures and uses within the district.

(g)

Parking Requirements. For purposes of this chapter, the permitted uses listed herein subsection (a) shall comply with the off-street parking requirements set forth in Article X. However, the parking requirements for the conditional uses listed herein subsection (b) shall be as specified by the Zoning and Planning Commission.

(h)

Signage. Identification signs for the conditionally allowed uses listed herein will be subject to the provisions of Section 22.26. Such signs shall not exceed five feet above grade or six square feet in area. Such signs shall only be illuminated by an external light source.

22.94 - Neighborhood transition district.

The NT District is intended to provide moderate residential density and act as a buffer between single-family residential neighborhoods and the intensity of the CBC and CBOC Districts.

(a)

Permitted Uses. The following uses are permitted in the NT District:

(Numbers within parentheses () indicate parking class of each permitted or conditional use. For specific parking requirements, see subsection 22.242(b).)

Single-family attached dwellings (1).

Single-family detached dwellings (1).

Accessory uses and buildings, incidental to and on the same zoning lot as the principal use.

(b)

Maximum Lot Coverage. No building, together with its accessory structure, shall occupy in excess of fifty (50) percent of the area of the lot upon which it is constructed, except for single-family detached which shall be limited to thirty (30) percent.

(c)

Yard Requirements.

(d)

Parking Requirements. For purposes of this chapter, the permitted uses listed herein shall comply with the off-street parking requirements set forth in Article X.

(e)

Minimum lot frontage. For each lot within this District, the minimum lot frontage shall be fifty (50) feet;

(f)

Minimum lot area. For each lot within this District, the minimum lot area shall be seven thousand two hundred sixty (7,260) square feet.

22.95 - Central business outer core residential district.

(a)

The CBOCR District shall be limited to the "outer downtown" core area of the City as identified on the City Zoning Map. It is intended to accommodate multiple family residential and townhomes.

(b)

Permitted Uses. The following uses are permitted in the CBOCR District:

Parking requirements for residential dwelling units located within the CBOCR District are listed in Article X Off Street Parking and Loading. However, single-family attached shall have two parking spaces per dwelling unit.

Dwelling units.

Accessory uses, incidental to and on the same zoning lot as the principal use.

(c)

Conditional Uses. The following conditional uses are allowed in the CBOCR District, subject to the provisions of Section 22.26:

(1)

Professional office on the first floor of a residential building;

(2)

Municipal parking garages, structures and surface lots for private passenger automobiles.

(3)

Religious assembly.

(d)

(e)

Floor Area Ratio/Building Height. In the CBOCR District, floor area ratio shall not exceed 4.0; however, maximum building height may exceed four stories or forty-eight (48) feet when not within one hundred (100) feet of the subject property line which is adjacent to, or across a right-of-way from single-family detached and/or single family attached uses; If a property is not adjacent to single-family detached and/or single family attached uses, floor area ratio shall not exceed 6.0 and in no event shall building height be greater than six stories or seventy-two (72) feet.

(f)

Minimum Unit Size. Studio apartments may be no less than five hundred (500) square feet, one bedroom apartments may be no less than seven hundred (700) square feet, two bedroom apartments may be no less than one thousand (1,000) square feet and three bedroom apartments may be no less than one thousand two hundred (1,200) square feet.
