CHAPTER 17

46 FENCES

17.46.010: SUBDIVISIONS:

   A.   A subdivider shall install a six foot (6') chainlink fence along all adjoining open ditches, canals or waterways, nonaccess streets, open reservoirs, bodies of water, or railroad rights of way.
   B.   A subdivider whose subdivision is zoned R-1-15 shall provide a six foot (6') chainlink or vinyl fence along all adjoining property which meets the state of Utah 1969 farmland assessment act (greenbelt) requirement for agricultural use.
   C.   A subdivider whose subdivision is zoned A-1-R shall provide a six foot (6') chainlink or vinyl fence along all adjoining property which meets the state of Utah 1969 farmland assessment act (greenbelt) requirement for agricultural use unless the adjoining property owner or owners and said subdivider provide to the city council an agreement signed by all parties abovementioned requesting an exception. In the event such an agreement is presented to and approved by the city council, the city council shall require a five foot (5') stock fence in lieu of the six foot (6') chainlink or vinyl fence.
   D.   A subdivider whose subdivision is zoned A-1 shall provide a five foot (5') stock fence along all property which meets the state of Utah 1969 farmland assessment act (greenbelt) requirement for agricultural use. (Ord. 2015-10)

17.46.020: FRONT YARDS:

   A.   Front Yard Requirements: No fence, hedge, or other similar structure shall be erected in any front yard of a dwelling to a height in excess of three and one-half feet (31/2') or within the "clear view zone", as defined below.
   B.   Height Exception: Archways and gates for driveway access are permitted under the following conditions:
      1.   Built on a minimum lot size of one acre;
      2.   The width between the side supports must be a minimum width of twelve feet (12') at a minimum vertical clearance of thirteen and one-half feet (131/2') above the ground. (See figure 17.46.020B2 of this section.)

      3.   No part of the structure may obstruct the view of vehicles exiting the driveway of any passing motorist or pedestrian. (Ord. 2015-10)

17.46.030: SIDE AND REAR YARDS:

   A.   No fence, hedge or other similar structure shall be erected in any side or rear yard to a height in excess of six feet (6').
   B.   No fence, hedge or other structure shall be erected on any side yard that would obscure the line of sight of one entering upon the street or intersection from the driveway or garage of an adjacent lot.
   C.   Six foot (6') fencing in a rear yard shall not be located closer than thirty feet (30') from the front property line. (Ord. 2015-10)

17.46.040: CORNER LOTS:

On corner lots, no fence, hedge or other similar structures shall be erected to a height in excess of three and one-half feet (31/2') along any yard bordering a street or front yard of an adjoining lot that has the driveway or access to the garage on the side adjacent to the yard to be fenced, except that in any rear or side yard of a corner lot, a fence may be erected to a height not to exceed six feet (6') upon a finding by the Farr West City building official that the height of the fence will not obscure the line of sight of one entering upon the street or intersection from the driveway or garage access bordering said corner lot. 17.46.050: CORNER LOT OBSTRUCTIONS; CLEAR VIEW ZONE:

On any corner lot in a residential zone, no fence, hedge or other similar structure in excess of three and one-half feet (31/2') in height as measured from the top of the curb or edge of the hard street surface, shall be placed on any corner lot within a triangular area formed by the street property lines and a line connecting street property lines at points twenty feet (20') from the intersection of the street property lines. This area shall be identified as a "clear view zone". (See figure 17.46.050A of this section.)

17.46.060: SWIMMING POOL FENCES:

   A.   Protective Fence Or Barrier Required: All swimming pools, hot tubs/spas, wading pools, or other artificial water features deeper than eighteen inches (18") shall be surrounded by a protective fence or barrier. This includes permanent in-ground, above-ground and on-ground swimming pools, hot tubs and spas. Temporary or portable swimming or wading pools are not subject to the requirements of this chapter.
   B.   Fence Or Barrier Requirements: The design of fences and barriers are intended to protect against potential drownings and near-drownings by restricting access to swimming pools, spas and hot tubs, and other artificial water features. All outdoor swimming pools, including in-ground, above-ground and on-ground pools, hot tubs, spas, or other artificial water features more than eighteen inches (18") deep shall be surrounded by a fence or barrier which shall comply with the following:
      1.   The top of the fence or barrier shall be at least six feet (6') above grade measured on the side of the fence or barrier which faces away from the swimming pool. The maximum vertical clearance between grade and the bottom of the barrier shall be two inches (2"), measured on the side of the barrier which faces away from the swimming pool. Where the top of the pool structure is above grade, such as an above-ground pool, the barrier may be at ground level or mounted on top of the pool structure. Where the barrier or fence is mounted on top of the pool structure, the maximum vertical clearance between the top of the pool structure and the bottom of the barrier shall be four inches (4").
         a.   Openings in the fence or barrier shall not allow the passage of a four inch (4") diameter sphere.
         b.   Solid fences or barriers which do not have openings, such as a masonry or stone wall, shall not contain indentations or protrusions, except for normal construction tolerances and tooled masonry joints.
         c.   Where the fence or barrier is composed of horizontal and vertical members, spacing between the vertical members shall not exceed one and three-fourths inches (13/4") in width and spacing between the horizontal members shall not exceed one and three- fourths inches (13/4") in width. Where there are decorative cutouts within vertical members or horizontal members spacing within the cutouts shall not exceed one and three-fourths inches (13/4") in width.
         d.   Maximum mesh size for chain link fences shall be a two and one-fourth inch (21/4") square, unless the fence has slats fastened at the top or the bottom which reduce the openings to not more than one and three-fourths inches (13/4") in width.
         e.   Where the fence or barrier is composed of diagonal members, such as a lattice fence, the maximum opening formed by the diagonal members shall not be more than one and three-fourths inches (13/4") measured at the widest part of opening.
         f.   Access gates shall be equipped to accommodate a locking device. Pedestrian access gates shall open outward away from the pool, shall be self-closing and have a self-latching device. Gates, other than pedestrian access gates, shall have a self- latching device. The gate and barrier shall have no opening larger than one-half inch (1/2") within eighteen inches (18") of the release mechanism.
   C.   Prohibited Barrier Locations: Barriers shall be located to prohibit permanent structures, equipment or similar objects from being used to climb them.
   D.   Indoor Pools: Access to indoor pools shall be restricted by the surrounding structure in a manner that is at least as secure as provided for outdoor pools. (Ord. 2018-01)

