CHAPTER 8

OFF STREET PARKING, DRIVEWAYS AND LOADING

8-8-1: PARKING PROVISIONS, DRIVEWAYS AND LOADING AREAS:

   A.   Parking And Loading Spaces Required: No building or structure shall be erected, nor any residential use changed to commercial or industrial use, unless maintained off street parking and loading spaces have been provided in accordance with the provisions of this chapter. Even where the new use involves no additions or enlargements, there shall be provided as many such spaces as may be required by this chapter.
   B.   Building Alterations: No building or structure shall be substantially altered, added to or enlarged, or its use changed permanently unless there is provided as many such spaces as may be required by this title with respect to the square footage as to which alteration, addition, enlargement, or change of use has occurred.
   C.   Parking On Certain Areas Prohibited: Parking and/or storage of otherwise legal and licensed vehicles of any kind, except upon properly surfaced and approved driveways or parking aprons, is prohibited. Parking of such vehicles on lawns, patios, garden area, or naturally wooded terrain is expressly forbidden at any time, except in an emergency such as fire, flood, earthquake, etc., or to facilitate approved construction work.
   D.   Location Of Parking Spaces: The following regulations shall govern the location of off street parking spaces and areas:
      1.   Parking spaces for all detached residential uses shall be located on the same lot as the use which they are intended to serve.
      2.   Parking spaces for commercial, industrial or institutional uses shall be located not more than three hundred feet (300') from the principal use and shall be located behind or beside the use.
      3.   Parking spaces for apartments, condominiums or similar residential uses shall be located not more than two hundred feet (200') from the principal use on the same developed property.
      4.   In all zones, if a new single-family residential structure is built without a garage, space shall be provided for the lawful addition of future covered parking.
      5.   No parking lot pavement edge for a commercial or industrial use may be located closer than five feet (5') from the right of way of a public street.
   E.   Maintenance: The owner of property used for parking and/or loading shall maintain such area in good condition without holes and free of all dust, trash and other debris. (Ord. 223, 7-13-2006)
   F.   Disabled Vehicles: The parking of a disabled vehicle within a residential or commercial zone for a period of more than thirty (30) days shall be prohibited, unless such vehicle is stored in an enclosed garage or other accessory building. (Ord. 254, 1-15-2015)
   G.   Parking Space Requirements Not Listed: Parking spaces for other permitted or conditional uses not listed in this chapter shall be determined by the planning and zoning commission. (Ord. 223, 7-13-2006)
   H.   Fractional Numbers: Fractional numbers shall be increased to the whole number.
   I.   Agreement For Reduction In Requirement: Where there is an adequate public transit system, or where, for any other reason, parking demand is unusually low, such as where uses with differing operating hours or needs share parking under a formal, written agreement to which the city is a party, then the parking space provisions cited herein may be reduced proportionately by the planning and zoning commission. If the owner whose parking facility is under such an agreement which requires the facility to be available to the patrons of the other use(s), fails or refuses to make such parking available in accordance with the agreement, such failure or refusal is a violation of this title.
   J.   Special Conditions: Where special conditions exist which make compliance with these standards impractical, the planning and zoning commission will consider alternative proposals presented according to the procedures and standards for a variance.
   K.   Loading Spaces: Required off street loading space is not to be included as off street parking space in computation of required off street parking spaces. All off street loading spaces shall be located outside of any right of way or a street or alley.
   L.   Snow Removal And Storage: Where snow removal and storage may pose a problem to traffic circulation or reduce the amount of adequate parking for winter business, the developer or owner of the property shall designate a snow storage area and remove snow as necessary to maintain minimum traffic circulation and parking.
   M.   Adjustments: Adjustments to required parking may be authorized by the planning and zoning commission based upon evidence of actual parking demand for the proposed use.
   N.   Multiple Uses; Shared Parking: Required parking facilities for two (2) or more uses, structures, or parcels of land may be satisfied by the same parking facilities used jointly, to the extent that the owners or operators show that the need for parking facilities does not materially overlap (e.g., uses primarily of a daytime versus nighttime nature; weekday uses versus weekend uses); and provided, that the right of joint use is evidenced by a recorded deed, lease, contract, or similar written instrument establishing the joint use. The city may review and approve owner requests for shared parking.
   O.   Authority To Reduce Required Parking: If more than one type of land use occupies a single structure or parcel of land, the total requirements for off street automobile parking shall be the sum of the requirements for all uses, unless it can be shown that the peak parking demands are actually less (i.e., the uses operate on different days or at different times of the day). The city may reduce the total parking required accordingly. (Ord. 223, 7-13-2006; amd. Ord. 254, 1-15-2015)

8-8-2: PARKING AREA DEVELOPMENT STANDARDS:

