ZONING DISTRICTS

22.71 - Districts.

For the purposes of this Chapter, the City is hereby divided into the following zoning districts:

Conservation and Residence Districts
CR Conservation/recreation
RE Residential estate
R1 Single-family residence
R1A Single-family residential
R2 Single-family residence
R3 Two-family residence
R4 Limited general residence
NT Neighborhood Transition
CBOCR Central business outer core residential
R5 Specialty Residence District

 

Office and Commercial Districts
CI Civic Institutional
O1 Office
C1 Local shopping
C2 Community shopping and service
C3 General commercial
CBC Central business core
CBOC Central business outer core

22.72 - Interpretation of district sequence.

This Chapter rejects the outdated and inappropriate concept of hierarchical and cumulative zoning districts and is based on the idea that each district is created to accomplish a specific purpose, and to encourage a particular type of development and to protect that development from being encroached upon by incompatible types of development.

22.73 - Maps.

(a)

The location and boundaries of the districts established by this Chapter are set forth on the zoning map entitled City of Elmhurst Zoning District Map, dated December 7, 1992, which is incorporated herein, and hereby made a part of this Chapter. Said map, together with everything shown thereon and all subsequent amendments thereto, shall be as much a part of this Chapter as though fully set forth and described herein.

(b)

The following rules shall apply with respect to the boundaries of the various districts as shown on the zoning district map:

(1)

District boundary lines are the center lines of highways, streets, alleys, and easements; right-of-way lines of railroads, toll roads, and expressways; or section, division of section, tract and lot lines; or such lines extended, unless otherwise indicated.

(2)

In areas not subdivided into lots and blocks, wherever a district is indicated as a strip adjacent to and paralleling a street or highway, the depth of such strips shall be in accordance with dimensions shown on the maps measured at right angles from the center line of the street or highway, and the length of frontage shall be in accordance with dimensions shown on the map from section, quarter section, or division lines, or center lines of streets and highways, or railroad right-of-ways, unless otherwise indicated.

(3)

Where a district boundary line divides a lot in single ownership on the effective date of the ordinance from which this Chapter is derived, the Zoning Board of Appeals, after appropriate public hearing, may extend the regulations for either portion of such lot. No fee shall be assessed for such interpretation.

(c)

The current zoning district map shall be available in the Municipal Building.

22.74 - Essential services exempted.

The erection, construction, alteration, or maintenance by public utilities or municipal departments or commissions, of overhead, surface or underground gas, electrical, steam, or water, distribution or transmission systems, collection, communication, supply or disposal systems, including mains, drains, sewers, pipes, conduits, tunnels, wires, cables, fire alarm boxes, police call boxes, traffic signals, hydrants, towers, poles, electrical substations, cable television transmission lines (but not including appurtenances), gas regulator stations and other similar equipment and accessories in connection therewith, reasonably necessary for the furnishing of adequate service by such public utility or municipal department or commission or for the public health, safety, or general welfare, shall be exempt from the regulations of this Chapter, provided, however, that the installation shall conform to Federal Communications Commission and Federal Aviation Agency rules and regulations, and those of other authorities having jurisdiction.

22.75 - Zoning of annexed land.

On land hereafter annexed to, or consolidated with, the City, no building or structure shall be erected, enlarged or moved and no change in the use of land or existing buildings or structures shall be made until an ordinance designating the zoning district classification of such annexed land is duly adopted by the City Council. Within thirty (30) days of the annexation, the City Council shall file an application for an amendment to establish the zoning district classification of such land. Action shall be taken by the City Council regarding the classification of annexed land within ninety (90) days of its receipt of the amendment application from the Zoning and Planning Commission. Failure of the City Council to take action regarding the classification of annexed land within the prescribed time period shall result in such land being automatically classified as R1 single family residence district, provided however, that those parcels of land located on the south side of Harrison Street as herein identified, shall, in the absence of action by the City Council otherwise, be automatically classified as R1A single family residence district, provided any parcel of such land annexed has a minimum lot frontage of fifty-six (56) feet and a minimum lot area of ten thousand (10,000) square feet:
