B-5 Central Business District
§ 285-18-1 Purpose.
The Village Central Business District is the traditional center of the Village. It is a complex area that must provide space for retailing, offices, transportation facilities, public services and both vehicular and pedestrian movement. Because the area is of historic and aesthetic importance to the Village, and because there is very little vacant land and parking is a serious problem, it is essential that changes in use and occupancy receive careful review.
§ 285-18-2 Uses permitted.
A.
Uses permitted in the B-2 Business District with the exception that carry-out restaurants shall be permitted.

§ 285-18-3 Special uses permitted.
In accordance with § 285-26-9:
A.
Transit and transportation uses.
B.
Antique shops.
C.
Satellite receivers.

D.
Bakeries in which the manufacture of goods is not limited principally to goods retailed on the premises, subject to the following standards:
(1)
Gross floor area of the production area shall not exceed 2,000 square feet.
(2)
There shall be retail sales on the premises and the business shall maintain a retail presence such as signage, in accordance with Zoning Chapter regulations, on the public roadway (not including any public alley).
(3)
Loading/unloading shall be in an alley or in dedicated loading area on private property. Trucks making deliveries or picking up may not park/stand on public streets.

§ 285-18-4 Site and structure requirements.
§ 285-18-5 Special provisions.
A.
The site plan provisions of Article XXVI shall apply only when changes in any building facade are proposed, or when new construction under § 285-18-5F is proposed. Changes in facade or new or modified signs shall be reviewed and approved by the Village Appearance Commission. The review shall be based on standards and criteria adopted by the Commission.

B.
Whereas the Central Business District is predominantly built up, an applicant for a zoning certificate or occupancy certificate shall show how the standards of Article XXIII may, at least in part, be met through a combination of off-street, on-street and public and private parking spaces.
C.
Signs shall, when provided, be in accordance with Article XXII, except that if the Village Appearance Commission adopts additional standards, the more strict standards shall apply.
D.
Dwelling units shall not be located on the first floor of any structure. Dwelling units and any business uses shall not be established on the same floor of a structure, unless, at the effective date of this chapter, there exists a mixture of dwelling units and business uses on the same floor.
E.
Conversion of residential structures to commercial use is prohibited unless a special use permit is approved by the Plan Commission as provided in § 285-26-9.
F.
Whereas the Central Business District is predominantly built up, any building addition proposal to decrease existing provided yards, or increase any existing height, shall be reviewed as a special use under the general standards of § 285-26-9E, to the extent applicable, and under the special standards herein included:
(1)
Any existing off-street parking spaces shall be preserved.
(2)
Any parking required by additional floor area shall be provided by a combination of off-street, on-street, and public and private parking spaces.
(3)
Architectural renderings shall be submitted to show design relationships to the existing building under review, and adjacent buildings.
(4)
Applicants shall show how off-street loading, if needed, may be provided.
(5)
Applicants shall show how refuse disposal facilities will be provided.
(6)
Applicants shall show how a building addition proposal will affect window access to light and air for any residential unit in the existing building under review, and adjacent buildings.
