CHAPTER 4

ZONING DISTRICTS AND MAP

8-4-1: ZONING DISTRICTS ESTABLISHED:

In order to carry out the provisions of this title, the city is hereby divided into the following zoning districts:
   Residential districts: R1, R2, R3.
   Commercial district: C.
   Industrial districts: LI and HI.
   Overlay districts: CB, OS, and Ag.

8-4-2: BOUNDARIES; MAP:

   A.   Boundaries Shown On Map; The boundaries of the zoning districts listed in section 8-4-1 of this chapter are established as shown on a map entitled zoning district map of the city of Fairfield, Idaho, updated 2011, which map is hereby made a part of this title. (Ord. 254, 1-15-2015)
   B.   Boundary Lines: Unless otherwise defined on the zoning district map, district boundary lines are lot lines; the centerline of streets, alleys, railroad rights of way, or such lines extended; section lines; municipal corporate lines; or other lines drawn to scale on the zoning district map.
   C.   Less Restrictive Requirements: Where a lot is divided at the time of the effective date hereof, or by subsequent amendments, by zoning district boundary lines, the less restrictive zoning requirements may be extended not more than twenty five feet (25') into the more restrictive zoning district adjacent to the zoning district boundary line. 8-4-3: GENERAL ZONING DISTRICT REGULATIONS:

Within each of the zones, the size of buildings and structures, the density of population and the location and use of buildings, structures and land for trade, industry, residence or other purposes are hereby regulated and restricted as set forth in this title or as may be amended. However, nothing hereto shall be in nonconformity with the agricultural exemption as contained in Idaho Code section 39-4116(5). (Ord. 254, 1-15-2015)

8-4-4: CONFORMITY REQUIRED:

Except as otherwise provided herein, land, buildings and premises in any district shall hereafter be used only in accordance with the regulations herein established for that district, and the following general provisions:
   A.   Buildings: All buildings shall hereafter be erected, constructed, relocated or structurally altered to have:
      1.   Lot Occupancy: No building (including its accessory buildings) in any residential district shall occupy more than sixty percent (60%) of lot. All other districts determined by setbacks.
      2.   Building Height: No building in any district shall exceed thirty five feet (35') in height from established grade point.
      3.   Foundations: All buildings over eight hundred (800) square feet, or intended for regular access by the public, must be affixed to a permanent foundation.
      4.   Off Street Parking: All buildings shall provide for a minimum of two (2) off street parking spaces per dwelling unit, or as provided by chapter 8 of this title.
   B.   Lots:
      1.   Access: All lots shall have vehicular access on a dedicated improved public street with a sixty foot (60') minimum right of way unless a secondary means of permanent vehicular access has been approved on a subdivision plat.
      2.   Size: No lot held under one ownership at the effective date hereof shall be smaller than required by this title, and if already less, the dimension of area of such lot shall not be further reduced.
      3.   Density: The number of dwelling units per acre of land when the acreage involved is computed excluding street rights of way.
   C.   Walls, Fences And Hedges:
      1.   Fences, walls, and hedges are permitted along the edge of any yard to a height of six feet (6'): provided, that no fence, wall or hedge along the sides or front edge of any front yard shall be over three feet (3') in height. On a corner lot, nothing shall be erected, placed, planted, or allowed to grow in any such manner as to materially impede vision between a height of three feet (3') and ten feet (10') above the centerline grades of intersecting streets bounded by the property lines of corner lots on a line joining points along said property lines for thirty feet (30'). In any zone where a front yard requirement does not exist, no fence, wall or hedge shall be allowed along the front edge or for a distance of twenty feet (20') back from the front edge at any height greater than three feet (3'), without prior approval of the planning and zoning commission.
      2.   Barbed wire and electric fences shall not be erected or maintained within the city unless approved by the planning and zoning commission.
      3.   Fences, walls and hedges shall be maintained in a good state of repair. (Ord. 223, 7-13-2006; amd. Ord. 285, 6-17-2021)
