CHAPTER 1158

B-D Business-Downtown District

1158.01 PURPOSES.

   It is the purpose of the B-D Business-Downtown District to encourage the functional grouping of those commercial, residential and accessory establishments that encourage pedestrian movement and the preservation of the historic character of Downtown Elyria.

1158.02 PRINCIPALLY PERMITTED USES.

   Principally permitted uses are as follows:
   A.   Allied Health Facilities.
   B.   Child Care Facilities.
   C.   Clubs.
   D.   Commercial Recreation.
   E.   Commercial Schools.
   F.   Convenience Businesses.
   G.   Dental and Medical Clinics.
   H.   Educational Institutions.
   I.   Fast Food Restaurants.
   J.   Financial Institutions.
   K.   Government Buildings.
   L.   Health Unit Office.
   M.   Hotels/Motels.
   N.   Neighborhood Retail Businesses.
   O.   Non-Commercial Recreation.
   P.   Off-Premises Signs.
   Q.   Offices.
   R.   Personal Services.
   S.   Public Parking Area.
   T.   Religious Places of Worship.
   U.   Residential, Except Detached Dwellings of Three (3) Households or Less.
   V.   Restaurants.
   W.   Retail Businesses.
   X.    Taverns.
   Y.   Warehousing.
   Z.    Wholesale Businesses.
   AA.   Farmer's Market.
   BB.   Any other use determined by the Building Inspector to be of the same general character as the above permitted uses.

1158.03 PERMITTED ACCESSORY USES.

   Permitted accessory uses are as follows:
   A.   Any use customary and incidental to the permitted use.
   B.   Signs as regulated in Chapters 1173 and 1174.
   Accessory uses, other than signs and fences, shall be located only in the rear yard and located not closer than six (6) feet from any lot line and covering not more than thirty-five percent (35%) of the required rear yard.

1158.04 CONDITIONALLY PERMITTED USES.

   Conditionally permitted uses are as follows:
   A.   Automotive Filling Stations.
   B.   Automotive Repair.
   C.   Automotive Sales.
   D.    Building Materials and Related Trades.
   E.   Cellular Communication Sites.
   F.   Hospitals.
   G.   Nursing Homes.
   H.    Research and Development Laboratories.

1158.05 MINIMUM LOT AREA AND WIDTH.

   There shall be no minimum lot area or width for properties in the B-D Business-Downtown District.

1158.06 MINIMUM FRONT YARD SETBACK.

   There shall be no minimum front yard setback for properties in the B-D Business-Downtown District unless the property is within the same block front as any residential district, in which case the minimum front yard setback shall be twenty (20) feet.

1158.07 MINIMUM SIDE YARD SETBACK.

   There shall be no minimum side yard setback for properties in the B-D Business-Downtown District except when the property abuts any residential district, in which case the minimum side yard setback shall be ten (10) feet.

1158.08 MINIMUM REAR YARD SETBACK.

   The minimum rear yard setback for properties in the B-D Business-Downtown District shall be twenty (20) feet plus three (3) additional feet for each story over three (3).

1158.09 MAXIMUM HEIGHT REGULATIONS.

   The maximum height regulations for properties in a B-D Business-Downtown District shall be as follows:
   A.   No principal building shall exceed seventy-five (75) feet in height.
   B.    No accessory building shall exceed fifteen (15) feet in height.

1158.10 OFF-STREET PARKING AND LOADING.

   Off-street parking and loading shall be required as specified in Chapter 1175.

1158.11 SCREENING OF NONRESIDENTIAL DISTRICTS.

   When a lot in a B-D Business-Downtown District abuts a nonresidential district, landscaping and/or fencing, a minimum of six (6) feet in height, shall be provided within the side or rear yard abutting such district to visually screen the nonresidential land use from the residential use.

1158.12 LAND USE INTENSITY.

   There shall be no maximum lot coverage for buildings in the B-D Business-Downtown District.

1158.13 REQUIRED CONDITIONS.

   A.   All business, service or processing shall be conducted wholly within a completely enclosed building, except for the following uses:
      1.   Billboards and signboards;
      2.   Automobile display or sales, off-street parking and off-street loading;
      3.   Farmer's market; and
      4.   Outdoor dining on City sidewalks as regulated in Section 521.04 of the Codified Ordinances of the City.
   B.   Processing and equipment employed and goods processed or sold shall be limited to those which are not objectionable by reason of odor, dust, smoke cinders, gas, fumes, noise, vibration, refuse matter or water-carried waste or danger from explosion or fire.

( EDITOR'S NOTE: City Council declared a moratorium on the provisions of division A. that all business, service or processing in the B-D Business Downtown District, be conducted wholly within a completely enclosed building for any restaurant or food service operation in said District commencing with the approval of Ordinance 2008-71, passed May 19, 2008, and terminating on November 1, 2008.)