17.46.070: COMMERCIAL, MANUFACTURING AND RETAIL ZONES:

   A.   Any commercial business or operation that borders residentially zoned property shall erect a decorative wall, hedge, or full privacy fence a minimum of six feet (6') in height along the common property boundary or boundaries. The preferred fencing material is full privacy vinyl. Other options such as chainlink with full privacy slats or precast decorative concrete/stone wall may be required if a more durable fence is needed due to the nature of the business or operation.
   B.   Any business or operation that meets the following criteria shall erect a decorative wall, hedge or full privacy fence a minimum of seven feet (7') in height that surrounds the entire property or area affected:
      1.   Dismantling Or Storage: Dismantling or storage of automobiles, trucks, heavy equipment, surplus materials, or building materials.
      2.   Safety Risk: Storage of any items or material deemed to constitute a safety risk.
      3.   Public Nuisance: Storage of any items or material deemed to be a public nuisance.
      4.   Exceptions: Retail automobile sales, displaying automobiles for sale. Vehicles in various stages of repair are not part of this exception.
   C.   The City building official shall make the initial determination regarding items or operations that pose a safety risk, and/or qualify as a public nuisance.
   D.   All fencing material shall be appropriate to the nature of the commercial business or operation as determined by the Planning Commission with the advice of the City building official. (Ord. 2015-10)

17.46.080: FENCES IN STREET, ANTENNA AND UTILITY EASEMENTS:

   A.   Street Easement: Fences are not allowed to cross or be erected within a street easement.
   B.   Utility Easement: Fences are allowed in utility easements, however the property owner is responsible for all costs to repair or replace any fencing damaged by the City or utility company in the course of accessing the easement to repair or service utility lines, storm drains, sanitary sewer lines, etc.
   C.   Telecommunication Towers: All telecommunication towers shall be fenced for security purposes as required in this section.
      1.   Fencing: All telecommunication towers, accessory equipment, and other apparatus associated with the antenna and antenna support structures, shall be enclosed with a six foot (6'), as a minimum, high vinyl coated chainlink or other appropriate fence unless located within a building.
      2.   Development Standards, Conditional Use: The development standards of this chapter shall apply to a wireless telecommunication facility established as a conditional use except as otherwise modified by this section.
   D.   Fencing And Screening Requirements: Specific fencing and screening plans for each facility shall be submitted to the Farr West City Planning Commission in conjunction with a conditional use permit application. Higher grade fencing, more aesthetic fence designs or additional landscaping may be required. (Ord. 2015-10)

17.46.090: NONCONFORMING CONDITIONS:

New fences, repairs and additions to existing fences shall meet the existing requirements at the time of the construction, addition or repair. (Ord. 2015-10)

17.46.100: DOUBLE FRONTAGE LOTS:

   A.   As defined in section 17.08.010 double frontage lots have two (2) street frontages and two (2) front yards. Fencing requirements for both frontages shall follow the provisions of 17.46.020. The street frontage designated as the rear of the lot may have a six foot (6') tall fence located no closer than thirty feet (30') from the property line.
   B.   Exceptions:
      1.   With approval of the building official, double frontage lots, where a street frontage is designated as the rear of the lot or the backyard, are adjacent to lots that also have their rear or backyards on that same street frontage, a solid or view obstructing fence, not to exceed six feet (6') in height, may be installed to enclose the rear or backyard of the lot.
      2.   Where the street frontage designated as the rear of the lot or backyard is located on a street where one (1) or more adjacent lots have their front yards or primary street access on that same street, a wrought iron fence, not to exceed six feet (6') in height, may be installed to enclose the rear yard area of the lot under the following conditions:
         a.   Written approval of all adjacent property owners and the building official.
         b.   Fence shall not obscure the line of sight of one entering upon the street or intersection from the driveway or garage of an adjacent lot.
         c.   Clear view zone requirements of 17.46.050 shall be met.
         d.   Front yard setback requirements for accessory buildings shall be followed. (Ord. 2020-04 § 1)
