CHAPTER 1167

Zoning Certificates and Permits

1167.01 PURPOSE.

   A zoning certificate shall be required in accordance with the provisions of this Chapter in order to ensure that proposed development complies with the standards of this Zoning Ordinance, and to otherwise protect the public health, safety, and general welfare of the citizens of the City.

1167.02 APPLICABILITY.

   (a)    No person, firm or corporation shall locate, erect, construct, reconstruct, enlarge or structurally alter any building, accessory building, utility building or structure within the City, or change the use of the building or land without first obtaining an approved zoning certificate.
   (b)    No zoning permit shall be issued which does not conform with the provisions of this Zoning Ordinance.
   (c)    The Zoning Inspector shall not issue any permit authorizing the commencement of work without prior site plan review in accordance with Chapter 1161: Site Plan Review.

1167.03 INITIATION.

   Pursuant to Section 1157.03: Authority to File Application, any person having authority to file applications may initiate an application for a zoning certificate.

1167.04 PROCEDURE.

   (a)    Applications. Applications for a zoning certificate are available at the Engineering and Zoning Office. Inspector, and when completed are to be filed at such office. Each application shall include the following:
      (1)    Name, address and telephone number of the applicant.
      (2)    Two (2) copies of a scale drawing showing the actual shape and dimensions of the lot to be built upon, or to be changed in use, in whole or in part.
      (3)    The location of the lot, its current use(s), and the zoning district in which it is located.
      (4)    The location of the lot, the lot coverage and the height of any building or structure to be erected or altered.
      (5)    The use proposed for each building, structure or area.
      (6)    The number of dwelling units, commercial uses and industrial uses each building is designed to accommodate, if applicable.
      (7)    The required fee pursuant to Section 1157.16 Fees and Costs.
      (8)    Such other information as is requested by the Zoning Inspector for the effective administration of this Zoning Ordinance.
   (b)    Time Limit. If the zoning certificate is issued for the purpose of constructing a new building, structure, or an addition and such construction is not begun within six (6) months, then the zoning certificate shall be null and void. The permit shall be conspicuously posted on the premises affected by such permit during the construction time. The permit may be valid for six (6) months after date of issuance or until completion of the project within one (1) year after such date. Completion for purposes of this Section means that the finished exterior is in place.

1167.05 FAILURE TO OBTAIN A ZONING CERTIFICATE.

   If a permit is not obtained prior to locating, erecting, constructing, reconstructing, enlarging or structurally altering any building, accessory building, utility building or structure within the City, or change the use of the building, utility building or structure within the City, or change the use of the building or land the specified permit fee shall be multiplied by four (4), and a penalty of fifty dollars ($50.00) shall be imposed. However, payment of the fee shall not relieve any person of any other requirements or penalties prescribed in this Zoning Ordinance.

1167.06 REVOKING A ZONING CERTIFICATE.

   A zoning certificate shall be revocable, if among other things, the actual development activity does not conform to the terms of the application and certificate granted thereon. In the event of the revocation of a certificate, an appeal may be taken to the Board of Zoning Appeals in accordance with Chapter 1165: Appeals and Variances.

1167.07 AGREEMENT ENSURING PAYMENT OF CITY INCOME TAX.

   All zoning permit holders shall comply with the request of the Tax Administrator, as authorized by Section 172.19 of the Income Tax Ordinance of the City of Fremont Codified Ordinances, to provide, within ninety (90) days of completion of the project, the names, federal identification numbers, addresses, phone numbers, contact names, and dollar amounts paid or due to be paid to all persons, contractors, and /subcontractors performing work on all projects involving construction, improvement, remodeling or replacement of any real property.