   A.   Surfacing:
      1.   Parking and loading spaces for commercial and industrial uses shall have an improved surface including asphalt, concrete, paving stones or bricks.
      2.   Parking and loading spaces for residential uses may use other materials (such as gravel) that provide a stable driving surface under all weather and moisture conditions and during ordinary use by wheeled vehicles which prevents the raising of road dust or other like particulate matter into the air.
   B.   Drainage: All parking and loading areas shall provide for proper drainage of surface water so as to prevent the drainage of such water onto adjacent properties or walkways. (Ord. 223, 7-13-2006)
   C.   Lighting: Any parking area which is intended to be used during nondaylight hours shall be properly illuminated to avoid accidents. Any lights used to illuminate a parking lot shall follow regulations outlined in chapter 10, "Outdoor Lighting", of this title. (Ord. 256, 2-12-2015)
   D.   Access: Any parking area (except approved residential driveways) shall be designed in such a manner that any vehicle leaving or entering the parking area from or onto a public or private street shall be traveling in a forward motion. Access driveways for parking areas or loading spaces shall be located in such a way that any vehicle entering or leaving such area shall be clearly visible by a pedestrian or motorist approaching the access or driveway from a public or private street.
   E.   Screening And/Or Landscaping:
      1.   Parking areas shall be effectively screened on all sides which adjoin or face any property used for residential purposes by an acceptably designed wall, fence or planting screen. Use of chainlink fencing in or adjacent to residential areas is discouraged; if proposed, approval by the administrator is required.
      2.   Such fence or wall shall be not less than four feet (4') nor more than six feet (6') in height and shall be maintained in good condition. Planting screens shall not be less than four feet (4') in height and shall be maintained in good condition.
      3.   The space between such fence, wall or planting screen and the lot line of the adjoining premises in any residential zone shall be landscaped with appropriate natural vegetation, including grasses, hardy shrubs, or evergreen ground cover, and maintained in good condition.
      4.   In the event that terrain or other natural features are such that the erection of such fence, wall or planting screen will not serve the intended purpose, then, with the prior concurrence of the planning and zoning administrator in writing, no such fence, wall or planting screen and landscaping shall be required.    Note:
      1.    Width is measured parallel to the sidewalk or paved street surface.
   B.   Relationship Of Standard And Compact Parking Spaces: Up to thirty five percent (35%) of any parking lot may be designated for compact car spaces. Such spaces shall be permitted only on hard surfaced lots where the space is marked both on the pavement and by a sign.
   C.   Parking Space Requirements: For the purpose of this title, the parking space requirements presented in table B of this section shall apply; see also R1 and R2 property development standards and R3 and R4 property development standards, for general parking area requirements for residential properties.

8-8-4: DRIVEWAYS:

   A.   Minimum Width: The minimum driveway width in the commercial, central business, light industrial and heavy industrial districts shall be twenty feet (20') for two-way traffic and fourteen feet (14') if there is one-way traffic. (Ord. 223, 7-13-2006)
   B.   Drive-Up And Drive-Through Uses: Drive-up and drive-through uses and their queuing areas shall be oriented away from street rights of way and away from residential districts. There shall be no such uses in the residential zones (except those which already exist). All such uses otherwise require review from the planning and zoning commission and approval by the city council. (Ord. 254, 1-15-2015)

8-8-5: COMMERCIAL ZONE SPECIAL DEVELOPMENT STANDARDS:

   A.   Drive-Up Facilities Design Standards: The following standards shall apply to all drive-up, drive-through and drive-in facilities in any zone:
      1.   The facility shall receive access from a driveway or alley and not a street.
      2.   None of the drive-up, drive-in or drive-through facilities (e.g., driveway queuing areas, windows, teller machines, service windows, drop boxes and similar facilities) are located within twenty feet (20') of a street and shall not be oriented to a street corner.
      3.   The facility shall be subordinate to a primary permitted use. "Subordinate" means all components of the facility, in total, occupy less street frontage than the primary commercial use.
      4.   No more than one drive-up, drive-in or drive-through facility shall be permitted on one block, or for a distance of four hundred (400) linear feet along the same street frontage, whichever is less. (Ord. 223, 7-13-2006)

8-8-6: LOADING AREAS:

   A.   Loading Space Requirements And Dimensions: Off street loading spaces for commercial uses shall be provided in accordance with the following table:

   B.   Size And Location Of Loading Spaces:
      1.   Size Of Off Street Loading Spaces: The size of off street loading spaces shall not be less than the following, exclusive of access platform and loading area:

      2.   Convenient Access: Convenient access to loading spaces from streets or alleys shall be provided, and be not less than twelve feet (12') in width.
      3.   Location Of Required Loading Facilities: The off street loading facilities required for the uses mentioned shall not project into the public right of way or setback area. In no case shall required off street loading berths be part of the area used to satisfy the off street parking requirements.
      4.   Entrances And Exits: Design and location of entrances and exits for required off street loading areas shall be subject to review of the planning and zoning commission.
   C.   Computation And Location: Required off street loading space is not to be included as off street parking space in computation of required off street parking space. All off street loading spaces shall be located outside of any right of way of a street or alley. (Ord. 223, 7-13-2006)
