CHAPTER 1156

B-N Business-Neighborhood District

1156.01 PURPOSE.

   It is the purpose of the B-N Business-Neighborhood District to permit and encourage the establishment of small convenience businesses and personal service businesses to locate in close proximity to the residential areas which they are serving. The location of the Business-Neighborhood District and the nature of the limited commercial activity should be developed to avoid traffic congestion for the surrounding residential neighborhood areas.

1156.02 PRINCIPALLY PERMITTED USES.

   Principally permitted uses are as follows:
   A.   Child Care Facilities.
   B.   Clubs.
   C.   Educational Institutions.
   D.   Financial Institutions.
   E.   Neighborhood Retail Business.
   F.   Non-Commercial Recreation.
   G.   Offices.
   H.   Personal Services.
   I.   Religious Places of Worship.
   J.   Restaurants, provided seating capacity is limited to not more than twenty people.
   K.   Any other use determined by the Building Inspector to be of the same general character as the above permitted uses.

1156.03 PERMITTED ACCESSORY USES.

   Permitted accessory uses are as follows:
   A.   Any use customary and incidental to the permitted uses.
   B.   Signs as regulated in Chapters 1173 and 1174.
   Accessory uses, other than signs and fences, shall be located in the rear yard only and located not closer than six (6) feet from any lot line and covering not more than thirty-five percent (35%) of the required rear yard.

1156.04 CONDITIONALLY PERMITTED USES.

   Conditionally permitted uses are as follows:
   A.   Drive-In Facilities.
   B.   Public Parking Area.
   C.    Restaurants with a seating capacity greater than twenty people.
   D.   Residential Dwellings, Except Detached Dwellings of Three Households or Less.

1156.05 MINIMUM LOT AREA AND WIDTH.

   There shall be no minimum lot area or width for properties in the B-N Business-Neighborhood District.

1156.06 MINIMUM FRONT YARD SETBACK.

   There shall be no minimum front yard setback for properties in the B-N Business-Neighborhood District unless the property is within the same block front as any residential district, in which case the minimum front yard setback shall be not less than twenty (20) feet.

1156.07 MINIMUM SIDE YARD SETBACK.

   There shall be no minimum side yard setback in the B-N Business-Neighborhood District except when property abuts any residential district, in which case the minimum side yard setback shall be not less than ten (10) feet.

1156.08 MINIMUM REAR YARD SETBACK.

   The minimum rear yard setback in the B-N Business-Neighborhood District shall not be less than twenty (20) feet.

1156.09 MAXIMUM HEIGHT REGULATIONS.

   The maximum height regulations for properties in a B-N Business-Neighborhood District shall be as follows:
   A.   No principal building shall exceed twenty-five (25) feet in height.
   B.   No principal building used for a public purpose shall exceed seventy-five (75) feet in height.
   C.   No accessory building shall exceed fifteen (15) feet in height.

1156.10 OFF-STREET PARKING AND LOADING.

   Off-street parking and loading shall be as specified in Chapter 1175.

1156.11 SCREENING OF NONRESIDENTIAL DISTRICTS.

   When a lot in a B-N Business-Neighborhood District abuts a residential district, landscaping and/or fencing a minimum of six (6) feet in height shall be provided within the side or rear yard abutting such district to visually screen the nonresidential land use from the residential use.

1156.12 LAND USE INTENSITY.

   There is no maximum lot coverage requirements for buildings in the B-N Business-Neighborhood District.

1156.13 REQUIRED CONDITIONS.

   A.   All business, service or processing shall be conducted wholly within a completely enclosed building, except for off-street automobile parking and off-street loading.
   B.   Goods sold shall consist primarily of new merchandise sold at retail on the premises; and not more than two persons shall be engaged in the fabrication, repair and other processing of goods in any establishment.
   C.   Processes and equipment employed and goods processed or sold shall be limited to those which are not objectionable by reason of odor, dust, smoke, cinders, gas, fumes, noise, vibration, refuse matter or water-carried waste or danger from explosion or fire.
