A. Protective Fence Or Barrier Required: All swimming pools, hot tubs/spas, wading pools, or other artificial water features deeper than eighteen inches (18") shall be surrounded by a protective fence or barrier. This includes permanent in-ground, above-ground and on-ground swimming pools, hot tubs and spas. Temporary or portable swimming or wading pools are not subject to the requirements of this chapter.
B. Fence Or Barrier Requirements: The design of fences and barriers are intended to protect against potential drownings and near-drownings by restricting access to swimming pools, spas and hot tubs, and other artificial water features. All outdoor swimming pools, including in-ground, above-ground and on-ground pools, hot tubs, spas, or other artificial water features more than eighteen inches (18") deep shall be surrounded by a fence or barrier which shall comply with the following:
1. The top of the fence or barrier shall be at least six feet (6') above grade measured on the side of the fence or barrier which faces away from the swimming pool. The maximum vertical clearance between grade and the bottom of the barrier shall be two inches (2"), measured on the side of the barrier which faces away from the swimming pool. Where the top of the pool structure is above grade, such as an above-ground pool, the barrier may be at ground level or mounted on top of the pool structure. Where the barrier or fence is mounted on top of the pool structure, the maximum vertical clearance between the top of the pool structure and the bottom of the barrier shall be four inches (4").
a. Openings in the fence or barrier shall not allow the passage of a four inch (4") diameter sphere.
b. Solid fences or barriers which do not have openings, such as a masonry or stone wall, shall not contain indentations or protrusions, except for normal construction tolerances and tooled masonry joints.
c. Where the fence or barrier is composed of horizontal and vertical members, spacing between the vertical members shall not exceed one and three-fourths inches (13/4") in width and spacing between the horizontal members shall not exceed one and three- fourths inches (13/4") in width. Where there are decorative cutouts within vertical members or horizontal members spacing within the cutouts shall not exceed one and three-fourths inches (13/4") in width.
d. Maximum mesh size for chain link fences shall be a two and one-fourth inch (21/4") square, unless the fence has slats fastened at the top or the bottom which reduce the openings to not more than one and three-fourths inches (13/4") in width.
e. Where the fence or barrier is composed of diagonal members, such as a lattice fence, the maximum opening formed by the diagonal members shall not be more than one and three-fourths inches (13/4") measured at the widest part of opening.
f. Access gates shall be equipped to accommodate a locking device. Pedestrian access gates shall open outward away from the pool, shall be self-closing and have a self-latching device. Gates, other than pedestrian access gates, shall have a self- latching device. The gate and barrier shall have no opening larger than one-half inch (1/2") within eighteen inches (18") of the release mechanism.
C. Prohibited Barrier Locations: Barriers shall be located to prohibit permanent structures, equipment or similar objects from being used to climb them.
D. Indoor Pools: Access to indoor pools shall be restricted by the surrounding structure in a manner that is at least as secure as provided for outdoor pools. (Ord. 2018-01)
